The point is that she doesn't care- they all know that this is a critical moment, that *genocide* was just committed, and he's ringing his hands about procedure instead of doing what they both know is right. If he really wanted to, Cap could've changed uniforms and helped off the books, or he could've helped, stood by his actions as righteous, and accepted the consequences. But instead he made excuses, because it isn't a fight he's willing to stand up to his superiors over. Cap *is* letting them down, he's absolutely stood up to his superiors to do good and nessecary work in the past, asking forgiveness rather than permission. And he isn't doing that here, because it's not really his fight.

With Ms. Marvel, she held onto her as long as she could, completely draining her power and putting her into a coma. That gave her Marvel's powers permanently. Or until she finds a way to return them. Source: the 90s animated X-Men. There is an episode that explains it.
