They are considered the same in most states. However in states where both are used DWI-Driving while intoxicated is a harsher crime than DUI- Driving under the influence.

There is no difference between DUI (Driving Under the Influence) and DWI (Driving While Intoxicated), it is a change in wording from State to State. I am a police officer and I specialize in these. Here in Ohio we call it OVI (Operating a Vehicle Under the Influence). The penalties can also be different from State to State. Remember, just because you might be under the per se limit of .08 g/dl of alcohol in your breath sample, does not mean that you still cannot be charged for DUI, DWI, or OVI. It's mostly based on your driving ability at the time. I have had those under the limit and they were driving on the sidewalk to the roadway and back onto the sidewalk. Also, the limits or numbers might be different in your blood and urine. But the set number is close to what the number would be if in your exhaled breath. For years, the term was DWI - Driving While Intoxicated, kinda meant it was from drinking alcohol. So they started to change things to include a more broad approach to impaired driving to include drugs (legal or illegal). You know, also to make things sound not so harsh anymore. Open container in a car is separate from the DWI, DUI, or OVI charge. If your a guy that got charged with an IUD, well, that's a whole other problem... :)

The terms ARE used interchangeably. DWI typically has a higher threshold for intoxication. Penalties vary and are based on state laws.

Depends on the state but if the state charges separately then DUI is used for suspension of alcohol and DWI is for the suspension of other drugs (recreational or prescription.)

DUI is an acronym for driving under the influence while DWI refers to driving while intoxicated. However, legally speaking New York does not use the term DUI.

DWI (Driving While Intoxicated) and DUI (Driving Under the Influence) are basically the same thing. Jurisdictions use one lexicon or the other. For instance, some police agencies use the term BOL (Be On the Look-out) while others use (All Points Bulletin) when extraordinarily seeking a person(s). In some cities, you may see a No Parking Anytime, whereas, in Detriot or Philadelphia, you may see a No Standing sign, which means you can't park or even stop whether you are in the vehicle or not. It has nothing to do with a human being standing.
