Massad Ayoob's advice in this context was to be the one to immediately call 911 if the attacker flees; for this very reason. He said the first one to 911 is 'the victim" and the other one is 'the perpetrator'. Excellent points in this video. I view my cell phone as a weapon in this context for these reasons. You can't just walk away because the attacker fled.

The decision to use force is a subjective decision. You do it when you believe you should, knowing that decision comes with a lot of risk. Do not take on that risk unnecessarily. Do not create situations where you have to make that decision. In the self defense context, firearms are for protecting people.

Doesn't matter. There is no true legal answer to the question of appropriateness. There are only defenses to why shooting can be justified. Folks hate "laywer talk" tho. They prefer clear-cut answers.

Paul Harrell (RIP) , told a story of him and a couple friends were out shooting and someone started shooting at them from a distant ridge. Bullets were hitting around them and all they did was take cover. Finally the shooter left and they appeared to be no worse for wear. If they had returned suppressive fire, which would make sense, I’m sure the worthless judiciary or LE would have tried to criminalize their defensive actions.

@@blatherskite9601- there’s levels to deescalation and escalation, you increase between “non-lethal and lethal”. Basically between “verbal and taking a life”. When scenarios arise you have to MATCH the threat level, not go PAST it. If the situation is verbal keep it verbal. Once lives are in danger then you have to make the decision of “preservation of human life”. YOU ARE THE JUDGE AT THAT MOMENT, make sure you are mentally, morally, and emotionally prepared before getting into the thought process of taking a life to save a life.

Well explained and I enjoyed the video. There are many different concerns about when to draw your firearm in self defense. There are many concerns about the facts of what is going to happen afterwards with many false witnesses, police, and the nosey neighbors. Criminals don’t care about anything about you and they are lawless, the false witnesses are looking for recognition and praise and maybe make money and the neighbors that are in everyone’s business are going to abuse and hate you and they become a MOB. They hated you even when you started carrying and training with Firearms. Life is going to change even if you are legal in every way possible in defending yourself. You can be a Hero and you are still considered as the threat to your neighbors and you are not going to have any body on your side. People are not looking at the things after a self defense incident, the innocent people are the enemy not the criminals.

I've been carrying for years, and watching this makes you question why carry. What might seem a good time to pull your weapon might not be a good time to do it for somebody who wasn't there and wasn't afraid like you at that time. It's good to be that person outside looking in and not actually there, to someone who is actually in that situation and say oh he/she should have done this, or they should have done that

You carry to protect your families lives, not your own. If someone tries to kill a loved one and you stop them, you are sacrificing your life for theirs. It may not be fair, but that just seems to be the way it is. All you can really do is just pray that you never have to pull that gun.

This “attorney “ seems to be saying leave your weapon at home and die if things turn sideways. I went to a local meeting with police to talk about these things and the lead officer told me I looked like I could defend myself without shooting someone. The problem with getting older, it takes less to disable an older person than it would have when I was 25. Even if I can go in for a 5 minute fight, I can’t outlast a younger person or several even younger teenagers. Cops with training , get their butts handed to them all the time by bad people. This society is crazy and we need to deal with crazy by making crazy realize there are deadly consequences and it could happen to them. If not, we are doomed and just leave your weapon in holster until you’re beaten and they take your weapon and use it on you.

The very most important things in any shoot situation are; recognition of the immediate threat, becoming violent enough fast enough, render the immediate area safe and then call for help!! Render aid if possible and wait for the police. Call an attorney!

I told an officer at a meeting about a police encounter. I had a cop pull me over ,first time in 35 yrs and I got out of the truck to see what he wanted. Big mistake , but when you don’t have encounters where your last encounter was, you were expected to walk back , then things go sideways. The officer got behind his door, pulled his weapon and yelled “ what are you doing?” He ended up having me go to the side of road and I told him I didn’t mean to scare him. Yeah, he didn’t like that either. We went thru the dance of what I do for a living and when I told him I flew helicopter evacuation, all things changed and all was good. The cop I told this to at the meeting , was amazed a cop would draw on me at a routine traffic stop and told me I was lucky he didn’t fire. I try not to look intimidating, but it seems I have this thing about me that even my medical crew said I look like I’m capable of anything. Anyway, leave it in holster.

I am getting my CCW in December. But I have a body camera that I had to buy because of a stalker situation that's also the reason I'm getting my CCW. I will have that body camera on me whenever I am carrying just in case I need to use the gun.

I have my CPL in Washington State. I leave my firearms at home except on range day! Too many people have been charged for brandishing. And if the threat stops and I continue I get cuffs! Not allowing that!

Basically like state of Vermont says in self defense law defined as clear as it can be; When you are in reasonable fear of imminent bodily injury or death! Reasonable must be taken seriously and it is on prosecution to prove it was not. Attacker shows Intent, ability and opportunity all 3 must be met. Also in VT self-defens law definition, you do not have to be hit first or punched to wait to defend your self. Prosecution in case all is done by the book,have very slim chance proving it was not lawful and legal self defense. Be smart and know state self defense laws you reside in.

Our concealed carry instructor was a man of few words. I took the course just after the nation wide story over a Houston man killing a burglar coming out of a neighbors house with a TV. When pressed our instructor said, "I'm not killing a man over my TV. So I'm damn sure not killing one over a neighbors TV." So then someone asked him how to know WHEN to shoot to kill. And he said, "We don't shoot to kill! We shoot to live..." I never forgot that.

Being an attorney sometimes lawyers (have not passed the bar test)for self-defense cases is a good business so do your job that you are paid to do at the court and let the clients decide when it's the right time, the right time being as the law states and of course being a true self defense, stop telling them not to (almost) defend them or their families... life goes first, do your job even if it is a hard case, and the judge is your cousin.

Living in Ohio, we have the Stand Your Ground statute, and the Castle Doctrine law. Do these laws give you specific rights as far as use of deadly force? I was always taught if the offender has the Ability, Opportunity and puts my life in Jeopardy. Thanks Matt

If you even have to show your gun, CALL 911. First to call is the Complainant. That's how it works, unfortunately. "I was threatened, I showed my pistol, and the threat backed down.". If the other guy calls first and says you threated him with a gun, you will be charged with brandishing.

Happened to me I was followed by 6ppl to my mailbox in apt complex arguing started they came towards me I pulled my firearm that was it then got in my car and left came home cruisers everywhere I got arrested for aggravated menacing because they said I pointed it at them screaming racial slurs I ended up beating the case and keeping my firearms with a public defender then got the agg menacing charge expunged

How about if the person attacks you have a history of crimes. Do we still have to go through the legal process? I live in OH, and I see a lot of criminals and drug dealers carry guns, and they shoot people right away for small things without any hesitation. So, do we have to wait until we get shot? I still don't understand how it works? Things happened so quickly. If you wait for the other person to draw it first, then you are gone.

Even if it is ruled that you did everything proper is gonna cost you a lot of money for a good lawyer and your life will be impacted for the rest of your life. And I know several individuals that now wear body cameras whenever they carry concealed. Might be a good idea.

I wonder why this atty. never mentions probable cause. That’s what we were trained to watch for. When that comes up it’s the right time.
