Hello po. May pinirmahan kaming ATS sa isang agent, no expiry.. after 3months wala pa din syang balita re sa property. Now may isang agent with sure buyer na talagang intersted. Ask ko lang if magkakaproblema po ba kami dun sa unang agent na may pirma kami sa ATS?

Hi. It depends if the Authority to Sell you signed was exclusive or non exclusive. If not exclusive, then you can have multiple agents represent you.

I have a question. What if in a subdivision a seller wanted to sell his/her 3 lots which is block 1 lot 1-3. Does it okay to have 1 ATS only?

Hi! Its not necessary, unless he just wants to confirm your identity. Perhaps you can give him a copy of your title instead.

Hello and good evening mam, we signed up an ATS sa "broker" referred to us by a trusted friend. Pinirmahan po namin ang ats para mag move na ang negotiation nya sa prospect buyer nya. Pero Hindi nya na discuss samin na nag mark up sya sa presyo ng lupa. Pwed po ba sya mag mark up ng presyo without informing us?

Hi Sonia. The terms should be specified in the Authority to Sell. The standard brokers fee is 5% of the total contract price. Although sellers may give more but thats their prerogative. Marking up is considered unethical in our profession since we already have a standard brokers fee. Whatever the market price is, the broker should discuss it first with the sellers.

Hi, all payments made by the buyer should go directly to the seller or their atty-in-fact. The seller can then give the broker their brokers fee.

Hi Carolina. As per the real estate service act (RESA), only licensed real estate brokers/agents can practice selling of real estate.

Hi Yuan. If you signed an exclusive ATS, you’re supposed to give the listing agent the commission regardless of sold the property. Thats the usual premise of exclusive ATS. Otherwise, you can sign a non-exclusive ATS next time.

Hi. Usually brokers are paid on commission, which is released once property is sold.

Hi, it depends sa content ng ATS. Usually if it is an exclusive ATS the broker who has the exclusivity has the right on the commission given na wlang license ang nkabenta.

Hi ma'am. I know a buyer of a 3 hectares of raw land pero hindi po ako broker/real estate practitioner. Can I still ask the owner/seller for an ATS parin po?

Hi Melvin. You need be a licensed real estate agent or broker to sell property. There is also penalties in RESA for practicing real estate without a license. 200k fine and up to 2 years imprisonment. Question mam: what if an exclusive ats is issued in favor of X but it has been 6 months and X is yet to sell the property as he promised. Here comes Y another broker who found a sure buyer. Can X demand that he be paid commission fee although it was not him who closed the deal with the buyer? thank you po.

Hi Lexter. What’s the timeline of the exclusive ATS? If the property was sold within that timeline, you should get a 50-50 split with the broker who bought the buyer.
