I use to work for a summer mayor campaign to help bring awareness to underprivileged communities. A majority of them went towards Hispanics/blacks and barely any in Flushing/Chiantown. Prob once every week/2 weeks. Whereas, those communities gets 3-5 days of service each week

Because you can claim he was aiming for head or torso, and was instead blocked by arm. The defense would have to prove there was no intent to kill, which should be easy imo, cuz after the first slash, and the guy cowering away, John didn't continue going at him.

I agree and I also agree w/ the comment above lawyers. A good lawyer can make a difference. I have multiple Asian style blades in my home. Although I’m more of a defense person and I’m good at deescalation tactics, I could see myself in their shoes.

Assuming the store owner didn’t not have enough resources to drag out the case he probably pleaded out to get expedite the situation. I was in similar situation too it to trial and beat the case. There is a law that states if someone attack you must use equal force. Meaning if 10 people jump you law expects you to run if possible or use equal force which is non manageable. Now it’s known the attackers are privileged. Appeal the case and sue the attackers

From that video, he walked towards them with the catana. If they ran towards him and he had that weapon and he was at that moment using the weapon to stop them from attacking him , then I think it would have been different. BUT I also believe those 5 attakers should have been charged with a hate crime, at the least. But, maybe the Asian guys pressed charges for that and it just fell through because the DA didn't charge those guys for a hate crime at all. Making it very upsetting for the Asian guys getting attacked physically and verbally..

I think in legal terms the asian left the scene to get the katana so according to the law, he was able to leave the fight to a safe place but returned with a weapon to continue so he wasn't defending himself but now attacking...just saying according to the way the legal system works

We all have the right to self-defense in the event that we feel are lives may be in danger. It's a bad legal precedent to say that we're unable to physically retaliate after being attacked. Wielding the samurai sword wasn't a disproportionate response, imo. A 5-on-1 scenario perfectly warrants its use. The only way a victim has any chance of surviving an attack mounted by multiple aggressors is with a weapon. Ain't no way in hell he'd be able to fend off multiple dudes barehanded. Real life isn't the movies.

True, I had to flee a group of carjackers at a gas station in rural Oklahoma that managed to dent my car while I was fleeing. I didn't call the cops because I didn't feel like getting victimized twice in the same night. I've seen too many bodycam videos where cops ignore evidence and arrest victims. I remember someone asked me about police funding and I expressed indifference. He tried to guilt-trip me by saying "don't expect the police to help you the next time you're in trouble". I told him that I didn't even call the cops when carjackers dented my car. That shut him up real quick.

Sadly, I have to agree. If his brother was in the middle of being beaten and he intervened to try and save him, he'd probably have an ok defense. But from the video, his brother was behind him and the beating had already happened (past tense). Nobody was in imminent danger in the moment. Deadly force can only be applied for *imminent* death or *imminent* great bodily harm. That being said, I'm still surprised that the other 5 guys didn't get charged for their previous beating. I think the charges against the guy with the sword are warranted. But I find the lack of charges against the 5 other guys completely unacceptable.

That doesn't sound right right? Something is off about this case right?
