Apparently playing through the game, it seems that even though Agent Milton and the Pinkerton's approach Arthur peacefully with an offer of turning in Dutch and then Arthur and the rest of the gang will go free. The game doesn't actually give us an option of whether to accept or reject Milton's deal, so it seems that Arthur rejects the deal automatically.

When the Pinkertons confronted Arthur and Jack they never said he could go free, they just said he wouldn't hang. They could have just gave him life in prison. Second time they showed up at camp they still never said the gang could go free, just have a 3 day head start before they are hunted for the rest of their lives. The only reason so many got happy endings was because Abigail killed Milton whose sole ambition in life was to eliminate Dutch and all who cared for him.

the funny thing is that arthur asks everyone in valentine if they saw any pinkertons, but the veteran in rhodes knows that they are here.(i taked to him way to early) so i assume that this mission better fits in chapter. i don't know if you can trigger this mission in ch.3 tho. but it would be cool besides the other fishing missions in this chapter.
