Does waiting matter if the injuries and the pain and suffering is going to easily go higher than the available policy limits? I would think in that case it should go pretty fast comparatively. Especially if you are found Not-at-fault.

How could some of you be so critical of what this guy is saying!!!??? He spelled it out as clearly as I have heard! Explaining it throughly and honestly! The attorney has to wait until you are released from medical care, to know the extent of injury, medical treatment and the cost! Would you rather your attorney simply throw a dollar amount out to the defense!!?? I was injured tripping in a poorly maintained parking lot. I have had two major surgeries and am still in physical therapy following the second. I know I have at least 3 months before the surgeon releases me. And, the trip and fall occurred over a year ago!!! I will gladly wait until everything needed for the right settlement is in!

I have a question.. 3 years ago my husband was hit by a Construction company van -- I lost my car and my husband has lost his job do to his injury.. -... My question is I now has to do all the things men do like cut grass - bring bag's in from the store - do the snow - outside yard work & all the things inside the house cause he can not stand long - we do have a lawyer on this -- he can't walk with me in a store - so vacation stuff is out.. I can't dance with him all the things he was - he isn't today.... Is there a name they have that I can be compensated for the actions of the accident... Everything is on me too do he use to do.. Not fair too a couple that was capable of living our lives together as we met each other when we got married...

I signed my release a year and a half ago and nothing still. I understand they need to pay leins but it doesnt take a year and a half. I called and there is no balance. It was a unfair amount paid due to damages and the bills are more than amount rewarded. Why so long its been 4 years?

Time to hire a new attorney. That waiting period can be depending on your PD and injuries, can take someone 6 to 12 months. If it’s a serious injury it can take 12 to 24 months And if you had a big surgery it can take 3 to 4 years. We learned it from interviewing an attorney on our talk show. So if they have a case in my name along with his - do that mean its a together case? Cause I had to care for him since the injury.. Both legs was not in use for him to do anything...will they seek a case for me,,, they do have my name on his case..

Thank you. If my lawyer would have explained that to me in that way. I would understand. Unfortunately he did so I was feeling like they was not being helpful. Sometimes I feel like I'm not asking them the right question. I'm not a person who calls a lot or be mean, but I didn't understand when they are just responding like a tape recorder. If they know it can take x amount of time I feel like its ok to just say that. In my case not only am I in pain, I couldn't apply for jobs I want within my job, and he evicted me so I don't have a place of my owe. I couldn't afford the place because I couldn't no longer do OT. Which was about 3k down to I think 1.5k. I try to stay strong but its hard.

Well I was injured in an auto accident back in November. The person who rear ended me was not insured. I finished medical treatment in January and I have received lost wages in January also. It is now April and no settlement. Even though this is going through my own insurance company

I listened to you more than once. I'm just trying to figure out if there is a threshold for injury cases? Is it normal for a back injury to take 11 years? It happened at work in a state vehicle. Person was the passenger. L5 broke in half, surgery's 2, cage and screws, used bone from other parts of body to make tiny spine, 2nd surgery due to screws were rejected from body. Screws started pushing there way out. Approximately two 1/2 years wait until nothing else can be done. An offer wasn't made yet? The Lawyer's are well known but I feel a mistake was done down the line. Any advice would would be great.

That's not the normal time to settle a claim but each case is different, and there may be a reason why your case is taking so long. We have had workers' comp cases that remain open for decades. You should make an appointment for a face-to-face meeting with your attorney and ask when you can expect to receive a settlement, and what the plan is for obtaining that settlement.

@@KrystinaStar We are in the mid-atlantic states and we are headquartered in Delaware. We have had workers' comp cases that remain open for years because the medical treatment takes years. We have had cases where the defendant goes into bankruptcy, which stays the proceedings and jams up the case for years. We have had cases where we sue and win but the defendant can't pay the award and it takes years to collect. You really should meet with your attorney and find out what is taking so long in your case. Every case is different.

I think with companies that have high insurance possible payouts it takes longer because those lawyers are probably paid well to drag it out.
