I have an issue getting my ex to do a financial order. Iv started mediation and now he is ignoring the calls or to engage. How many attempts does the mediator have to take before I can get a signature to go to court? My ex has moved on in a new relationship has children with his new partner and cohabitating. We have an undertaking where no one can finalise the divorce until the financial settlement is in place, yet I can’t get him to engage. I’m self representing he has a solicitor. We also exchanged form Es as his solicitor wanted to do this for table discussions surrounding finances wanted to exchange evidence which we have done, yet half his evidence of finances are missing. How can I get this resolved?

that will depend upon the mediator but as a rule of thumb - 14 days is a good amount of time to wait for a reply before issuing you the MIAM's form

Joint tenancies are a nightmare. My ex hasn't lived in the property for 8 years, he has remarried and has a child with new wife. Council still won't remove him from the tenancy.

If myself and my ex want no part in claiming against each others pension can this be done as a clean break or do we have to declare it and let a solicitor or judge decide the outcome? We know one pension is better but don’t want to go down the route of taking it from the other. We just want to walk away. Thanks

Does form A need to be completed regardless if its a mutual agreement or not, if both parties agree get the solicitor to write it up would a form A still need to be completed?

I had a consent order drafted by a legal guy , who has since decided not help us anymore and has taken outer money and ran, would the court allow me to submit a consent order redrafted by myself with only mine and my wife's signature, the children's court allowed us to this wouldthe divorce court allow this , also does a d81 always need to be submitted when it is a consent order Please help @legalqueen
