The International Criminal Court (ICC) has come in for strong criticism - most recently from the United States, but also from many African nations.
Tasked with bringing to justice perpetrators of genocide, war crimes and crimes against humanity, it has been accused of political and regional bias, and of failing to achieve convictions in some of its most high profile cases.

...the national sovereignty of The United States is the source of your sustained freedom as with the rest of the world. If every country in the world signs on in support of ICC it becomes a de facto world government....so tell me...where is the constitution in all this...where are individual liberties...this is nothing but a star chamber at this point...The United States didn't sign on because The Constitution and the Bill of Rights would be null and void under the ICC. The Constitution is the supreme law of the land in the U.S.....the people are in control. The ICC needs to be reformed to include a Constitution and a Bill of rights and not some non-codified (needs a formal written document) lib-speak as with the EU....with out these it will become a totalitarian ruling body and is at risk of a repeat of Hitler and Stalin

Are US citizens not also citizens of the world? It's not a foreign court. That's like saying California shouldn't subject it's citizens to US federal court. If the world agrees that something is a objectively a crime against society, why does the US get to walk away? Regardless, it's not citizens the ICC looks that (usually), but governmental actions, and the government officials responsible for them. So it's really a check the the governments of the world have put on themselves. The founding fathers system of checks and balances was never designed for such an interconnected, global society. The ICC is just an extension of their idea of Checks and Balances on the government.

Any nation that decides not to agree that the ICC can investigate crimes committed by one country in another country should not be allowed to operate overseas. It's one thing for a country to decide not to allow the ICC to investigate crimes that took place only in their own country but it's quite another when a country's military takes action out side of it's own borders and refused to prosecute war crimes themselves.

The ICC would receive a lot more credence, if they prosecuted returning ISIS-members (those who originally came from European countries) in the Hague. For one thing, it would alleviate the burden on an already wrecked Iraq and Syria of having to prosecute and potentially detain for years hundreds of criminals (sure, in these parts they would execute some, but you're still left with minor collaborators, e.g. some women that emigrated to fight but were married off and turned into baby machines). For another, European national jurisdictions wouldn't have to deal with semi-stateless individuals, who have on the one hand relinquished their citizenship (making them someone else's problem), but due to the commitment to denying statehood to terrorists cannot be regarded as foreigners (international conventions rule out statelessness as an option). As I see it, the aftermath of ISIS is an international issue that's practically tailored to the cmptenecies of the ICC, if only because prosecuting an international gang of separatists is such a thankless job for any one nation to take on.

As a Chinese, it must be strongly pointed out that the trial of the United States is the United Nations International Criminal Court. The last ad hoc arbitral tribunal on the review of China’s South China Sea sovereignty was not the UN agency, and its competent authority, the Hague Arbitration Tribunal. It is a court of similar negotiation in civil commerce -- and it is funded and has no power to decide on disputes between other countries such as sovereignty. There is also the fact that the arbitration fees are supported by the Philippines. What is even more interesting is that the Philippines believes that the United States does not help pay and now refuses to pay. Your cognition comes from the paradox of American control, and there are too many fake news.

TV ICC-watch documentary *ICC issues political verdict: Yüksekdağ’s appeal rejected* The individual appeal submitted by former HDP Co-chair Figen Yüksekdağ to the Constitutional Court (CC) has been rejected. Red. 8.8.2018 Turkey’s AKP regime controlled judiciary has issued a verdict on former HDP Co-chair Figen Yüksekdağ’s individual appeal to the Constitutional Court. The appeal had been made on the following grounds: - The capture, detention and arrest warrants issued against Yüksekdağ after the date of arrest are not lawful. - Access to the investigation casefile has been restricted, as such the rights to freedom and safety have been restricted. The accusations leading to the arrest pertain to acts of exercising freedoms of expression and political activity. - The rights to free speech and political activity have been violated as Yüksekdağ was unable to fulfill her duties as a deputy on account of her arrest. The Constitutional Court ruled that the appeal is “inadmissible”, and claimed that Yüksekdağ’s politically charged arrest is “lawful”. The CC argued that “arrest on political grounds is not possible”, and that “the arrest is warranted”. The same verdict also claimed that Yüksekdağ is “at flight risk”, and as such, “there is factual basis for the arrest regarding flight risk”. The CC said, “It is clear that there is no violation regarding the applicant’s claims that the arrest was made unlawfully, and as such that part of the appeal is clearly without merit, and the application must be ruled inadmissible.” The only CC member to object to the verdict and pose an opposing viewpoint was Engin Yıldırım. anfenglishmobile.com/news/cc-issues-political-verdict-yueksekdag-s-appeal-rejected-28801 *+* *+* TV ICC-watch documentary **Erdogan's crimes have gone unpunished for too long. At some point the capacity of humans to effectively stand in judgment against one another does fall entirely apart. Who is the one guy who is really fit to have the final word about right and wrong over all of the rest of humanity? I see the need to try for justice, but I also see why it’s a lot of hubris to believe that’s really in the scope of human power.

Mark Anthony Demaguil It is not an interference of sovereignty when a state has consented to the courts jurisdiction, which many states have done so. In such case they are justified in being involved in local justice systems as the state has consented

@@seth3638 ICC can interfere if and only the local justice systems are not working.. And also in the case of the USA.. whom they are not a signatory of the Rome Statute but still insisting the USA to go to trail against the alleged atrocities they made in Afghanistan

Mark Anthony Demaguil Afghanistan is a party to the Rome Statute and thus the ICC. Since the US has committed human rights violations in their territory, the ICC has jurisdiction to investigate. USA is not a member of the ICC. Due to their sovereignty they are free to obstruct and resist the investigation against them. They are already doing this as seen by revoking the visa of the ICC investigator. Such conduct my the USA confirms the wider world’s suspicions that the USA have violated HR and are seeking to escape accountability

who funded them? the 100 plus idiotic members who pays membership per year. those gullible countries who wanna look good on international community. lol good thing we got out last year. what a waste of money. no one follow them anyway, every country only follows their own judicial system. why would you let someone outside you're country to decide who is guilty and not in you're country. why would you follow their ruling. that is not part of you're constitution. super lame! they can only arrest people from africa, because ever since europeans enter and do military intervention in africa at will. they always have a presence there, and africa is letting them. so they use ICC ruling to take out leader by force who don't follow their policy and propaganda. but they can't do it in countries who has full sovereign rights. states that don't allow any military, or diplomat to enter without their permission. so if they attempt to enter and investigate places like myanmar, laos, cambodia, etc. they're people would be arrested or deported immediately. totally useless. no police power. they only expect you to follow their ruling, and who would be dumb enough to follow that?

I am angry that my country, Australia accepts the jurisdiction of the ICC. If any Australian citizen commits war crimes, we prosecute and punish them. Therefore the ONLY reason the ICC would want to investigate Australia would be that they are playing political games against us. This is unacceptable. I am quite happy to assist the ICC in chasing down real war criminals, but never, never to accept jurisdiction over us. This, of course, is the same reason the US refuses to get involved. In fact, if I were the American President I would propose a law to prosecute any foreign court which attempted to arrest, request extradiction of, prosecute, or punish any US citizen for alleged actions taken on behalf of the American Government.

Maybe you should petition the ICC against your own government for the inhumane treatment of Australians in the midst of this covid19 crap like the UK did. I'm American. Unfortunately I'm unable too petition the ICC on behalf of America because America does not accept the ICC as an authority.

the united states has a law that has passed if im not wrong, that is allowing military action to be taken to free an american that will be prosecuted in the hague. if the united states actually does that, they will basically declare war on the netherlands, which means a NATO ally, which could spark a world war. so, i think the chances of a country attacking a NATO member is so extremely low, the ICC actually does have the *protection* to do their work, which makes them meaningful.

Why not? ICC is selective is chasing after the weakling country. Why would country be subjected to ICC when criminal Zionist UK monarchy are sitting finely in Buckingham? How could US, Nazi Ashkenazim Israel and Nazi Saudi who killed people with impunity and UN immunity? be not subject to court martial? The trial evils are real terrorists. So before ICC charge the small states, it must jail first the big time criminal and violators of human rights.

The same here in Indonesia, your neighbor. I've seen some Western media saying that our current policy of restricting anti-government hoax, crackdown on drugs, etc. are threatening democracy, but they don't realize how bad is things over here. For example, the opposition in current election kept spewing nonsense, dangerous lies that many believed and shared. Sure, alternative opinion is fine, but when they decide to resort to hoax and fake news, you know that there is a problem. We're talking about hate speech against non-Muslim individuals, fake news about the incumbent planning to make Indonesia secular or that he's not even a good Muslim (even though his VP is literally the president of one of the largest Muslim organization in Indonesia and a cleric himself), and even an artist who faked an police brutality. It's funny how the world was once against that whole blasphemy shenanigan in 2017 with the Christian governor, but then they believed that the word of the opposition (which includes some disheartening comments on making Islam the only faith in the land from their supporters) must be heard, even though considering those words would eventually break democracy itself.
