Dex, I do hope you read this as I have been thru trademark issues MANY times and always won the fight. Fair use provides that a party may use a protected mark not as an actual trademark, but rather, for its descriptive meaning. The fact that you own a registered business, with a registered name gives you the RIGHT to use the name/word. You arent selling JEEP branded products, You arent using a JEEP icon, Logo, font type, using the Seven Slots(which is trademarked) If you were to trademark DexJeeps as all 1 word theres absolutely fucking nothing they could do about this at all. Even my name TPBMODS, I was hit with a C&D from The Trailer Park boys lawyers(TPB Productions Limited Canada) and TPB BEAST LLC (LIMITED LIABILITY COMPANY; DELAWARE, USA) who deals in E-cig related products. Now, I am canadian, and my NAME was used in the vaping and computer world so words like Mods come from both sides, but TPB means TeamPipeBomb which is an old running joke

I agree with Tpbmods! I have seen other channels on KZbin that have used Jeep in their name/logo (2 word together) and they also sell merch. They've been on KZbin awhile and no such mention of anything like this by them. The letter Is only to intimidate and manipulate you and want to hurt your business. I would keep selling the DexJeeps merch, but have the words together in one word on your logo, maybe add Parts to it... they can't touch that.

Very well explained Dex, it certainly sucks to see a multi billion dollar company take offence to normal people just having a go, especially when there promoting there older vehicles as being great old trucks that are worth fixing (compare that to a modern jeep and it’s a different story). We all cope enough flak for owning a jeep since people always compare our old rigs to the modern ones that are full of problems haha. But I can also understand a company trying to protect its assets, even if they went a little extreme with all those people and yourself. Either way mate, you are a fantastic KZbinr that provides really good content regarding these wicked old school Jeeps and can’t wait to see what you bring to the table next! Man I work at the wrangler plant. Now I'm just a part timer. FCA is they used to be. Now its stellantis. The way stellantis treats their employees let alone their loyal consumers is beyond me. Every company operates differently. If they had a problem with the name. They should have contacted you the moment they had suspensions or concerns. There is no "injury" towards the company. Ever since they swapped to stella its spiraled out of control.

Fiat Chrysler Corp has done “irreparable injury” to the Jeep brand. After years of being a shop owner I absolutely despise the automakers. They do everything in their power to make it difficult for small businesses to repair the garbage that they are selling and they generally have nothing but contempt for the customers who buy their products and have problems with them. Fiat Chrysler couldn’t build a lawnmower engine worth a shit much less build a competent vehicle. It’s no wonder that they have to have a small army of blood sucking lawyers to protect them.

First off, I'm glad you made this blessing in disguise happen, I would not have found the channel otherwise. Jeep also sells merch like shirts and hats... Jeep is just defending there own trademark and have 100 lawyers on payroll sitting around just looking for stuff like this. Also the governments is not gonna give you trade mark advice, although I think it would be a good idea... its up to the company applying for the trade mark to do the research. I don't think you would have any chance fighting it, coming from a law stand point. You also have to remember when the trademark laws were put into place there was no internet where you can apply for a trademark overnight and the offices would let you know if they thought there would be a conflict.

My buddy had a side hustle, making folding fire pits. He made all sorts of them but a lot of them were jeep related. Now, a lot of them may be a stretch he made maybe 20 or 30 a year. He was fine until he built a small website, and FCA found it. He got basically the same letter. The first one was polite, like the one to you. He basically said hell with it and carried on. A few months later, the second letter was not so nice. He finally just stopped the product altogether. Btw from what I understand, you can be called dex jeep parts but not dex jeeps. Copyright laws are weird.

Had a franchise company contact me 10 years ago bought me using there name since they were opening in this area. They were already running adds on local radio. Had a lawyer inform them that my business was 10 years older than there franchise. I had changed my legal name to include the business name so it is exempt from infringement. They decided to not move into the area and pay me royalties. Free advertising was nice.

A good attorney may say its just a scare but you are not in their lane and they have no grounds to stand on......worth the investigation. One more piece of my .02 If the attorney you talk to doesnt give you the warm and fuzzies from square one find another. Many have asked about using the same name and were given an answer to NO you can't use period. Unless you contact owner and have written permission. Not even on a card or tee. Do a search asking you will see.. Someone must have made a complaint to tip them off. But be safe on trademark words.
