Question: Let's say a municipality or a county has easements for water run off and water pipes, and the county requires easements for access to those facilities, but some of them were drawn in such a way that they cross residential lot boundaries? Like Easement 1 serves a county division to access a culvert, but the line drawn crosses Lot A and Lot B. The language and easement number are the same on the two lot plats, but the lines drawn make the easement appear on both adjacent lots (like a utility line that runs down a street is perhaps an even better example). I am seeing more and more neighbor to neighbor disputes stemming from these scenarios where Neighbor A reads the text of the easement literally and Neighbor B sees the easement that crosses his boundary as conveying some sort of common area access right to their property onto Neighbor A's lot. My advice is always that the easements run with the individual lots and serve the holder at the expense of the servient land owner and no access is implied to adjacent neighbors due to the line crossing their boundary or even mere proximity to the easement. Do I have that right? This week it was a utility light pole on the neighboring lot.... Neighbor A is up in arms because Neighbor B has a light pole on their lot right next to their driveway and hence believes they have access to Neighbor B's lot for general use. I say the easement is for the utility company to enter the easement area and each neighbor lacks access rights.am I correct?

I'm looking at a house that is on an easement. according to the survey the road out front is not a city street, but part of the property, and is labeled as an easement. so as i understand it, all the houses on my block basically have their property extend out over the road that is really a shared driveway. there's no HOA so who is responsible for maintaining it? and if something happens on my portion, do I have to worry about liability? if a pothole suddenly forms or one of the concrete slabs becomes raised and someone breaks their axle on it, do i have to worry about being sued? and are there usually legal requirements on things like maintaining access to the full two-lane width, or is it good so long as one lane can get through and the neighbors dont mind (I'm mainly thinking about temporary situations like where i would park the moving truck or extra street parking if i have guests over)? I'm in florida if that makes a difference.

Hey I live in Asheville North Carolina. 3 weeks ago I noticed a sewage leak on my property. The line is not connected to my house but connects to 8 houses behind my property. I have an easement on my property for that sewer line. I been in Contact with msd and environmental health. It still not resolved. What can I do?

Seems like the buyer should have had a title search done and title insurance and this would have been discovered before going forward with the purchase. Most areas now also have online property maps that would clearly show any easement on the property.

A registered cooperative housing society with limited liability and having 47 members and of tenant copartnershp type owns a plot area In Mumbai. The owner of a neighbouring plot area has approached the cooperative housing society for gaining 12m wide access from plot area of the cooperative housing society. Is written consent of just 24 out of 47 members of the cooperative housing society enough to allow easement right of 12m wide to the neighbouring plot area owner or is written consent of all 47 members needed? I tried to check this in sections of Indian Easement Act 1882 but found nothing. The neighbouring plot has 9m wide access to main road in north direction as the only access to main road and has internal provisions for getting water supply, air and light, its owner wants another access of 12m wide from plot of cooperative housing society so that he can utilize available FSI and redevelop into high rise building, sell to buyers and earn profit. So the neighbouring plot is not a land locked plot and the purpose for which its owner wants another 12m wide access that is redevelopment is not fundamental right of the owner.

What do I do if my neighbor is relentlessly using the easment as their very own driveway, not letting us use what so ever. Leaving their hose out, then building a freaking planter box on it. What do I do here, they are so argumentative. Can I call non emergency police?
