I used to be in law enforcement in Kentucky and the one that always cracked me up was illegal spotlighting for deer was titled molesting deer 😂😂😂😂

I am wondering how on earth they figured out the guy got the tags the day after killing the deer? Did he take it to have it processed without a tag so they caught him that way or was he pulled over for something else and they saw it in his truck. So many questions!

Mr. Fuller's attorney, while trying to do her best for her client, makes the argument that always gets me. "My client is having a hard time because he's in jail!" Well, there's a real simple solution for that.....

I liked Ignatius. He told the truth, and wanted to accept responsibility. Its rare you see that. I would be inclined to give lesser sentences or second chances when I see stuff like that.

Yea if she ends up losing her Nursing career that would be a huge bummer, especially if she really has changed. I wonder if there’s legal recourse for the State’s mistake?

The woman with the expunged record got screwed a few ways. At this point, she now has to petition for her money back, petition state legislature for new laws to get these charges expunged and then if, IF, that goes through, PAY to FILE and have this expunged AGAIN. That's rough!!

But she is still guilty of child abuse. That puts an end to her career path as a CNA (certified nursing aide or nurses' assistant). She will never be hired in a hospital or doctor's office if they do background checks because felonies are always on your record. Her future employers deserve to know what they are hiring. You wouldn't want a person who, say, committed elder or child abuse to watch your mother while you're gone to work, or to watch your child at any day care, would you? It's one thing if you got speeding tickets or a single DUI if you learned your lesson and never do it again. It's another thing if you have committed abuse and still got that child back in your sole custody! Who knows how she is treating them now?

I agree that she should get her money back from the attorney she hired to handle the expungement because he/she should’ve been aware of the law regarding her situation before taking her money, but it’s hard for me to feel bad for her that the conviction will go back on her record without knowing all the facts about the case. Especially since she was convicted of a crime against a child, and it had to be serious enough that the charges were upgraded to a felony, but she is trying to get a job at a school. She may have changed her life around, and to her credit, she completed her probation, got custody of her son, and got an education to better her life, but it’s too risky for a school to hire her. Even with all the positive life changes and staying out of trouble, you never know what can set her off. I looked up the Kansas State Statute, and I’m guessing she either allowed someone to abuse her son, or she was making meth in her home with her kid living there. That’s something a school should know about a person before hiring them, and I’m guessing her job application screening is how they found out that her conviction shouldn’t have been expunged. It sucks for that they granted the expungement and then reversed it, but it’s ultimately her fault for being in that position to begin with. Her life isn’t over. She just needs to find a different career. It’s easier said than done, but she can find a way to overcome this.

On the other hand, if we are going to put scarlet marks on people then the government should support them financially.

@Jedi Da Force "You never know what can set her off." Respectfully, are you kidding me? Putting aside the technicality, a judge granted the expungment. A judge said she completed probation/parole. A judge gave her full custody of a child involved in the felony she was jailed for. She's never re-offended. If she was a danger to anyone, especially children, do you really think they would have let her out of prison? Much less sole custody of a victim of her crime? Come on.

What a great ending. People can change IF they’re sincere about their wrongdoings and strive not only to better their lives, but the lives of others. I also pray that the girl has been able to live a fulfilling life as well.

For the 60-ish yo guy who seems to have long-since corrected his life's path, getting that sort of conviction expunged off his record will be worth it some day in the future when his health declines and he finds himself in need of short-term physical rehab or long-term nursing home care. A large percentage of those facilities will not take someone with that type of offense on their record, even if it was 30-40+ yrs ago and even if the person's health & physical capabilities have declined to the point where there is no way they could harm anyone else. It takes our discharge planners days & sometimes weeks to find a facility willing to take the patient that also has bed availability, and oftentimes these places are a couple hours (or more) away, which makes it difficult on the family.

I am so angry for the lady with the expungement .They didn't give a shit all the money etc should be returned and I would take this to the Supreme court of Kanas. Well, since it was a child abuse case, don't you think that any future bosses have the right to know her past? When my husband worked for hospitals, he did a background check on every single applicant. He was very thorough because you can't have a felon working in a hospital where it's too easy to take your anger out on a defenseless, sleeping or comatose patient. Likewise, you can't have thieves working for you because they can steal anything (especially drugs, needles and syringes). He had one guy apply who had admitted to stealing employee cars from the very same hospital he was applying to! Why bother applying? So he could continue to get government benefits. He didn't want to work so he stole cars, then applied at the same business later on after it was on his record. Free room and board in the meantime courtesy of the county jail and the taxpayers. You can't have domestic battery charges or sex crimes of any kind on your record. These are all non-negotiable. So, even though she has full custody of the child she was accused of abusing, it must stay on her record. It's a serious crime! Yes, she should get her money back because they should've known better when they paroled her and given her better information. But it should not come off her record.

Look at it this way, the lady had the BENEFIT of the expungement of her conviction. She should never have had that benefit and the court is rectifying that mistake. Having said that, i do think she should be given a refund if she spent money on it.

It shouldn't have happened, granted, and I do think it would be fair to reimburse her any monies she paid for it, but as you say, she had the benefit of it not being on her record for 4 years when it should have been. Not sure what the crime was but it sounds as though it was something to do with her child, so i'm guessing that's why it's not a crime that can be expunged.

My husband was a graduate from Brown University and a graduate from LSBM the same law school Judge Simpson graduated from. He was a great public defender so much so that inmates scheduled their crimes around his schedule, just saying that most PD are very good, he was a great defender especially for those who had been wrongfully charged, that’s why we have PD’s, not to lie or try to get one over on the courts.

Let me get this straight . She works so she doesn’t qualify for a lawyer. She can’t afford one so she represented herself. Four years ago the court said if she paid a fee the charge would be dismissed so she went and paid for schooling for a job she can’t have if the charge was still there. Now they said they made a mistake ZFOUR YESTS AGO and they say tough, it’s still there and she can not get a dime back and there’s nothing she can do because she works and can not afford a lawyer and won’t be given one. What a Karen.

Sometimes this is nicer than one long hearing. Thanks for doing this on Memorial Day. It's usually a very sad day for me as many of my relatives died in WW2 and Viet Nam. Damn, I missed a great live stream!. Sorry Mike, I'll try to do better! 😅. I found a couple of the cases troubling, the ones dealing with 'errors' that ended up really costing the defendant even beyond completing their debt to society(as given to them by the system). The debt as they understood it. Just shows that our system is far from perfect, and human error is a good portion of that. Mistakes made in your choices can follow you so darn far into your life. Especially now, in this age, I truly hope young people realize this before limiting their futures. Thank goodness Mike is awesome and doesn't let his clients down, of that I'm certain! I really do feel bad for that lady!! Sounds like she’s tried really hard to turn her life around and the system came in a screwed her. Sucks.. I know I don’t know the back story… but I feel for people who really try to change. Hope she can maybe get legal to help getting the fees back or something!

Doubtful she'll get anything back unfortunately, that's not how it works. Chance she can tap into some programs to help pay for the process moving forward though, all depends on what's available in her area.

Ms. Overstreet is rather loose with her details sometimes. I'm think that Judge Webster is getting tired of her attitude. There is also another court officer in some of his proceedings I have watched. She doesn't seem to be much better.

No, @Law Talk with Mike, you weren’t being naïve or too soft on that guy. Not only did he follow the hardest rule-voluntarily turning himself in-but he traveled to a different state to do it. He’s putting in actual effort to do things correctly. Participating in the system goes a long way with me. He may still be a bad human and do something bad in the future, but unless society wants to freeze him in carbonite like Han Solo, his compliance with the rules is the best possible outcome of the legal system. I wish him luck and hope he keeps doing what he did in the video.

Duhhhh an expungment means no record is publicly visible, existing only at the DA office- sealed. In such cases you can say you have no criminal charges on your record.

What concerns me about Mr. Webber is he moved around a lot - and just because he doesn’t have arrests or convictions doesn’t necessarily mean he doesn’t have victims. The girl was 15 and he was 28 - almost double her age when this happened and he couldn’t tell? Maybe I’m jaded because I’m also part of the predator catching community and I hear these excuses all the time. One thing I’ve learned from being part of that community-most of the pedophiles I’ve seen exposed are meth users, the attraction to minors just doesn’t go away one day, and finally there’s only one cure for pedophilia and I can’t say it on here.

@@Cumdown I didn’t say all of them - I said a lot of them. It’s just a weird correlation I’ve noticed. The majority of them are either stone cold sober or are bringing weed to the minor. And I’m not a catcher - it’s just a community I support because I hate pedophiles.

I do think he’s sincere about not wanting to do anything that risks sending him back to jail. Definitely a subtle “I’m getting too old for this nonsense” vibe as well. It’s also nice to see someone who’s using their jailhouse law library knowledge to understand the process and their rights rather than to try and find quasi-sovcit, poorly interpreted, magic loopholes.

The woman who got screwed with the expungement might be able to apply for a pardon to the Governor. Not sure if it will help her situation.

​@Maritza Fernandez yeah, from reading the statute, it sounds like she either left the kid in a really dangerous situation that involved potential serious injury, or she was bringing them around drugs/people doing drugs. Really surprises me she would still have custody of the kids, but I guess it's next to impossible to permanently remove a mother from her child.

The woman with the expunged record got extremely screwed. That judge blew her off with ZERO regard, but that is the government for you, THEY make the error and come back years later, and it's like "oh well, no biggie, but you're still fucked" have a nice day. I think she should sue the judge and attorney who allowed the expungement because that was clearly a lack of due diligence on their part, and she deserves to be compensated.

Wait, first his attorney states that the calls were to the sister. Now she states that the calls were ALL initiated by the victim. Can't have it both ways lady. Plus, a no contact order covers both initiating contact by the defendant AND accepting contact from the victim.

It seems like it's better to tell the judge, "you're honor, I fucked up, it's my bad, I am 100% at fault, and I am making no excuses" rather than spin them a tale of woe.

Judge didn’t act like he cared about the woman who paid to get her record expunged and it didn’t happen. There should something he could do to help her. Unbelievable

Not much they can do when the state legislature contact them to say its an illegal expunged record. The law doesn’t allow a different decision a judge has to follow the law. Best they can do is advise her to try to claim the money back from the court. She might be able to claim they’re liable as they entered an illegal order which has caused her material damage.
