As a judge her opinion is pretty important. Whats hard about asking a judge if they agree with a court decision? She will be the one setting new precedent similar to those cases in the future. Not great to see a potential supreme court justice who couldn't even do that when asked questions by senators before an appointment.

This isn't low level court. The letter of the law isn't simple, it's interpretation of the law. Who interpretates will absolutely reflect in the judgement. This is the highest court of the land, there cannot be crazy religious nutjobs interpretating law, then you will have crazy religious outcomes, much like that in the Handmaids Tale.

She is right when she states that Congress has the responsibility to make statutes and the Court is limited in its review of those statutes only in respects to their constitutionality, that’s not me saying that (or her actually) that’s the Constitution and Marbury v. For presidents both parties picked an old nominee that could honestly die any time in the next 10 years at the drop of a hat. However, neither party would do that for a supreme court nomination. Anyone nominated to the supreme court is going to be young and sharp, because the party controlling them will want 30+ years out of them.

They have the ultimate say on whether or not a law should stand and how that law can be applied by making case law. And in cases where there are no laws they do make the law through established case law. Of course they have to limit themselves to the constitution but we all know that it doesn't always go that way since humans are biased.

Judge Barrett correctly states her personal feelings & opinions are not only irrelevant but stating them would also be unfair to litigants in future cases. She wants everyone in her courtroom to know that she is acting in a fair & impartial manner. That is called integrity. This is what you want in a Supreme Court Judge. I pray she gets confirmed.

The Supreme Court does not decide what's "right"... they only make the ultimate decision with regard to the legislature's actions (laws passed) being within the boundaries of the Constitution. I agree with her on social issues, that should not be decided by the courts, but the Will of the People through their elected officials. I just hope she realizes that is not how Trump works. His social causes have not done well with the highest court in the land. He was hoping a conservative court would help him politically. As he will with this pick concerning the upcoming election. If she is a strict Constitutional Judge as she claims, she will respect the separation of powers and not involve herself with the politics of the moment. That's why conservatives, in general, feel betrayed by the other conservative justices... they only like activist judges if their politics align. Activist judges have no place in our Constitutional Democracy and that is what I expect from ALL judicial nominees.

*if* She means what she says. Then i am absolutely in favor of her as a moderate. It is the job of ALL judges to interpert the laws as they are; laws made by the Legislative branch. Not to make them. It is a Judge's moral obligation to set aside all personal opinion when issuing a ruling- morality is the plaything of Congress, not the Supreme Court. And if she can accomplish this, and mot behave like an activist. Then she is doing far better than most Judges ever have.

That's all fine and dandy when the founding fathers had you in mind when they crafted the constitution. But for people like me, and ironically Amy Coney Barrett, they did NOT have us in mind. In fact, I was considered 3/5 of a person. So when it comes to the constitution, yes, interpretation should reflect the times we live in and the advances we have made. It's called evolution.

it is near impossible for a human being to dissociate from personal bias throughout their career, even if only slightly. add to that the fact that she would be entering a position of great power and you're seeing someone who has a greater chance of falling victim to their personal bias. the fact that she's so personally ambiguous is really worrisome to me - a judge, albeit like a stone, should heed the progression of their society appropriately to ensure the most adapted interpretation of their constitution is emplaced. To subject any society to an antiquated interpretation of their constitution as research, technological, and societal progressions advance is to pull the wheels off of a thousand-year-old wagon and leave it stranded, resting in comfort as the world spins by it. sorry to be all poetic or whatever lol, but it's an important thought.

May be a good pick, but I disagree about following precedent. Only follow if you agree it was a good decision. There had been a lot of bad precedent overturned, like slavery, women voting, etc. Follow the Constitution...best you can.

That isn't how law works. It's the job of congress to create or amend the laws. The judicial branch only interprets and enforces those laws

You're confusing two of the branches of government. The Supreme Court did not abolish slavery or give women the right to vote, that is the legislature's job. Upholding precedent is part of the Judicial branch of government, stare decisis. Google it... it exists so courts are consistent. If the precedent is not to the public standard, they elect officials who legislate a difference. If this is objected to and makes it to the Supreme Court, they decide if the law is constitutional or not. Precedent is an integral part of our government.
