I bought this house in Cleveland from a turn-key company and it has not been very turn-key since then! Cleveland has some pretty crazy laws in regards to rentals and has made me never want to invest there again.

I have a solution to these complicated eviction laws, use them to your favor instead. Give some friends the key and have them stake out the house. Once the tenant leaves, your guys throw all of their stuff out on the curb, change the locks, and move in squatter style. When the tenant comes back and inevitably calls the cops, your "squatter" shows the cops a "lease" at which point the cops won't do anything, it has to go to court. Now your problem tenant is in the same boat that you were in. Since you can't "legally" get the "squatter" out in a reasonable amount of time, the problem tenant will move on and find other housing. Once that happens, the "squatter" moves out and you take possession of the property. Now you can rent it out or sell it.

My mother rented out her house to the same tenant for 25 years, she kept it clean, any repairs needed, she had them done and took it off the rent. I bet no one could get that lucky today.

When I was a renter I always left them looking better than when I moved in. ( one landlord gave me 3 months free for making it "sell ready" and always making sure it was clean, viewable and smelling fresh when he DID put it on market) Also carried renters insurance. Many landlords in this area REQUIRE it to sign a lease on a SFH.

I was a landlord for 16 years. Out of all the tenants I ran into, the best were some Mexican citizens working for a local roofing company. I wasn't sure of their immigration status, but they all had "T.I.N." cards I used for background checks. Those guys paid on time, all the time, every time. I rarely heard from them. The only time was when the furnace stopped on a bitterly cold day which was resolved within half a day. They kept the property clean, and when they didn't, they responded to my requests to clean things up, like the outside or the carpet. The only "problem" I had was when one of them decided to date and carried on with a woman that lived on that block. She found out later he had a wife in Mexico and became livid, calling me to "do something" about the situation LOL. I told her that it was well beyond my purview! I was unfortunate to see them leave when they decided to go back to Mexico. They were the best tenants I ever had.

The house I rent is a very similar situation. Landlord had me move in so I could basically renovate it for her. I’ve redone the entire kitchen, bathroom, interior paint and most of the electrical work and going to start on the exterior replacing soffits and such this spring. I tell her what materials I need, she pays for them and has them delivered to the house. In exchange for my labor we get a pretty substantial break on the rent. Very “win-win” situation.

Yes I rented a townhouse for years and kept it immaculate and even did some gardening and hanging baskets. Guess what, anything i needed help with, he was there that day!!!! Even gave me a discount....said it was the best one in the complex!!!!!

Here in NY a tenant did not pay rent for 3 months at the start of the pandemic. The owner of the one family house had the front yard dug up by a plumber and the water main disconnected, cry baby tenants called the police and other authorities they said it was a civil matter, take it up in court. The landlord had a permit for the plumbing work so no fines were issued, the cry baby tenant moved out of the house rather than go to court knowing that it could take months and they will go with no water.

In the state of Washington, in foreclosure, they have a 12 month moratorium after the foreclosure, if it’s their primary residence. So lenders get no money through the foreclosure and 12 months afterwards. I actually had the mortgagor who we foreclosed upon, who was nearing the end of his moratorium period call me up and ask if we would be interested in renting the property to him. Yea-No! “You’ve lived in the house two years, only paying for your utilities and now you think I would believe you’d be a good renter? No sir! We are preparing the eviction papers as we speak! I suggest you take this time to find somewhere else to live and have your stuff all moved out before we show up at the front door with the sheriffs!”

When we moved to Colorado Sprgs in 2020 from Buffalo, I really wanted to rent our house instead of selling it. After seeing what my neighbor had to go through with his rental units across the street, there was no way I was willing to take that chance. I know not every tenant is a nightmare tenant, but it only takes one (or 2 in my neighbor's case). I ended up selling it to my neighbor, who wanted to be close to his rental units.

That's what's so damn maddening about all of this. I get that people need a place to live, and I believe in social services to a degree, but why does that burden have to be put on Mark Ferguson? Mark, the guy who provided the tenant a place to live--something the judge never did. Let the judge put his money where his mouth is.

to avoid the late fee issue you can just list it for more at the beginning, incorporating the extra fees and then give them a bonus discount when they pay early

When you rent to anyone get proof of social security number. If they don't pay be sure and let them know that you will be filling a 1099 C for the debt for all rent, fees and damages. They will owe the IRS income tax on the amount. Doesn't get your money collected but sometimes makes them get out quicker.

Yes you really have to you really if you have a property management company with your apartments you need to really really look into that because they are some shady ass people here where I live I've been living here since 2010 in Anaheim these apartments have had three or four managers and it's a trip because each one has left in the middle of the night not even telling us that we're going to get a new manager and the next day a new manager will show up like hey I'm the new manager and we're supposed to know who they are and give them our check well in 2017 this new manager arrived and she's been a living hell ever since the first day she got here I don't even think it was her something's really s***** going on they're supposed to be tenant resident managers but the first thing she told me when our conversation was like I'm not going to be here all the time I live here cuz I but I have another property management I have to be there most of the time so please she does not live here she shows up only for some month when she's showing or when there's a picture to do and always on her time so we want to do redo's on weekends and Sundays she has like two or three people and I'm catching on to her so that's why I think she wants to evict me because I'm not stupid there's three of them her mom her and her sister they all look exactly like ones a little bit taller and bushier and the other ones a little bit you can tell hip the middle one the main one has some stupid ass glasses that she acts like she's so smart and she doesn't speak she has no communication whatsoever which is very important to have interactive communication with your managers I'm going to prove in the court that ever since she got here she's made our life and coming up quite enjoyment of living hell so make sure that you have good property managers check up on them they're really shady this one has kicked out there's 22 and empty Apartments now I don't know for what the hell cuz nobody's going to come live in this f****** hell hole for $2,900 because it's a dump and I'm going to make sure everybody knows it because it's just she was renting to people with 789 people because you have to make 6,000 7,000 to get a two bedroom apartment not a lot of people make that kind of money I made that money by myself and when this girl keeps you try to check my credit again and ask me for an ID I believe it's a 2010 lady and you don't need to check my credit again for what just because I retire ever since then that they found that I don't work she's been making my life living hell she doesn't need to know where my money comes from I'm retired lady I get some money and I qualified way qualified by myself when I moved here in 2010 is it legal for these managers just to flip in the middle of the night and not let anybody know I mean you don't want to be giving your checklist of whatever weirdo they don't look like property managers this is her first job she had a job at Farmer Boy and a check cashing place and over here she's saying under perjury that she has 30 years experience she's not even that old I don't think she's licensed it's totally lying about everything so I had to let it go and I'm going to look for a good lawyer let's see what happens I'm not going to let this one go I think people are evil she doesn't own the property management company which works for an owner which is anonymous she gets a lawyer to back her up because I don't think she can pull it out for self she's so lame that I have so much evidence and she's totally saying that she I am lying when I have time I keep everything I keep everything and I'm going to prove that this is ridiculous and sue her back personally the property management company that lawyer if I can or unlawful infliction of stress and for the $8,900 they think they're going to get for their lawyer fees for a $571 payment is ridiculous they're going to have to pay me that on top of my top-of-the-line attorney that's going to help me with this civil rights harassment and retaliation not to mention maintenance issues and lying in the perjury she doesn't know what she got coming for her and that's just going to know who I am and I'm sorry I'd hate to do this cuz I've been there all these years and I put up with a lot of stuff but this right here is BS cuz I'm being discriminated especially with my poor pet he's beautiful there's like a pit bull that's downstairs from my house he's so loud and they sneak him in every night but I'm not a snitch because that's not my problem I don't know what their situation is but if they're going to have a dog and they're going to have a dog and they're going to have a dog and I should be able to have my dog because he is an emotional support animal I have verification and then she didn't follow the guidelines I've already completed to anybody at the city and see what happens well that's plain discrimination against the Americans disability act I'm not lying I know there's a lot of people that lie but not everybody's a liar especially me I have a very ethical person and I hate Injustice and even the judge was not even looking like she was going to side with me because she was like ugh and then try to go to court and I don't want to be going back and forth back and forth back and forth so I said f*** it I'm going to get a lawyer I didn't want to waste her time we're going to vacate it and get a new trial and then we'll see what happens I don't know what's wrong

In NJ you cannot evict a non-rent paying tenant if they have children. They will cry to the judge and the judge will give them another 6 months to move. They will continue to get extensions on eviction.

I vote for you to sell it asap! .... How come I don't have the luck to live somewhere free for a year??? I am 72. On limited social security. My adult son had to cosign for my apartment in Greeley because the apartment is $1,000 monthly, my income $1,900. But i always pay on time. Never cause trouble. Keep it neat & clean. Will leave it neat & clean when I move or die. Never been evicted. How do these riff raff people figure how cheat the landlord. Especially one that is nice like Mark. ??? MERRY CHRISTMAS 🎅 🎄 MARK

Worth mentioning that 2 "businesses" registered to this address received PPP loans, totaling $40k. The loans have been "forgiven." Yes, someone knows how to work the system. Absolutely despicable.

I used to own a 12 unit building, a beautiful, sweet young black woman approached me about renting an appreciation using her section 8, I was hesitant at 1st, but I really liked her so I decided to give her a chance. ONE OF MY VERY BEST DECISIONS I EVER MADE. She was a GREAT tenant and like clockwork my rent was in my mail on the 1st of every month. She was responsible for only $17, and she also paid that every month on time. She also painted the apartment and put in new flooring at her expense. So I gave another couple the same chance (not that it matters but it was a middle aged white couple), the state again paid regularly, but that tenant was responsible for $40 a month, which they never paid. Then section 8 came out to do their inspection (at that time it was once a year), this couple begged me to lie and say they were paying their part of the rent. I told them I would ONLY if they got caught up and never stopped paying it again. Which they did. My point being section 8 can really be great for a landlord ESPECIALLY if you're doing a lower priced rental. I would do it again for sure. AND because it is so hard to find landlords who will take a section 8, most tenants will not want to move, so they will do whatever is necessary to keep their apartments.

I had to deal with this during the pandemic in Co where my tenant stopped paying because we couldn’t evict during the CDC eviction freeze. It was stressful.

Always pay your rent or morgage first every month. Shelter, Always comes first. I'm retired in Danbury, CT. I rent a studio condo. We had a couple here who didn't pay rent for 3 yrs. It started with the Pandemic. The wife is a crack head. The husband is a drunk. She lost her section 8 voucher, for non payment of rent. The little piddly amount she was supposed to pay went to buying crack. They finally got evicted. . Disgusting!

Due cause. not paying rent for over a year. I say, Give some one can trust a Rental Lease for the place. say they are Renting a Bedroom and kitchen usage. Get them a key and have them just move in. Since they have a Valid lease for one bedroom and Kitchen usage it would be Legal for them to Live there with that Renter. If the Renter Complains, well tell them you gave them a Valid Lease. and You are more then Welcome to Move out. Or Do Not Renew Their Lease once it expires. Then go thur the Eviction process for Squatting.

in the UK you can get a possession order once rent arrears are persistently 2 months plus in arrears. A year ?!

With the law of unintended consequences, this is why there is a housing shortage. Investors have moved to other investments and pulled the rentals off the market, either to be sold or remodeled, which means removing the tenant. I could rent my home and downsize, but I can not risk paying a 2nd mortgage for me to live and have a non-paying tenant. As a result, I am living in my home and investing in other investments for growth and income. Examples are WES stock bought at $5.42 per share and up about 5X in 2.5 years. Bought XOM stock at 39.11 and it is now around $108 per share. Now the market has crashed again, and as I watch the stock prices fall, I'm deciding which ones with a low Price for the Earnings, I want for dividends and growth. Buy low, Sell high. Collect dividends and reinvest for compound growth. Much easier today than dealing with non paying tenants.

Vermont was hell to evict. She moved her father in so she got evicted but left him behind. Adult protective service was a joke. It was left flea and bed bug infested. $40k worth of damage.

So someone buys a house, you live there but then don't make mortgage payment, you get kicked out by the bank for not paying, but if you buy a house and then rent it out to someone who doesn't pay you, that's okay because you are still making payments. Don't seem right! Sell the house to one of the judges. My handicapped brother who works and 61 years old lives in slum lords apartment, he should quit paying rent.

Here in Germany, it's insanely hard for a landlord to evict tenants but if they don't pay, that's a valid reason to evict.

@@investfourmore You bet, Mark. Completely different. Here the landlord has very few rights and the tenant has a lot of rights. It has to be said though, that ~half of households in Germany are tenants. So it is pretty important to have strict regulations.

I've been hearing things in the local news, in Cleveland, about something of what you're talking about. The city HAS been making it tougher and tougher on landlords. I don't remember it always being like that. From my memory, this was more of a recent thing, that they've been getting tougher on landlords. Many of the suburbs of Cleveland are better for both sides (the tenant and the landlord) than Cleveland is. As the one subscriber of yours who is probably the only one from Cleveland, I would have offered to be your property manager for this location. I just don't know how good I'd be in that particular position. And also, this location of Cleveland IS lower priced, and it's also one of the more bad locations. EDIT: Well, I scrolled down in the comments. Turns out I'm not the only one in the Cleveland area watching your videos.

I was going to suggest moving in yourself- give the tenant 60 days notice to leave because you want to move in. I don't think they can throw you out of your own house in favor of a hostile tenant. It's worth the time and money to get a credit report on prospective tenants and only take one who has good credit and no evictions on their background check.

@Mark Ferguson . Have you hired a private investigator to verify that the house currently has tenants? That would be one of my next steps after creating an LLC. However, I do believe the LLC application papers must be filed in person.

One more reason to be very careful in buying real property in your IRA. Another issue is that you when the property is sold [and under current law, it will have to be sold, either by you when have to take RMDs, or within 10 years after the death of both you and your spouse (assuming your spouse is your primary beneficiary)] is that you will likely trigger a UBTI tax filing by your IRA because the depreciation (that you don't get any benefit for because your IRA is already tax-sheltered) is recaptured anyway, and recaptured depreciation is Unrelated Business Taxable Income (UBTI). That means that your IRA trustte will have to file tax return for your, and your IRA will owe taxes on that UBTI at the higher trust rate. This happens for both Roth and Traditional IRAs. (Note - UBTIs also occur when an IRA owns MLPs, which is another reason that people often set up self-directed IRAs). I looked into Self-directed IRAs several years ago and decided that the tax complications made it a non-starter, even before having to pay the extra fees to the trustee. When you decide to sell the house, be sure you understand the fees the trustee will charge you to file the tax return for the IRA for the UBTI generated by the depreciation recapture, and be sure that your IRA has enough cash on hand to pay that tax bill when it comes due.

My brother started out buying va repo houses and he still have a few houses left but at one time he owned well over 30 homes. He is now buys commercial properties and he is a hell of a landlord. You don’t pay that next month you will receive a letter to quit and usually in court by 30-45 days! He’s not a horrible person he’s a business man.. he has helped some tenants such as when a woman’s husband died and she had 3 small kids. He helped her to get social security and get on section 8 and find her a nice house to move too. He hated going to court so much so now he buys commercial and have a lot less headaches

Someone below suggested beginning work on major repairs and take a really long time on the repairs to make living in the home super uncomfortable. It was the post about NY landlord who started plumbing work and consequently turned off the water. Might be worth investigating.

Crazy. I feel landlords should be able to charge a tenant with theft or fraud for not paying rent, after 3 months. The laws need to be revised & judges held accountable. My landlord has an LLC. I am lucky that I have a wonderful landlord & my rent is always paid early. Great video.

I have properties near Cleveland area, but not in Cleveland. It is all about location. Investing in good neighborhoods is the priority. Overall Ohio is landlord friendly, I have done three evictions so far. 21 days to hearing depends on the city. First time hearing that you need a local company to do evictions. I know there are many CA investors who are under Trust and hire local management companies to do evictions. Hope your issues can be solved soon.

Interesting. In the UK tenants now get 6 months ntq before they are liable to leave after which the landlord may have to apply for a possession order, which can be enforced within a couple of months. At present no reason has to be given for the notice to quit. The county then has a duty to provide housing to the tenant though that might be quite basic. The landlord has no further liability. Where there are rent controls they only apply to the tenancy not the property.

If you cannot evict them, then they will never be homeless. If they are never homeless then you don't have to worry about tent cities and other city responsibilities towards homeless. So what they are doing is keeping people off the streets at landlord's cost. I think best alternative is just to sell the property or deem it uninhabitable then they'll have to move.

If you price properly, I bet you could find a buyer for the house, and make a slight profit, even. It's not the best area but there are home assistance programs that target single moms who qualify to buy a home. Your house is perfect for a family like that. Cleveland has a serious affordable, safe housing crisis. There are a lot of slum landlords in Cleveland.

I ended up in a situation selling my old house where a guy living in a camper in the neighbor's back yard was demanding I rent to him instead of selling. I knew it would turn into a squatter situation. I'm in NY so the minute I would have let him in, I would have been in a lot of trouble

I live in Indiana in small town right on the river across from Louisville Kentucky. The small town I live in has just started making owners of rental properties register their properties. I believe it's a 3 year check from the town board

So those laws since covid times are still there, I thought they reopened being able to evict. But there is the homeless crisis that people don't want worsened. Try to talk to the tenants and see their situation and show us the inside of the house. But then maybe depending on how many people are there, an apartment building for such people is needed.

I would never be a landlord and glad I don't rent, I was fortunate to get a renter out of my Aunts house when she got sick he cussed me and everything destroyed the house! Thankfully he left peacefully, then I tried renting to a young woman and when I told her I was selling the house she said she was going to sue me!! I did not have a lease with her. What! I thought I said go ahead but you have a month to move, so that cured me of renting!

Since the covid mandate in LA California has been lifted our house and courts are filled but 90% of the tenants that are being evicted or given a short amount of time to leave yeah we do have some strange laws though good luck with the house

Don't know the situation you're in in your state but the small company I work for we have switched over to month to month little bit easier to get rid of people that you don't want there is no eviction process whatsoever, and you " have to go in and change the air filter" which honestly wolves save you a lot of money as far as having to hire the HVAC cable will come in and gives you a chance to inspect the property.

There's a great office building in Bradenton, Florida, that our local child welfare agency would love to lease. It's for sale or lease. Purchase price is $6 million. We're solid tenants and looking to leave our current building because it is not being maintained and has mold in the walls. Looking for a Xmas miracle!

Have you tried offering the tenants the opportunity to buy the house they're living in? You could have a portion of the rent like $300 -$400/mo applied to a down payment. Of course that opens you to ask for $300-$400 more per month. Because the rent is going to cover your mortgage. But you could help your tenants buy the property by saving up for a downpayment to then refinance the outstanding loan still on the property. They will be very cooperative if it is appealing to them to become home owners. You could stipulate that this arrangement would require timely monthly payments. But if they get through with the payments, you should do what you can to help them buy the property from you. You could take a note on the outstanding balance of the downpayment so that they can get refinanced. Since the property was purchased in 2015, there is probably a substantial amount of equity left to get you out safely. In the meantime you can collect rent from willing tenants focused on buying your house.

Sounds like a nightmare. I live in Ohio. I've seen areas like that. They're not usually safe locations. The overgrowth, the graffiti, the bridge, the poor roads, the weeds, the thin sidewalk, the abundance of light poles, and siding with no stone/brick features - those are really bad signs. But I guess this is your wheelhouse if you buy problem properties. Just too much headache for me. That area isn't *the worst* I've seen, though, either. My first house was $89k. I made sure that it had clean side walks, and wasn't near any bridges, or tracks. Bridges, and rails, are hotbeds for illicit activity. Also, Cleaveland has been going downhill for many years. 2008 hit it SO hard, and it never really recovered. I think the reason for the super strict rent control is because people just couldn't live there without it. There needs to be a better way to make sure rent gets paid, but people aren't homeless.

California has a 30 day eviction process. It does not have sympathy reasons. Some local jurisdictions have weird rules.

Sorry you have to go through this. Some people are just scum. Should be able to add these types of people to a database of deadbeats that's available to all rental property owners so that no one will rent to them. Eventually people will realize that if they dont pay rent or trash a property they will eventually wind up homeless. And not that it solves your problem but may alleviate some potential problems down the road , don't own rental property in a city you don't reside in.

I'm sure glad I mostly got out of the rental business when I did. The ones I have left are all long term renters. People wonder why rent is so high these days. Well, when you have to cover the cost of all this bullcrap you have to be paid for it. Pass a law that says the state doesn't get taxes on property that the rent isn't paid and see how fast you can evict then ! Not paying rent is stealing. When exactly did that become "legal" ?

Renters sign Waiver of Rights under Law for 30 day Eviction. Waive rights and protections under law and contract to be out in 15 or 30 days with no recourse upon service of notice.

When was that photo on Google maps taken? It looks like your tenant is taking very good care of the property with nice mowed grass and the house looking nice and clean outside, hopefully the same amount of care inside. It's a bummer she is not paying rent but hopefully in the end she will save you money on renovations and clean up when she finally leaves, unlike some of your properties in Colorado where the clean ups were very costly. It seems that America is becoming an investors nightmare.

You may want to talk to Jeremy Hales. He has a KZbin channel called What the Hale$! You can find his email address their. He may be able to help you as he has rental properties in Ohio. Homes he owns and rents out. Just a thought. This might help you with dealing with your issues or maybe have an idea how to deal with it.

Ohio laws favor the landlord. Like he said he can’t evict due to his IRA owning the party. A 1993 property going for $75-80k makes sense for that area and selling it for a discount would suck. My friend in Cleveland owns a handful and only added to his portfolio year after year. I’m a Ohio resident and own in Ohio under my LLC. Using IRA funds to buy is not a bad strategy but getting a LLC done in Ohio would help him out and sort the issue. Also I agree with the blue state reference. Let’s pray more common sense comes into play. I would urge people to find properties near universities and colleges. Students leave after 10 months of academic year. Student always leave.

And can you buy from them without their involvement in property management. Many want to include in the deal they manage the property. I don't trust that and would say no.
