As far as a legal standard goes, the law does allow for an exception to an intent based crime based on mental capacity. The basic idea of a defense based on mental incompetence is the idea that if someone is unable to understand the nature of their actions due to a mental condition or impairment then it can negate the intent element of certain crimes. However, it does not necessarily allow someone to "go free." The lack of the prosecution to prove a specific element of an intent based crime such as murder aforethought may allow the defendant to not be convicted on the murder charge, but still be convicted on the lesser manslaughter charge. That's why prosecutors will often charge a defendant with multiple counts; they go for the big one so to speak, but still get a conviction on the lesser count. Mental incompetence is also considered during the sentencing stage. A couple of good movies to watch on this are "Anatomy of Murder" and "Identity." Movies often get many things wrong, but Anatomy is pretty strong.
