UPDATE on this and edited reaction: kzbin.info/www/bejne/e4LCgmNrjNdgqJY I may not have clearly mentioned this, but the strike came from Pony Canyon, and I definitely understand why now. When I filmed my reaction and reformatted the footage, they were both things already up on KZbin, so it didn’t seem like it would be a problem, or at worst just get claimed or blocked. But I’m not looking to blame anyone else for this. Just venting my personal frustration that it ended up in a strike. I’m grateful that it’s only one strike!

I don't know but as of this moment, mine is still up with no problem! But then I used the original upload, unlike most reactors that used your upload. Has anyone else gotten a strike or been taken down? IDK but I'm not going to take the chance, I'm going to go ahead and take it down and post it on my Patreon for free. Also, this is NOT the band, it's Band-Maid's publishing company.

countless times i have gotten a reaction blocked and a few strikes when big channels like yours have no issues. Though I do not wish a strike on anyone it should be large channels do not get treated better or get away with stuff. When this video came up i avoided it just for the strike reason, saw that one coming. You should get a strike if everybody else did

Sorry this happened. The staffer who published the video is really the person who messed up. I don't blame them for not wanting a low-quality phone video to undercut a new song debut. FYI Blocking is an automated function of YT ContentId. Since the new song isn't in the system, blocks couldn't happen. The takedown request form only allows two options: 7 day notice and immediate removal which results in a strike. So, there isn't really a convenient way to retroactively block a previously released video. It was a confluence of circumstances that started with the IG bootleg. The hype was intended to be around the 30 second clip released by the band. You were really of the victim of circumstances.

Hi Wave, I got 2 videos taken down last night as well & received 1 strike. Gotta just wait it out 90 days for it to expire & just kinda take it as part of the territory with sharing music 🎶 content. It's unfortunate, but sometimes these things happen, so it's a better path for us to somehow take this positively by respecting Pony Canyon's decision. I think you can write an email 📧 to them, and they might remove the copyright strike.

Hey, Wave. I know it's a bummer to have that copyright strike over your head, but don't take it as a personal attack. Think of it from the label's point of view: The full song was released before the official teaser was even published. Pony Canyon has been VERY permissive when it comes to reaction videos-even when it comes to bootleg recordings of already published songs and older blu-ray recordings-but no label would be happy if an unreleased song was already circulating on the internet before the official unveiling. I think we take free-flowing distribution of IP for granted so much, that we get offended when someone tries to protect their IP. There are literally hundreds of unauthorized Band-Maid live recordings circulating on the internet that Pony Canyon lets slide, but distribution of an unreleased song crosses a red line-and that's ultimately a high bar.
@steveherman6909
@steveherman6909 3 ай бұрын
IP should always remain with the artist. Record labels have a contractual agreement that they get exclusive rights to share the IP. Publishing companies hold the copyright to the IP of the artist that the label has the exclusive right to share. System failure.

From Japan Thank you for always supporting BAND-MAID. In Japan, filming live performances is not permitted at the moment. I was surprised to see so many live performance videos uploaded to KZbin this time. If this were allowed, many people would film and upload them to KZbin without permission. The rules in Japan would be broken by fans. I feel that Pony is trying to protect not only their company, but also Japan's live performance culture. They have never forgotten the support they receive from Reactors. It must have been a difficult decision for them as well.

I have a feeling the label didn't expect any video recording of the song would happen (other than the 30 sec snippet Band-Maid released) due to the fact that you can't record videos with your phone in Japan. Maybe they did not know that the fancam video was posted by The Warning...or maybe it wasn't posted by them (the internet isn't always reliable). So they figured it was recorded by a fan and that was why they took it down. Either way it sounds like a miscommunication between The Warning camp and Pony Canyon - and you don't deserve a strike. In short I don't think The Warning was suppose to post that video (Afterall the song is going on a Band-Maid album) so technically it's a Band-Maid song.

In Japan, even if some scenes such as concerts are reflected, it will be against the law and It doesn't matter whether the video is the photographer's or shared one will be subject to immediate deletion. That's why it set up a shooting time during the concert. The video shot by the fans this time is clearly against the law in Japan, and we can't complain even if it is deleted. So it's wise to wait quietly for the MV or album to come out.

Hey Wave, sorry to hear about the strike, but life goes on and you'll be fine. In Japanese we say, "Shigata ga nai" which translates to "It cannot be helped" or "What's done is done". When learning this in college, in my small pea sized mind, I actually thought is was best to combine them, although not technically correct. "It cannot be helped, as what's done is done." Take this as learning experience. Copyright has always been a touchy subject and going forward, I would definitely avoid unreleased/unpublished material. In the back of my mind, I was thinking someone is going to to happen, as the Maids mentioned it was going to be coming out on their new album and also saw the 30 sec teaser put out by the Official Band-Maid channel. As for Pony Canyon I think everyone needs to take a breath and cut them some slack. They has been very lenient with previously released content, not on or no longer on Official "free" sites. There's a few channels posting material which are still behind paywalls out there, but at one point they were published in one way or another and have not taken those down. I think we've all just learned where "the red line in the sand" is for Pony Canyon.

It's alright, Wave. You'll sail through this no problem. The strike will be gone before you know it. I think they probably went with the Strike in order to make it very clear that "leaks" and "unauthorized fancam footage" are unacceptable. I guarantee you will never put up another video that is recorded in the same way, and probably not any "leaked" songs either, if anything like that happens to come out. From Pony Canyon's point of view, that's mission accomplished. I get that. I don't agree but I get it... Well, I *would* get it, if the video had been from a random fan. But this was from the other band's management. Because it was from the band, I think permission was implied. Bad move from them.

Imagine what happened to The Warning crew member that posted that full length video, they are likely looking for a job today. If the reaction would have been limited to the 30 second clip posted by Band-Maid, it likely wouldn't be an issue. Reprocessing the pirate video into a different format is what likely took it from a block to a strike, as that takes it up a step in making the video escape the piracy algo. A pirate video is a pirate video even if it was pirated by a crew member who should have known better than post it.

I don't know who did the stream, maybe it was somebody of The Warnings crew, but certainly it wasn't "The Warning" as you said. What really shocked me was the "I feed my wife and kid from this channel" part. Things like that could happen any time to YT channels, 3 strikes doesn't sound that much. Don't you think it's a bit too risky to rely on the YT income to support a family? And also, as hard as it is and this may sound harsh, the management sadly owes you nothing because you're doing reaction videos of them. Thousands of people are doing this, sorry. While I am pissed about this, again nothing wrong with blocking it, striking it is too much since one of the crew posted it themselves. @@kixx91 They should have just left it online then until the official video is posted, then block the videos after the official one released. What good does removing the video? It only gives bad press, nothing good. People have already seen it and are hoping for an official video with good sound and videoquality, it hyped up the album and did a better job of it than Band-Maid/Pony Canyon did before. It did the job the official video was supposed to do and made people more excited for it. Stuff like this happens, they should learn to roll with the punches, but a lot of Japanese companies are terrible at doing that unfortunately. I am absolutely NOT watching that official video nor reactions to it and I hope I am not alone (I probably will be) and I am seriously thinking of not importing the album either. First of all, Wave, I hate to see you get the copyright strike. Hopefully you can get it overturned or retracted. Do we know whether this strike came from Band-Maid management or The Warning management? Contact a band to see if they will retract or unblock as case may be. Rick Beato got a block from Led Zeppelin. Fans took to social media and let Robert Plant know and Mr. Plant had the video unblocked. In that case it was the label. Band-Maid love reaction channels. When I saw them in Dallas in 2022 Miku asked if people liked KZbin reactions. Then she asked if there were any reactors. A guy yelled out wildly waving his hands. Pigeon looked and pointed. I spent a lot of time adding English subtitles to 6 Band-Maid MV's and they got tens of thousands of views over several months. The monetization went to Nippon Crown and they, Revolver and Pony Canyon seemed fine with what I'd done. Then, one day, their old talent agency, Platinum Passport, hit me with two strikes on two of the videos and, having had my channel since 2008, I removed the other four before YT terminated it. Now they're all on my FB site, BAND-MAID SUBTITLED MV'S, instead! It'll all go back to normal in 90 days so just be very careful until then. It's just the way it is so the easiest way to deal with it is just to accept it. Anything else and the only person being stressed will be you, not them - and we don't want that. Stay safe.

So who has initiated this strike- The agents for Band-Maid and/or the Warning? I think we have been lucky with Band-Maid up to now, who seem to put the songs we like and share on their channel to enjoy. We don't know but if it had been a Band-Maid thing alone it would have just got blocked as usual. I've just thought- As a collaboration, who owns this song anyway?
@steveherman6909

Ideally, the musicians should own the music, but that's not the case. While a case could be made that musicians hold Intellectual Property rights to what they compose and play, copyrights are under the purview of the publishing companies. Not the folks making the music and not even the record label. Fault lays with the system and not this camp or that person.
@bobespirit2112

It sounds like Pony Canyon will be the Publisher as it’ll be released on Band-Maid’s album. They would surely be the ones initiating the copyright strike. The band members will share the performers royalties. The Composer royalties will depend on whether The Warning participated in developing the song or just performed their parts as written for them by Band-Maid. If they participated, then Ale, Dany & Pau will split that 50/50 with the Band-Maid members. It can get pretty complicated depending on who exactly participated in the writing and in how any band members decide to split that money. Most bands break up of money when 1 or 2 members who do most of the composition and lyric writing, and don’t let the others participate, and then take all those royalties for themselves. If a band is smart, even if 1 or 2 do the bulk of the composition and lyric writing, they ask for, and receive input from the other members (yes, even the drummer 😂), and they split all that money evenly amongst them. But they make it fair by having the members who aren’t doing as much work in composition and songwriting do more of the “other” band work - planning & scheduling rehearsals, travel planning, merchandise designs & oversight, band finances, release artwork, etc. And i think that’s exactly what Band-Maid does as we see Saiki take the lead on merchandise usually. It’s said Akane plans their rehearsals. I think Misa probably helps Kanami quite a bit with the composition and arrangements these days. And ofc Miku writes most of the lyrics but Saiki helps more nowadays. Bottom line, they try to split the overall “band” workload as much as possible, so they can split the rewards equally. The band Rush was famous for using this model and i think most recent bands have learned those lessons and why we see many bands staying together for longer periods, say than many 60’s & 70’s bands did who broke up over the money.

A few things: 1) Pretty sure BM and their people are the ones who didn't want their song to get out. Japan has strict rules on videos of live shows. I'm sure TW's people just had to comply. Not on the band so don't take it personal with TW. 2) the labels feel they dont need reactors to promote the art of the art is good enough. And they are good enough so they are banking on the art to reach the necessary audience when released. 3)Reality is reaction videos aren't making that much of a difference with TW success. Many people that are recommending songs keep finding old folks with small channels to get them to react. No one is aiming high. And outside of you and a few others, the videos don't contribute much to them.

The Warning are going to continue to grow, they are young, extremely talented and smart. They don't need the buzz from this collab as much as Band-Maid do but their team were obviously proud of the work they were doing and happy to share the experience. It was an unfortunate decision to issue copyright strikes and potentially shut down channels that are one of the few ways Band-Maid is discoverable. [Edit: I edited this as it seems the rights holder had limited options via youtube to block instead of strike, and whether it makes business sense or not it is their right to stop unauthorized copies] Band-maid are a good band but practically impossible for most people to find unless they somehow pop up in the algorithm. This is a tough era for any rock band to succeed let alone a Japanese language band that doesn't have a lot of youth appeal. Any publicity, even low quality fan cams is probably a win for them. Ideally the label should have released a single and MV or at least announced them as most reactors would not have reacted to the live video if they knew an official MV was on its way.

But in the end Pony Canyon will find the universal success of their bands will suffer if people are scared of sharing unofficial videos. Short sighted and in the end will take money from their bands when people don't share reactions and music. Bad business on their part not to have an official release ready. What were they waiting for? They should know by now that fans in the West are drawn to Bands by unofficial videos and reactions. This makes me not want to watch any more Band-Maid reactions. I know the band themselves has nothing to do with this, but I absolutely hate labels doing that stuff. Nothing wrong with trying to block videos, I know Japan has different rules for stuff like this (especially fancams), but the main reason they grew overseas is because of reaction videos and I honestly can't support labels removing fancams or reaction to non-ripped stuff (I understand removing/blocking reactions to blu-ray or DVD rips). I knew them changing to Pony Canyon was a bad thing. I am actually seriously contemplating to stop buying their stuff until they go to an other label. I should probably cancel my fanclub/prime subs as well. Good luck promoting a band that has no fans left. Honestly, all reactors should stop reacting to any Pony Canyon artist, bands would find their way to other labels over time and Pony Canyon can keep their anime driven J-Pop stuff which is clearly the only thing they care about anyway.

Sorry, but this is overreacting. There are literally hundreds if not thousands of unauthorized Band-Maid videos on KZbin, and Pony Canyon isn't taking them all down. @@billb.5183 I get that, but the only thing the fanrecording did is making people hyped for the album. I have no issue with them trying to block the videos, I have an issue with them giving reactors a strike over it. Western reactors do more for hyping up Japanese bands in the West than most labels do. If I hadn't reluctantly seen a one of the Band-Maid reactions a couple of years ago, I wouldn't have imported over 300 physical CDs/DVDs/Blurays from Japan, I wouldn't have gotten tickets for over streamed shows and I would certainly never had gotten into a fanclub of a band I never even heard about. I get they are trying to protect the recording, but this wouldn't have impacted the official video nor the album, I would say it even brought more hype to it. They are attacking the wrong people, they should have attacked the Warnings crew member instead. But most Japanese labels just don't understand how much impact reactors can have on a market that is not really serious about expanding outside of their own country. They just don't understand why anyone would want to listen to Japanese music outside of Japan (it's very similar to the gaming industry, but they have somewhat gotten it the last couple of years). Removing stuff ripped from DVDs/Blurays/streams is one thing (I understand why they do that), striking a shitty fancam that has people hyped is an other.

@@archaeopteryx981 This is 100% overreacting, I agree, but this is the only way to stop labels from overreacting as well. You can not imagine how happy I was when Gacharic Spin moved to Band-Maid's old label instead of Victor (who are/were worse than Pony Canyon in trying to control bands directions). Nippon Crown is a great label for bands, but they don't have the anime output obviously which helps growing in Japan. I personally prefer bands that are able to play and produce what they want and were the label tries to find fans instead of shooing them away over something petty like a fancam that doesn't hurt their bottom line whatsoever. It's more a principle issue for me than anything else.

The other side of the coin is they are the ones that have created the material, they own the copyright, and they have control over how it's used. So, any video that you react to, you are stealing the work of others to line your pockets either financially or intellectually. You are the same as all the people that want to book a band for free and "you will get great word of mouth". Radio stations and Spotify pay a royalty albeit small for the playing of copyrighted material. There are plenty of reactors that rarely get anything blocked with a much larger viewership. My guess is that they get permission first. So yes, you are whining, and like many people doing the same you don't want to do the work. You want the hard work of others to subsidize your hobby.

There’s been two that were struck. Both say it was probably because they tried to monetize the videos and that they probably missed the 7 day window to remove the vid before receiving the strike.
