My uncle is retired from the IRS. I got an LLC before I did a single post/video, etc. You need one as your first step, hands down. Even if your channel never takes off, you need the LLC **before** you start. 2nd step: get an EIN from the IRS. 3rd step: take your LLC paperwork and EIN and get a business bank account. Research the best states for LLCs for creators; you don’t have to get your LLC in the state you live in.

@@vegasrichsave Absolutely! I went with a small business only bank that restricts their customer base to small business and online creators. It’s literally called Small Business Bank. Since all my LLC operations are online, I chose that over my local credit union (which also does business banking, as well as personal). I wanted to keep them very separated. It was a piece of cake to get my Small Business Bank account Stripe verified, and connected to my business PayPal account. (I have a BuyMeACoffee account that works through Stripe.) It can all be super confusing but I took my time and did a lot of research on it.

@@Thanasephtis-bu Once you have an LLC, you need an EIN to file your LLC taxes. Turbo Tax has a version where you can do your personal and LLC taxes in the same software, but you still need the EIN for the LLC tax filing. This is especially important if you are going to pay yourself a salary as an executive of your LLC. Otherwise, the entirety of your income from your businesses (with or without an LLC) is taxed at a personal tax rate instead of a business tax rate. It pays to keep them very separate like that, and decreases your chances of getting a personal tax audit visit from an IRS agent. I hope that makes sense? Let me know if I’ve confused you more, and I’m happy to reword it.

This is all solid advice and it works. On my channel, we try to make everything containing copyright into a completely new video by layering the video with commentary, color grading, flipping the frame, audio editing, and simply making the copyrighted content into our own, in a transformative matter as the Fair Use Doctrine demands. We also have an S Corporation for our media and content creation so we have more legitimacy with KZbin. Finally, we then are always sure to include a Fair Use Disclaimer in each description. KZbin has been very generous to us and does not give us copyright strikes when we do these important steps she mentions in this video. Awesome content as always, Sean.

Quick CORRECTION... General Liability insurance is close to worthless for most creators. MEDIA LIABILITY & CYBER LIABILITY insurance is ESSENTIAL for all creators. That is the correct answer which she explained in the conversation but I'm not sure how clear it was for people not used to these different insurance forms. Additionaly (Insurance Broker & KZbinr Speaking) the insurance is dirt cheap!

@@pastorrandy If you've got something in the area of 10,000 followers its probably $2500 or so for both media and cyber coverage. A little plus or minus depending on your content. As they said in the discussion $2000 a month is typically the threshold where your business is growing and calls for legal entities, separate banking accounts, separate accountant, insurance etc. If you're not there yet keep working on the craft and your content. You'll get there, it's totally doable!

I don't know much about the people they are talking about in the discussion but if there is one thing that inspired me most from what the lawyer said in this podcast is when she expressed her heart for small creators, saying that she doesn't like to work exclusively only for the big creators (i.e., starts at timer 1:04:00) but wanted to reach out to small content creators too. I have copyright claims on my own music on my own channel. I distribute my music through Tunecore and for some reason it’s really strange how I can’t somehow approve my own copyright claim on the other end of this. We are in the Gray area and since I’m in the music industry, I can confidently say, there are a lot of errors and there are a lot of things that still need to be worked out. iTunes has the same type of rules. I had released music under a fake name. It was a stage name. I no longer go by. I decided to pull that music down and re-release it under my real name, I own all of the rights to all of this music, iTunes banned me from being able to release that music after I spent thousands and thousands of dollars recording it in Los Angeles. They said I could only release it if I released it under the original name that I released it as, unless I significantly changed the recording itself. This has motivated me to try to just make everything of mine available on my own website. The problem with this is music is so controlled that once you start playing by your own rules, it can get pretty difficult. I appreciate them being in top of things but lots of kinks to work out… That being said, this is the difficulty I have as a musician wanting to be a content creator on KZbin.!

I'm currently researching this in the Canadian side. Over here must be similar but different. I have a lot of friends that release things on itunes and yet I wonder about the ownership copyright things it seems that people get a very tiny shrivel or cut of what they're putting out. I've just been doing DIY live all over the place for years. And it feels more real and satisfying to me and the word of mouth and selling of archaic CD's (lol people complained they don't have a CD player) but still I've also had a lot of friends that got screwed either on the music industry contract level and it's interesting how this is on many different countries. And if you complain it kind of makes you look like your' not just happy for the opportunity to be big. But then again is it worth it if your work isn't being put forward where the creator should get a certain amount for what they put out. But I agree there's a lot of grey areas or a lot where people avoid looking at things because the excitement gets the best of you. I think probably is better to avoid fair use all together.

My band has several releases in Canada and the US. It's all copyrighted. We appear in magazines, make royalties, have materials, and live recordings from festivals, blah blah blah. All of it. Everything necessary. I, alone, appear under a stage name. This has, for some stupid reason, has caused problems that I don't really understand - I just play the drums. Everything had to be removed from KZbin and Spotify. The manager hasn't explained it in a way that I understand, but having it online causes some issues. Some part of it has to do with me not using my real name without legal identification. Never is a problem when I've filled in for someone on your dates. Didn't stop it in physical format. This comment about using a stage name caught my eye, and I was hoping I could get an idea of what the hell is going on.

And is also you as a business because of taxes etc. Yet it's a good rule of thumb to use a stage name where as I understand it in America if you get involved in a law suit then it's only your assets under the legal company name that can be affected and not your personal estates holdings etc? So it may be a form of protection. Then it gets complicated further so on youtube or public video services. Yet the challenge here is well America is it's set of rules. Canada is. And then world distribution is another. All have all it's differents laws nooks and crannies. Which is why I guess we had managers record companies so that we didn't have to have such a learning curve albeit still very well worth knowing about

@vibrationoftheone it just feels like another way to control the artist. It's already our music. We have no trouble in the physical realm, but it's as if when it hits online, it's an entirely new set of rules. We didn't need permission from the label to post it, and we have all the legal stuff. It feels like if the top isn't cashing in on it, we can't do it. They don't get to control how it's used, which is my understanding. I see big name artists posting on KZbin, so there must be some way they're allowed to do it. I do know that a huge number of bands pulled their stuff from Spotify, and I thought that had to do with fair use and being paid. My conclusion is that it's stupid, unclear, and poorly explained and vague, levelled against the artist, anyone can film a show and post it but we can't post the originals.

This was all kinds of dope. Listened to it in its entirety. Very insightful. I'm a small channel and I've had people steal my content. I'm talking about comment on my entire video and show my entire video. Not just clips but clips of the entire video. I wrote them and told them that I was going to let this one slide but that the next one if I find out about it I'm going to report them to KZbin. I would not have cared if it was just a clip here and a clip there. Go ahead and do your thing. I wouldn't have even known about it unless somebody hadn't come to my channel and told me. But my entire video? I don't like lazy content creators who I don't really call content creators. They're just thieves. I definitely would like to see another video with Tyler. This was fantastic. 👍🏿🙂

One thing you have to remember, honest negative product reviews where you show or explain the reason for the bad review is protected under the 1st Amendment as well as the CRFA (Consumer Review Fairness Act). So they would not have no legal grounds to sue you on a bad review.

The beauty and nightmare of living in the US is you can sue and be sued for almost anything. It can be a Brit lawsuit. Are you still have to hire an attorney and defend yourself and try to get yourself released from that lawsuit and I have had clients spend six figures to try to get themselves out of a lawsuit that they really should not have been a part of. Always be careful when you’re talking about other people or products that could potentially have a monetary effect on their business. If you base it in truth, that is a defense, but it’s like copyright strikes on KZbin. You can get a strike from an IP holder even if you try to argue fair use but fair use is a defense used in court during litigation.

If you're old enough to remember it, Oprah got sued by the whole Texas cattle industry because her show aired a discussion on food safety, and talked about mad cow disease. They said it lead to a drop in cattle prices. Fortunately she won but she was in court for 6 weeks and she never even said beef was bad!

When lawyers and laws interfere with creative processes, you get this. These types of people are seeing that KZbin is actually profitable and want to make it complicated and discourage a lot of people from even pursuing it. Human nature is such a changeable variable, you can't account for everything. You will get betrayed, whatever you do, or at least you would feel that you were betrayed. Whenever money is involved, there are "leaches" trying to squeeze every drop out of everything that use to be simple and make it complicated, so they can squeeze more and more, while doing nothing. It's the classic "create a problem and then come up with a solution". I'm not trashing the information in the video, whoever needs it, should definitely use it. But if we continue on this path, KZbin will become like cable TV. You won't be able to say anything until it gets approved by a third party, gatekeepers basically. Like in every major industry. Thank you for the information.

What advice can be given that would be specific to us? Also I’ve seen a few comments here and there on KZbin saying that once someone posts their art online that person gives up their copyright rights to the piece. Great info! Tread lightly until you can afford insurance. I have had a video marketing / production company for 20 years. Have contracts in place with all subcontractors about rights to content, non-disclosure agreements, and mandatory arbitration. Add a watermark to your videos!

A new phenomenon related to the topic that I have noticed is that content creators get copyright strikes if their own faces have been shown in the video or if their own voice has been heard speaking in the video. For example, an actor who created content had noticed that the movie company had blurred his face from the videos he himself had posted on KZbin as a kind of diary/vlog. But unfortunately I haven't come across the channel again since then so I don't know how the saga continued and if this settled with the film company, but I still hope that the person will be able to show his own face publicly in the future without infringing on anyone's copyright. But then there are those Copyright strikes from people's own voices that have been more of a problem for singers who create content in social media which raises the question of who owns the singer's voice but it probably depends a lot on what kind of contracts they have with record companies - or that's how it can be suspected. But it's also sad that if you can't use your own voice on social media if its copyright belongs to someone else due to a bad contract.

Great video. I think a question that still needs answered is how to handle situations where a creator strikes a channel and then the striked channel disputes it. KZbin then basically washes their hands and forces the striking creator to take legal action. Most creators stealing content know that won't happen and most are also outside the United States legal system. It often isn't worth chasing.

Fantastic video, great information. A lot of people don't understand the repercussions if something goes wrong in business. One thing also that isn't mentioned , especially here in California. If you have people working under you , even if they are " independent contractors" you have to pay Workers comp. When on the clock driving or doing work if they get injured doing their job and you don't have Workers comp you can be in a world of S , even if you are LLC'D. It's called the coming and going law.

You have added to my watch lists as you start to monetise your You tube channel, just be aware that you are liable to be taxed by the inland revenue apart from the legal issues that we have to face (copyright acts, sedition acts, defamation suits, etc) in creating contents out there. Media insurances or any kind of liabilities to cover your you tube channel is something new to me.

Great video! Thanks, Think Media! I also really liked the lawyer. Even though many people think of lawyers as cold and unemotional, she seemed very down-to-earth and relatable. I’ve already subscribed to her channel, even though I'm not sure how the legal stuff applies to me since I'm not in the USA. Still, I focus on my own content and try not to worry too much about fair use.

I ran into a similar content issue as the folks who she mentioned uploaded their content to one provider, had a delay and then uploaded it to another and in between someone stole their stuff, except in my case, both people were me. I wrote a novel, did all things I was supposed to do with ISBN's, copyright and all, but when I published it, I published to an aggregate publisher that publishes wide to other publishers like KDP, Google and lots of others. The hitch was the Google play was not in 100% sync with that aggregator, so when they got my book pushed to them, they got back to me to tell me that my Google play account had been closed for pushing someone else's content because they could see my book published basically everywhere around the world. I then had to supply them individually with all the proofs that I was in fact me and that I was the creator of this original content. It took about a week or so, but they eventually opened my account again. The point is that you can cause this to yourself very easily because they are checking for IP, but there is no central database of who owns what unless you have a copyright or in my case, copyright and isbn.

I am starting a new YT channel and I want to start a Manwha recap. I also am going to write, my own story. The question and worry I have is this : 1. I clip comics from many webcomics sites, some free. Am I breaking copyrights law and they do a copyright claim? Aside from clipping them, I also do my own scripts and describe the situation and correct the many various mistakes in language and lore. 2. Is what I am doing in writing my own scripts and explaining the situation and correcting mistakes / lore sufficient enough transformative defense against copyright claims/strikes?

I remember a few months ago , I seen some weird thing where the New Zealand family that I follow , they use other content creators reaction vids to make their own reaction vid of that reactor vid , but then this other family that i follow also , they did the same but created a reaction vid of the New Zealand family reacting vids , the second fam that I follow from what i know of gotten a strike cause the New Zealand family filed complaint on them , it confused me cause how can they file a complaint when they themselves are doing the same thing using other reaction vids and reacting to it

Bottom line, even if you have insurance, assume if you get sued, you are on your own and will have to cover the legal costs. And as Tyler says, you'll easily hit 6 figures to defend yourself. Truth is fine, but people with deep pockets will try and bury the truth, simply knowing you don't have enough money to defend yourself against them. If you get insurance, have a lawyer read the fine print... insurance companies WILL try to get out of covering you if there is any loophole at all.

Am I the only one interested in a video series focused on KZbin related Taxes, LLC , Trademark, Insurance, etc. How to do each? Like a KZbin Toolbox type thing for people everywhere, not just the US (I say this because, for example, I read that an LLC is something that is is always somewhat linked with the US, no matter where in the world you live)

Interesting. I've had a strike against one channel for using music owned by the person presenting. No recourse. Eventually it lifted but he and I were mystified on who claimed the music he was playing on the video was theirs and not his.

Great interview and an eye opener. My takeaway that being on KZbin, you should have integrity and respect as a content creator. Also stealing from others, is like sin, one day it would be revealed and the consequences would be very costly. Most importantly my big take away was at the end, to look at this as an investment that is futuristicly would have greater value than Real Estate. To equate content creating on KZbin with owning Real Estate and more is great vision for me as a new KZbinr. Thanks to you both.🎉❤
