All too often I am approached by an heir months or years after a probate is complete. They often tell me something like, "After my relative died, I signed the probate paperwork that they put in front of me, but now I am realizing that it was all done incorrectly. What can I do?"
Before you sign any probate paperwork after the death of a loved one, it is best if there is open communication, you understand the big picture, and someone should be able to answer questions to your satisfaction.
Whether you are being asked to sign an Agreement allowing the personal representative to be "Independent," or whether you are being asked to sign a Verification of a Petition for Possession, or whether you are asked to waive the accountings otherwise required of the executor or administrator, make sure you understand your rights.

Right now I’m in camp 2, I trust my brother but he’s not that transparent because he’s hard to get a hold of and doesn’t tell me much. And he told me in a phone call that he has no power, only he has to be fair but then at the end of the phone conversation he said, “but I’ve heard I can also say screw you to the people involved and just do what I want!” With a sardonic tone. Then in the letter accompanying the waiver renunciation and consent, the lawyer stated he can’t answer any legal questions because he represents my brother and not me. Even though my mother paid for it and we were all chipping in on the next lawyer fees. So when I called him he was condescending and said “that’s not how we do it here!” Because I mentioned something we did when my mother in law passed away. He didn’t tell me anything just that he represented my brother. Is that normal? I had thought we were all working together. When I asked my brother about it he said you don’t trust me! And now he won’t call me or take phone calls. And said some angry things in a text but did text he would do 100% what I wanted. Aren’t these all red flags? I don’t know where to proceed when I can’t talk to the lawyer, him, or my mother.

Thank you for presenting this information. I was unexpectedly in the position of dealing with probate court after my husband's death. For my own protection I did seek legal advice & didn't sign anything until I understood it. There is of course an emotional aspect to death called grief, which can be almost paralyzing. So while in this state, it's necessary to deal with the business aspect-the estate, the court, the insurance companies, the finances, etcetera. Thank you also sir for acknowledging the need to trust one's own instincts.

I am a co-trustee of a spendthrift trust for my brother, and unfortunately, we are going to hand the trust over to the district court in an effort to close the trust. Money does funny things to people.

I'm the top co-executor on my mom's living will and her will, and I'm her birth son. And I'm a benefactor to my mother's living will and her burial insurance as well , And I'm supposed to inherit a truck on the will... how well did that work out for me...😂... just read my emojis ..😅😅😅😅😅.. my mother's step-son and step sister has taken full control. And has robbed the place blind😅

Estate planning is essential to prevent probate. Without doing this, not only do you have to deal with grieving, but the complicated legal processes and papers impossible to understand without an attorney. It's just sad everything is MONEY. DYING is expensive (medical costs). Even DEATH is expensive.

Since you’re going over Louisiana laws comes to probate I have one for you that maybe you can answer and go over because I’m sure I’m not the only one that is going through this right now. My father passed away with no will. My mother is still living. When they got ready to build their home she had inherited in the state of Mississippi property from her father who had passed. She sold that property and use the funds to buy the property here in Louisiana that our home is built on. We have been told that the house reverts back to her because she used her inheritance for the property. Now I take care of her and I took care of my father. I have one sibling that is money hungry. She wrote her will stating that she wanted everything to go to me I am executor, power of attorney, medical power of attorney. My parents used my college fun to send him to school. They cosign for two loans that he defaulted on that they had to pay and they paid off hot checks and he went around riding. They also cosigned for him a house Here in Louisiana that he had to sell because he could not afford the notes and was about ready to have it repossessed and it was about to come back on my father. Being that I will be the sole inheritor of my mothers estate how will this go?

What happens when you are presidient probate papers and refuse to sign for 1 reason or another What happens to the probate process then?

What if you never knew that they were doing anything? I live with them. I never signed nothing. How are things going with no one telling me

I agree I have the same question. What is if a person knew they were dying and signed an orderly? But they withholding it and I don't know.

Ok what if every thing was left in a trust and and my aunt quit claimed me well my aunts add them self to the title deed .But my grandparents found out and had my aunts quit claim it back to my grandparts or they new it was already in a trust and when my granfather passed nothing was brought. Up than 13yr later my my grandmother passes yet the trust was never brought up yet.so they prorated at no valuable consideration the front house with my mom the back was never brought up cause my already had faulse deed of trust on the back house when they did quit claim back to my grandparents they used my mother quik claim as a title deed of trust as if she sold the property over to my aunt and her husband so once they probated the front house only them after word my aunts and my uncle went back to the lawyer office and probated again but with out my mom and this time the probate was for a valuable consideration and I just see my name from there on substitute trustee over and over or as if I married so and loan after loan after loan i already talked to my family my aunts dont want to talk my uncle said get ur lawyer and that it wasn't his fault. It was all my aunts yet he s the one claiming to be me as my grandfather son you got to help me her i know how you say you don't get involved in contesting and that u get involved in the start to make thing right from the start can u see my point thats thats what I'm asking from u now to just go as the way the trust was written please 323 335-5804 is my number.
