Hey! I’m confused, i’m not at fault this old lady hit my car at stop sign when i had right of way. Why are u saying don’t go to insurance but call the police? The police said the report automatically goes to my insurance?? Maybe that’s my insurance policy I guess so it has to be sent. The thing is I have a witness who gave me his number for my insurance if they need proof i was not at fault

@@senyorty Hello Sen! Sorry to hear about the accident. Furthermore, my apologies for the confusion. You're correct in that majority of the time, you will indeed need to contact your carrier even if you are not at fault. However, note that because the accident is on your record, it is not guaranteed that your rate will not increase. This very reason is why I mentioned in the vlog to review your policy and see if you are required to notify your carrier regardless of fault. It sounds like you contacted the police and your insurance carrier - which is good because it also sounds like your policy requires you to do so regardless of who's at fault. Unfortunately, carriers have quite a bit of latitude for increasing rates, so its hard to say definitively that they will not do so in this case. They can easily state the increase is not due to the accident and because of some other factor related to your policy. Just watch your renewal, and be ready to argue your case should you be levied ANY increase; especially if your carrier has accident forgiveness. Also, be ready to shop your coverage - because other carriers will surely provide you with amenable rates given you were not at fault, and in efforts to win your business. i just got in car accident other driver did not stop at the stop assign i kept calm buy front of my car damaged and i was left with bruise on my neck took photos of cars and my neck but paramedics showed asked my i was feeling i decided to go home and signed a from them that i said i would be ok to go home at the moment but cops that showed up today to scene told they only file report if someone goes to hospital they collected info frim both of us other driver had expired license from out of US, name didnt match with their car, expired insurance and they let them go, i was thinking i would have to call to file police report i was the one who initiated 911 call but cops seemed to do very little in situation i was very shook during the time to further question cops any advise would be appreciated pls im in california

Hello Nixon - thanks for the comment, and we're sorry to hear about the accident. Great job staying calm and collected in the heat of the moment. And although you feel you weren't treated fairly by the police, its great that you have them involved. This way everything you listed above (expired DL, insurance, etc.) can be documented. Sometimes the impact of a car accident doesn't manifests itself until days after - so you not going to the hospital immediately shouldn't be a big deal. There's no specific question in your comment, but I do have a few suggestions/things to look out for as you move forward through this process. Given the other driver does not have insurance, if you're fully covered then your uninsured motorist coverage will kick in to cover the damages to your vehicle and any related medical costs. Also, since your experience with the police whom aided you in writing the report wasn't stellar, and the fact that the other driver is clearly at fault and was driving illegally, I believe it may be best for you to seek legal representation, or at the very least consultation. This is the safest way to insure you are treated fairly by 1. law enforcement, and 2. all insurance carriers involved (yours and the other driver's). I know the situation may seem daunting, but hang in there, get you an advocate in the form of a lawyer, then work to make yourself whole again. Best of luck!

hello, my dad got into a not at fault car accident driving my car, the crash happened in a one cross stop 2 way street inter. He said that after making a stop at the stop sign the other driver who did not had an stop sign hit him from the passanger side. an officer show up and talked with both of the drivers. the officer didnt even asked my dad if he was ok even tho my car had the most damage. right after he went back to his vehicle, the officer came to my dad and gave him a citation for "not stopping at the stop sign" even tho my dad said he did. the citation was under my name even tho I wasn't even present thats a mistake the officer did there. My dad asked where did he got the evidence from and the officer replied the the houses around had cameras. so my dad asked to see the evidence but the officer told him with a mad mood that he has no right to show him that. this is the first time my dad was involved in a car accident and he also speaks a bit of English. the officer drove off, he didnt give my dad a report of the crash. my dad was in shock with anxiety because of the accident that he forgot to get the other drivers insurance, he only took pics of both vehicles damage. we filed a claim with our insurance about it and told them what happened. is there any advice you guys can give this first timer? thanx for reading all.

Hello Krazie346 - thanks for the question, and sorry for the treatment of your father, and of course the accident. Unfortunately, your situation is more legal in nature than insurance-related. Getting access to the cameras that were available during the accident and refuting the officer's assessment will be an uphill battle, but a lawyer could certainly do it. Thus, definitely seek legal advice as to what next steps should be. In the meantime, remember that your insurance company is your advocate. Also, they have a significant amount of resources (legal team, analysts, etc.) they could offer you to help plead your case. The insurance company may find that its more cost efficient to fight this out in court, than to just pay your claim. In addition to discussing this with your insurance company, you should look into contacting the local police department in efforts to locate the police report. If you can locate the police report, it should contain the other driver's information and their car insurance. Best of luck!

Hello Mike Love Thyself - thanks for the question, and we're so sorry to hear of your circumstances. As you know, its generally illegal to drive without insurance, so the other drive is in an extremely precarious position. This however, still does not help you regarding the resources you're expending to subrogate against the other driver. You're certainly on the right path with hiring a lawyer. Your question is more of a legal one, so we'll allow your lawyer to opine on your chances of winning a settlement. That said, you should also look to your own insurance for coverage. Do you have uninsured motorist coverage? Or perhaps a coverage benefit that would provide financial relief for the rental of a car? Even though you are not at fault, your insurance company is a valuable resource and could be quite helpful in your situation. You may find that you have coverage for this situation, and in lieu of waiting for a settlement/payout through the legal system, you may be able to receive one quicker from your insurance company. Then your insurance company can in turn take the other driver to court to recoup their costs. Best of luck! And we hope this shed some light on your situation.

I recently got into a car accident yesterday and the other car was fault. It was a company tow truck flat bed. The driver did not look back, was not aware of his surroundings and backed up with confidence. He damaged my rear Driverside door. Police was called and made a crash report but prior to that the driver was not cooperative and did not want to provide me with insurance info or license. The officer provided me with his policy number and turns out we have the same insurance company. I only made the claim with his policy number. Was this the correct step to take?

Hello Emmanuel - sorry to hear the unfortunate events, and that the other driver was a little less than forthcoming. Yes, you've made the right moves and are in the best position you can be in post accident. 1. You have an official an account of what has transpired through the police report (and any photos that were taken), and 2. you have notified your carrier. Although you have the same carrier, often times, the amount time it takes to go through the claims process is the same as if you and the other driver had different carriers. As you can imagine, insurance carriers must have a standardized process by which they handle every claim. As such, you'll have to go through every step that you otherwise would have if your carriers were different. Moving forward, keep lines of communication with your adjuster open, and remember, you do not have to outright accept their first offer. Do research yourself regarding the amount of damage your car has sustained, what it would cost to return your vehicle back to its original state, and if you'd prefer used vs. OEM parts. Best of luck during this process, and hang in there - you'll have your car back in no time.

Hello cindy9783 - thanks for the question. You are certainly free to call the other person's insurance carrier. However, take note that insurance carriers are inherently looking to save as much money as possible (pay the least possible regarding claims), as it pads their profits. As such, anything you say regarding the accident that could limit and/or curtail your payout will certainly be used against you. As such, we suggest leaving this to your insurance company. More often than not, your carrier will lead the discussion on your behalf with the other insurance company; and if they don't, they will let you know how to proceed.

Hello TRPXD HD - sorry to hear about the accident. Hopefully all involved are ok. Its unfortunate that this is how you found out your insurance had lapsed. Given this seems to be an honest mistake, I'd try contacting your insurer to see if they could backdate coverage. Assuming you have a fairly long history of coverage, it would strengthen the argument that this was simply a mistake. In fact, they may find that they never reached out to you or sent an automatic renewal (which is typically the case) and are obligated to backdate. In any event reach out to them, let them know what has transpired, and see if coverage can be backdated. If it can't be backdated you'll face fines for being uninsured from your state. Now given you technically did not have insurance at the time of the accident, your benefits may be limited. Some states abide by "No Pay, No Play" laws which essentially stipulate that those drivers that are in accidents, not at fault, and do not have insurance, should not be able to access the full benefits that a driver carrying insurance would receive. Typically this translates into no compensation for claims of pain, suffering and the like. However, you'd still be reimbursed for medical bills or property damage. So although this is time consuming, be forthright and honest during the claims process. And you may find that your insurer has no problem with backdating. If they refuse to do so, you can also try to explain to your state that you simply forgot to renew and they may be lenient with any fines. All that said, what matters most is that you and your car are returned to proper health, and given you were not at fault, that should be accomplished. Best of luck, and thanks for the question.

Hello: I was ridesharing with my vehicle in New York & my passenger opened my left back door while a cyclist approached. The door broke & the left side of my front left vehicle was cracked. The cyclist did not want to press charges & drove away. But the passengers only Zelle'd me 10% of the amount for the repairs. I reported them on my rideshare app but I don't have their personal info & I only have liability insurance. Is there a way I can pursue a lawsuit against the passengers in small claims court?

Hello Kentrc11 - so sorry to hear about the accident. Thankfully it sounds like everyone is in good health, and your car is the only participant that has sustained damage. You should definitely consult with legal representation to hear what your chances of success are if you bring a case to these individuals. I would think you have a fairly strong case, it'll simply be hard to find these individuals. Outside of this, and you may have done this already, but contact your rideshare company. Uber and Lyft's comprehensive and collision coverage extended to their drivers is contingent, and given you only have liability coverage, it technically shouldn't kick in. However, its still worth a call to them to explain the situation. If they won't cover the damage to your vehicle directly, they may have resources (perhaps inhouse counsel) that you can use to try and make yourself whole again. Best of luck!

Unfortunately, you're in a tough position. Regardless of if this accident occurred in an at-fault or non-fault state, you can face some pretty sever penalties. From a legal standpoint, your license can be suspended, you can face hefty fines, and your vehicle can be impounded. From a financial standpoint, you also may have to cover some of the expenses as a result of the accident (medical and property damage). Given the gravity of the situation - driving without a license, and it sounds like there may have been significant damage caused through the accident; you may want legal representation to advocate on your behalf, as the legal and financial ramifications can be significant. It's always questionable to engage with the other driver's insurance company by yourself. You may not know exactly what the other driver has told their insurance company, nor does the other driver's insurance company have your best interest at heart. Due of these factors, you should definitely contact your insurance carrier first. Often times, they will either engage the other driver's insurance company on your behalf, or have a lawyer do so. Either way, the starting point will be to contact your carrier - then ask them how they would like to proceed. Best of luck in the process!

Christopher - our apologies for the accident. That said, it sounds like the process is going as smoothly as possible. You're asking the right question - and your patience in accepting the other driver's insurance company's offer, may very well payoff. Always keep in mind that these carriers are for-profit entities looking to maximize profits wherever possible. As such, your best interest may not always align with theirs' (and most times will not). As such, do research. How did the other driver's insurance company calculate your car's value? Is it ACV or RC? Concurrently with this line of inquiry, do research yourself on the market value of your car. What are cars similar to yours selling for in the market? Use online tools to generate an estimate value for your vehicle. And yes, you can also reach out to your carrier to get their thoughts on the valuation. Once you've triangulated on what is an appropriate valuation for your vehicle, you can better assess how to move forward with the offer the other driver's insurance company put forward. You're definitely on the right track in questioning if you should have just accepted their offer. Maintain that patience, do some research, and engage with the other driver's insurance carrier to ensure you receive a proper and fair valuation for your vehicle. Best of luck!

I got into an accident where this lady came out of a shopping center into the street when she had a blind spot and tboned my car she admitted to the officer it was her fault I went to the Hospital and all that with them and the officer telling me her insurance will be paying for everything im going through the process now of my car being inspected and deemed totaled what can I do or is there anything I could do to get payed in full for my car and or then some? I was told by a friend i will be contacted by their insurance and they will hit me with a payment offer so that I don't sue? Any info or tips on how I could maximize getting cashed out would be appreciated.

Thanks for the question Doug. We hope you're feeling well. Your friend is correct, the other driver's insurance company will contact you. Alternatively, you can proactively contact them. The other driver's insurance will need to pay for the replacement of your vehicle, any medical bills, and any pain/suffering the accident may have caused you. Now typically litigation will not be an issue given its in a carrier's best interest to settle outside of court. That said, do your homework, have an understanding of the value (payout) you should receive given the totaling of your vehicle, medical costs, and any pain/suffering you may have been caused. If they're offer does not meet your threshold, be ready to take the discussion to court. You have made the correct first step in understanding that this is a negotiation, and you do not have to simply accept whatever the other driver's insurance company proposes. Best of luck Doug!

I am dealing with Allstate right now one of their drivers hit me I was in the expressway NY time 8pm 45 miles and their driver was at the stop sign he didn’t wait for me to pass and just hit me in the rear passenger’s side door Door is completely busted and the alignment is completely damaged Their adjuster I talk to five months ago got all the information and tried to blame me 30% and 70% their driver I have a dash camera so everything was on video I sent them the video and waited and their adjuster never got back to me contact with Allstate again they appointed another adjuster contacted by him now they want to blame 80% their driver and 20% on me I did not accept because their driver hit me I was in Expressway and he was in the stop sign ,the adjuster was telling me that I did not honk or flash the light trying to blame me and all stupid things Any advice much appreciated thank you

I'm in exactly the same position as you right now. I'm dealing with Allstate and they blamed me and asked me to pay for the other 20% even thought it was absolutely not my fault. I have police report and their client got a ticket for failed right of way at STOP sign and pulled in front of me. Any suggestions on my case? Were you able to get 100% coverage back? Hello Simone Gardina - thanks for the question, and we're sorry to hear your partner was in what sounds like a relatively bad accident. Hopefully they are recovering well. In regards to your question: given your insurance company will reach a payout settlement with you regarding the vehicle, they will then become the owners of the vehicle. This assumes you either own the vehicle outright, or the settlement covers any remaining payments you may owe on the vehicle to a lender. In either case, once you agree to the settlement, you are no longer the owner of the vehicle, your insurance company is. Part of the process of accepting the settlement will be filling out paperwork that transfers ownership and releases your vehicle to your insurance company. Make sure to do research on the value of your car, and don't feel obligated to take the initial settlement offer. Ensure that what your insurance company is offering is fair. Best of luck!

@@simonegardina4339 - this is more of a legal question, so I would ultimately reach out to a legal representative to get a definitive answer. That said, the insurance company's possession of the vehicle is not punitive. They are doing it because they've deemed the car as totaled and have paid you for the vehicle in lieu of repairing it. They assume you will simply use those funds to by a similar vehicle. As such, this isn't (re)possession in the traditional since; whereby someone misses payments for a given asset (in this case a car). Due to these facts, we'd be hard pressed to believe your credit would be penalized in any way. Once again, this assumes whatever settlement you agree to covers any remaining payments you may owe on the vehicle.

Hello Masa - thanks for the question; and hopefully this is just for general purposes and you have not been in an accident. The answer is, it depends. Some states stipulate that insurers must cover OEM parts. Then some insurance companies cover OEM parts only for newer vehicles. Thus, if your vehicle is older, then the insurance company may ask that you pay the difference between the cost of the after-market parts and the OEM ones you'd prefer. Ultimately, insurance companies more often than not will try to maximize their profit, so whenever they can use after-market parts they generally will. As such, just make sure you know if your state requires insurance companies to cover OEM parts, and what your actual insurance policy states.

I been in a non fault rear end shunt a few days ago while I was driving my brothers car under my own car insurance as my car was in the garage for repairs. I not really had the time to sort it as I think I been in shock over the weekend. Today, I get a phone call from the other drivers insurance NFU who fully admit liability. What would the process be, I wouldnt say I was badly hurt. But had to have a day off work as a HGV driver although I tried to work, just couldnt climb into the cab of my lorry in order to drive it. The other driver said he didnt see me when he hit me. The police didnt get involved nor were there witnesses. It appears they fully admitted blame. What would the process be. My brothers car is likely to be written off due to its age and the chassis is damaged and tail gate would not close. NFU have got me a telephone appointment with a doctor to access my injuries which I am pretty sure are just muscular injuries. My brothers car is insured to the value of £2300. What would the likely pay out be if the car was written off as he will need to replace it with a similar sized people carrier car. The car was in good condition.

Hello Stephen! Thanks for the question, and its unfortunate to hear of the accident and resulting injuries you sustained. It appears you may be located in the UK. Given we only operate within the US, I would definitely reach out to digital brokers that are based in and familiar with the UK's insurance market and laws. That said, if this happened in the US, there are a few things to look out for as you progress through this process. At no point should you feel pressured by the at-fault driver's insurance company, either for your medical injuries, pain and suffering, or the damage to the vehicle. Make sure to take the time necessary to fully assess any injuries, pain and/or suffering. This should include an actual visit to a doctor. A missed diagnosis could end up with you fitting the bill for any injuries that manifest themselves a little further down the road. In terms of the vehicle: the insured value with your brother's insurance company shouldn't really come into play, as they will not be paying out. That said, the at fault driver's insurance company may use that as a data point to arrive at an agreed value to settle the claim. In this regard, make sure you and your brother do your due diligence to ensure you're receiving the most possible for the vehicle. Once again, sorry to hear about your accident. But be patient (although hard to do) through the process, so that you can ensure that you're being paid adequately for the pain and suffering you have endured, and to restore your brother's vehicle back to working order. I guess the bright side is that it sounds like no one was in your mother's vehicle, so everyone should be in good health. As for the car: make sure to formally file a police report so the accident is documented. You may have done this already, but if you have not, ask your neighbors, nearby store owners, anyone within eyesight of your mother's vehicle if they have video that you can review in efforts to find the perpetrator. After all, they will not want the perpetrator to come back through the neighborhood and hit their car. You'll also want to contact your insurance company. If you have full coverage then you'll more than likely be covered by uninsured motorist coverage. Once again, we're sorry to hear the unfortunate news, but hopefully your mother will be made whole through repairing the vehicle.

Yes. If they are at fault.... You're insurance isn't involved. You will file a claim with their insurance, on the accident report you will have his insurance information. Once you file that claim, his insurance will review along with the police report (usually takes 10-14 days to process). They will have sufficient evidence that the other driver is indeed at fault and they'll repair your car. Sometimes the at fault driver will call the insurance the same day (Hey I'm liable I messed up and need to fix this guys car") in that instance the process goes much faster.

As noted above, Flavio is correct, however note that your benefits could be limited given the fact that you were not insured. Many states abide by "No Pay, No Play" laws which essentially stipulate that those drivers that are in accidents, not at fault, and do not have insurance, should not be able to access the full benefits that a driver carrying insurance would receive. Typically this translates into no compensation for claims of pain, suffering and the like. However, you'd still be reimbursed for medical bills or property damage. Also, unfortunately you may also be subject to fines and penalties for driving without valid insurance. Hopefully the process of making you whole has already begun, and everyone involved in the accident is on the road to recovery.

Fineeko - our apologies for the delayed reply. Hopefully this has been settled. But if not, it sounds like you already have your insurance company involved. If so, definitely communicate through them. Your interest and theirs' are generally aligned. In addition, your carrier has the legal resources that may be required to secure the best terms (in this case liability percentages) for you. This is precisely why its generally better to work through your insurance company versus contacting the other insurance company directly. The other insurance company does not have your best interest at heart, and they have an unlimited amount of resources (legal in particular). Hope all has worked out in your favor, or is at least trending that way!

My friend was hit from the side and back. The kid that hit him was speeding. My friend had already made the turn and the kid hit him out of nowhere. Police said my friend was still at fault yet gave him a warning on the ticket. But if he's at fault why a warning? Felt the police sided with the kid and the witnesses said he drive pass them fast and the kid didn't see my friend in mid turn. It sucks that this happened and it isn't fair. Wish I knew a way to get justice.

Hello NerdyDope Artist - thanks for the comment and we're so sorry to hear of the unfortunate events of your friend. An accident is already an emotionally charged event, and having the police perhaps misinterpret the events that transpired can only make things worse. First and foremost, we hope that all parties involved in the accident are doing okay. As it pertains to your attempts to support your friend: remember that you and your friend are not alone in trying to reveal the truth about what has happened. Your friend's insurance company is also a strong advocate that has a great deal of resources. Now your insurance company is certainly a for-profit organization, but that doesn't mean that justice and profit cannot align. In this case, the insurance company may be able to subrogate against the other driver if they can prove that they were indeed at fault; essentially limiting the amount they may have to pay out (ie save money). Make sure your friend provides details about the event, including any videos, personal testimonies by witnesses (recorded perhaps) to their insurance company. If their insurance company still decides that the officers on scene were indeed correct, your friend could always seek outside counsel. This route would obviously be quite expensive, but could save your friend money over time via the absence of rate increases, assuming your friend was successful in proving that they were not at fault in court. I know its a laborious process, but it provides the best opportunity for fault to be correctly placed. Once again, we hope everyone has recovered from the accident, and best of luck!
