Also, I just wanna point out that the owner is clearly wildly wealthy and very hands off on the business so at the end of the day they're just in it to feed their lavish lifestyle and probably don't want to deal with revenue dips impeding on their TWO MONTH VACATIONS but aren't anywhere near involved enough to actually grow the revenue of the business.

Anytime Ive had that its been doctors offices or tattoos. Last tat I had with a fee it was a down payment of $100 that went towards the tattoo as long as I showed up (I paid $300 in total for the tattoo). At the doctors its $100 for each no call no show after the first one. That makes sense, if I rescheduled I wouldnt be loosing out on money.

Just because they write it on their website, and you have to agree upon it to engage with their business, doesn't automatically mean they're enforceable.

The first offense was tracking them down. I've worked for places like this and the owners are all self-important weirdos, who do make great food, but forget where that food ultimately ends up. I'm on Trevor's side here, because he did everything he was supposed to do. Chase is a major banking corporation, if they felt it was within their legal rights to dispute the charges based on any hospital records Trevor put forward, then that's a pretty open and shut case. True, the restaurant did miss out on the prospect of having those seats available, but that wouldn't be strong enough for the courts to side with the restaurant owner. Something also tells me a jury of these people's peers is not going to side with a restaurant owner who uses priviledged information to stalk and harass a person on social media, let alone a judge in small claims court.

The insurer would seek to recover the money from the businesses on your behalf. If unsuccessful, they would then take the hit. I'm guessing the insurance was handled directly via their card, and therefore the insurers were able to recover the funds using a chargeback.

I could be wrong but possibly charging for the full price of the meal rather than a genuine cancellation fee might be what left the restaurant owner open to being charged back. I seem to remember the form that's submitted to the credit card company says that it was confirmed that the customer did not receive the good or service, which of course if you're charged for a meal you didn't eat then you can easily claim this.

Yeah it seems that the clarification is saying that the credit card itself has the travel insurance on it, which I have def heard of before. So the credit card company handles reimbursing the customer and does charge backs to regain their money. It's not a separate insurance company, it's just the credit card company wearing two hats.

It is also likely that the card processor agreement was involved as well. Many card processor agreements require that you represent in all transactions that the amount in the transaction represents a sale to the customer. And that by holding the entire cost of the meal as a "cancellation fee" the resturant thus misrepresented the transaction to the processor constituting the chargeback being done. also additionally they were probably penalized with an additional chargeback processing fee by the processor on top of the original transaction, which could have added another $100-$150 or more to what the credit card processor deducted from the resturant's account with them. These chargeback fees are usually pretty stiff and expensive. As the processor has them in place to encourage business owners to work with their customers regarding refunds and such.

It's completely legit for a small business to charge a lot more than the average, particularly for a 5 or 7 course meal or whatever, but where it gets dodgy is the "cancellation fee" seemingly being the WHOLE fee. That's actual extortion. But yeah, a lot of people see high prices and think "They must be doing well", but when you think about it, that can't be how it works because what are the biggest food companies in the world charging? Small amounts... just to a lot of people. Toyota is a much bigger company than Ferrari... etc.

Uh yeah, Table Boston has one of the worst reputations of any restaurant I've seen, and MARKIE made a video on them a while back. The owner is a rancid human being. I fully believe it was Jen herself on the phone who called Trevor "so butt hurt" given other reviews I've seen of the place. Would love a follow up on Table Boston in general Orr, it's a deep rabbit hole that I think you'll enjoy covering.

I'd believe that too, the "butt hurt" comment is on part character wise with how the owner conducted themselves through the text messages. Alternately given how much a a caustic ass the owner is, it would be not surprising for members of the staff to be the same.

So essentially calling someone "butt hurt" was saying that they were a child that had been spanked. Though as I stated before homophobic people HAVE used it some times, but it's not that wide spread.

I'm a small business owner and I agree. I hate when people use "small business owner" as some badge of honor, as if it doesn't take a couple hundred dollars and, like, 2 or 3 forms to be a small business owner. Though I also hate Amazon, but not because they're a big company - because Bezos abuses his workers and Amazon sells anything, including counterfiet products and products that can hurt people.

Culinary school kids and parents money. I was a chef for 10 years in Denver. Damn near every restaurant owned was by a rich kid that went to culinary school, couldn't make it as a line cook, thought they knew it all, stole all the recipes, and then let dad pay for everything. The rest were a few good people, and then everyone else was rich wine country people that watched food network, bought. a restaurant, paid $4 million for the looks, and then just hemorrhage money for a year before failing and stiffing the workers on their pay. I made good money as an executive chef, but NEVER enough time to take two months off. Maybe a 1/3rd of a day during the normal 100 hour work week, but not two months and still have the restaurant run smoothly.

Exactly and either way it’s not Trevor’s fault. The restaurant owner was apparently told that he was hospitalized, and it’s not up to the owner to question that. The owner needs to be contacting the credit card company that did the chargeback at this point and needs to settle it with them, not with Trevor!

Nah that’s completely normal for insurance. Insurance isn’t just a pool of money you pay into and then get paid out of when you need it, it is primarily a money making business. They do whatever they can to keep ALL the money you give them, and only once all their avenues of recouping that money are exhausted do they eat the cost.

@@olhydra yeah I know how insurance works lol. I work in insurance. I used to be a claims adjuster. Now I don't really know about travel insurance tbh. A charge back is not insuring anything. That's what I'm confused about. Like I used to do a lot of rental car claims where they charged the customers credit card. This would bee like instead of paying out on the claim we just took the money back from Hertz and gave it to the customer lol.

It's likely the credit card provider DID payout the customer... the charge-back in question being something the CREDIT CARD PROVIDER themselves did to recover the loss, most like under a provision the card processor has with the credit card provider's network. And the charge-back hitting the restaurant due to provisions regarding transaction representation under the processor agreement with the restaurant.

as someone who's done fixed-menu dining at a similarish pricepoint (but a real different set-up), it's awesome. mine was a bday gift from my mother, and we had a very lovely time. for a cancellation fee to be 100 percent of the cost is insane though.

You're right to be suspicious of her expressed concern for her staff. If she acts this way towards potential paying customers, she's almost certainly treating the people reliant on her for a paycheck *at least* as poorly. It honestly makes my blood run cold to think about. The most blatantly abusive bosses I've ever had still had enough of a grip to not pick fights with their customer base.

You’re very welcome to visit another time.’ Any not covered cancellation fee shouldn’t impact the restaurant as it wasn’t a loss, it was only a fee to potentially make up for guests that were sent away because they weren’t able to use the table because it was reserved, but then this can’t have been the case either. Not appealing to even consider booking a table and going there if you get tracked down and harassed. Don’t say you respect or appreciate guests. Seems a joyless place.

Unless I'm misunderstanding their model, communally served food isnt 'every single person gets their own separate dish prepared just for them', so 2 people not showing up just means everyone else gets slightly more to eat that night right? His travel insurance is through his credit card. So I wouldn’t be surprised if they way they “insure” you is by doing charge backs on all of the charges. This would be incredibly crappy because credit card companies will stop processing your charges if you have too many charge backs. But it would explain why she is insisting that he did a charge back even when he is saying he used travel insurance through his credit card. She wouldn’t have probably noticed if the credit card just went through differently from a normal charge.

The very nature of charges for no-shows really do need to be considered case-by-case. My anxiety wrecks me when I miss an appointment because the bus is 40 minutes late. My blood pressure raises exponentially when I so much as think of being late for something. I get that some people will abuse reservations, but things happen. Maybe a $10 charge might be acceptable, but nah. I don't go to businesses with crazy cancellation fees.

hospital records literally record the time you were admitted/discharged. they would not have refunded the fee unless the person was TRULY in the hospital at the time of the reservation, so there's no doubt on that part.

Every time I hear this story I'm just like ...these people are out of their minds. Because even if they DID manage to track down their missed train etc that's not proof that that's why they had to cancel 💀 They could have missed it BECAUSE HE WAS STARTING TO EXPERIENCE SEVERE AND SUDDEN SYMPTOMS. They also would NOT have known about that when they refused to remove the cancellation fee when they called and told them why they missed the reservation. They had absolutely no evidence whatsoever at the time of refusal to even remotely think that they were lying. They went out of their way to try to prove that they aren't just money grubbing monsters who refused to reverse a cancellation fee for a customer who called in and told them their partner was in the hospital. Also. They don't HAVE to provide THE RESTAURANT with proof that they missed it due to hospitalization. They have to prove it to their insurance company and they did. Your hospital records and when you are admitted etc are not public records so it doesn't matter if they only posted a picture in the hospital the next day. And insurance companies are not super well known for allowing folks to use their benefits willy nilly so it's actually wildly bizarre for them to claim they weren't in the hospital when they said they were. And again. Missing the train in no way means they weren't dealing with a medical emergency at the time and it's super messed up to accuse someone of not being in an emergency situation just because you're greedy and wanted to take their money despite the circumstances they were notified of. And regardless of if they believe that they were lying...they did refuse to refund them and they had every right to dispute it. 😐 These people are absolutely nuts and their restaurant seems like a terrible experience to begin with. Tf would I look like paying $125 to rub elbows and breath the damp air of a stranger practically in my mf lap while we SHARE A COMMUNAL MEAL when you can find a good restaurant with actual seating and not have to eat off the plate with strangers? A fool. I would look like a fool. 😐 These people lied through their teeth throughout this entire harassment and it's wild that they're like "We're getting ded threads!" Like no one should be calling them to do that but also....you harassed a couple for literally following their insurance protocol. 🙃
