Nomiki does NOT represent all or most New Yorkers! I've lived in NYC for 35 years and this guy was killed at the stop near my house and committed crimes in my neighborhood. Our city has failed people with drug addiction and mental illness by leaving them to roam the streets and New Yorkers to fend for themselves - then the city blames a guy for protecting the people on the train. Migrant gang crime and people who are unhinged in closed subway cars - terrorizing New Yorkers. That's what we are living with. People don't realize how scary ti is to be trapped in a car with someone having a mental breakdown and threatening others. He'd also, on other occasions, punched an elderly person in the face, and tried to kidnap a little girl.

As a former Marine to say we were "trained" in choke holds is freaking absurd!!! We might have had a day where we trained with pugil sticks, ie bayonet training, hand to hand basic strike techniques so we didn't break our hand if we were in that situation and some sweep and stomp basics as well as the use of weapons of opportunity. Training may have changed since I was in but usually if a Marine is in a situation where hand to hand is necessary something has gone terribly wrong. Now if he would have shot the guy from a 250yd IKD range sure that Marine is highly qualified in that situation but hand to hand is VERY basic in standard USMC training!!

The 'shoot them in the leg' thing they talked about in the video is a good one where the public's perception does not align with reality. Also, if you've ever wrestled . . . anyone, you realize that going at half speed normally just isn't an option. You have to really try or you are going to get in trouble quick. The break point between winning and losing is not always apparent and probably one you don't want to be near. That is to say that an attitude of "he should have done just enough to accomplish control while keeping the situation totally harmless" is easier said than done. Doing what's necessary to establish control comes with risk.

Someone with no priors could threaten a person. *It's wrong the first time.* A person with many priors might just have been goofing off and not scaring anyone this time. The guy was much smaller than Penny, and was being held down by THREE grown men. The threat was over. No justifiable reason at that point to keep strangling him. None of this is reasonably arguable. It might as well be a text book case in how to commit a crime by misusing lethal force when not necessary.

As a native New Yorker and former MTA employee I lived through the experience of working and traveling with unstable people on those trains. To the point where I was even assaulted. I fault the justice system for these unhinged people roaming freely. In my case, even after myself and another woman testified in court and having multiple priors in 4 boroughs, the man was let off with a couple of months in a mental institution. Just to later be let free again to commit more harm to innocent people. My family and I did not feel safe living in NYC anymore. Moved to PA in January and couldn’t be any happier with the decision.
