On the AIS topic: have made the same observations here in the Leeward Islands. And it applies only to a particular few very large yachts, i.e. that are fitted with several tenders which are stored mainly in garages in the hull (not on deck). The tender transmits a signal sometime with the same ID as the mothership. When the mothership picks up (swallows) the tender, the AIS remains for a while in the location of the last recorded position. Whilst in fact the yacht already had left the location sometimes more than 12 hours ago. 📍🔎

I don't understand why people think that having insurance on your Yacht is being not fair. What is not fair is the Yacht Owner thinking it's someone else's problem to clean up the mess and damage to the Ocean, Dock, or the State or Ocean we don't want all the things on the Yacht coming off and floating around in the Ocean or making Hawaii pay to clean it up or another Country it should be mandatory I'm sorry if you don't agree.

I agree with you, 100%. I don’t think much of insurance company and their (overall) motto Maximize income and minimize outflow - which means “sell as many policies as you can and do your best to avoid paying claims”. Mandatory gambling for the customer, in effect. Pay your insurance premiums and hope that they will cover any losses. In the US, the State Oversight Committees are manned by insurance agents. The fox guarding the henhouse, as it were. THAT needs to be corrected, but insurance is still a necessary evil. If you have a moving ‘vehicle’ of any kind that has the potential to harm people or property, it should be insured. Whether it is a dirt bike, an automobile, a speedboat, a yacht or a superyacht, it should be insured. I keep insurance on every vehicle and every building that I own. If you have the money to buy a yacht, a Superyacht or a speedboat and you can’t afford the insurance then you can’t really afford the ship, can you? It is as necessary as fuel. Period.

@@maobfh you are so right about everything you said in 1983 I was on the back of my Partner's Harley Davidson on our way home and a Simi ran the red light on Sepulveda & Victory Blvd he clipped the bike but cought my L-Knee I knew it hurt and I couldn't walk but I also couldn't get my Levi's off for 2 days I moved around on my but but finally went to the hospital and had to get my knee replaced and had to wear a cast and then a brace for 8 months at the time my daughter's were 3 & 5 he didn't stop because he was afraid my Partner was a Hells Angel all I know is the rest of the people who we were with went after him they found him but I don't know what happened they were pretty angry and at that intersection was a gas station and a restaurant on the Left side of the street and it was a police hangout not one of them came to check to make sure that everyone was okay. The only other accident I was in was in New Mexico we were stopped at a red light with a car in front we were in our truck and a lady who just bought a brand new truck that morning slammed into the back of us doing 85 in 40 speed zone we had my grandson in his car seat he was not even a month old I was thrown out the back window that broke on impact I had a broken back and my grandson had glass all over him it was in his mouth and all over his face and body my Partners head flew back and cracked his skull he also had a broken leg. In both cases they didn't have insurance but we did I was a Nurse and lost my job because I couldn't work he also lost his job with the Military and didn't get much money as a Vietnam Veteran. The lady said that she was looking for a CD to play and didn't notice that the traffic had not started going she was crazy while the Paramedic was working on us she offered to take my grandson to the hospital for us you can imagine how angry I was and in pain I told everyone to keep her away from my grandson. The only good thing that came out of that accident she went to prison for 15 years and her Driver's License was taken away for another 5 years. I'm just thankful that my grandson is still alive I have not been able to work since but I have my Family.

I was on a small private boat on Hawaii Island and we lost all engines. We drifted a while and contacted the Coast Guard. As they told us, basically we were on our own. There were no rescue craft within 200 miles. We were drifting very close to the rocks south of Kona. I even went into the water with a rope trying to swim out from the rocks. We did have a wonderful stroke of luck and another charter fishing boat caught our signal and towed us back to Honokahau harbor. If we had gone onto the rocks it would have cost serious money to recover. There are no coastal roads in that area. I'm glad that Hawaii has made these new regulations.

As you said this particular vessel has a history of turning off AIS. So, if it quacks like a duck it is a duck in my opinion. I belive it's a deliberate move. Great video and explanation of the incident. I'm a big of a nerd so I really like getting into the weeds like these videos do.

12:48 I'm pretty sure you can change the MMSI number in a lot of AIS transponders. There's software around that lets you interface with common AIS to send commands to clear the current settings and then let you enter a new one as if you were setting it up from scratch without sending it back.

If the boats are GRP or Carbon there's a very disturbing Science report out of one of the 🇬🇧South coast universities south Hampton, Portsmouth or Plymouth. Where they have done a deep survey into the local and area effects of GRP hulls breaking up and nano particles of Glass getting into the food chains. It's grim in that it's behaving just like Asbestos and skewering cells and organisms that ingest or otherwise envelope the particles. They are in particular getting concentrated in Mud flats. It was published online in one of the UK magazines.

I guess I have been watching you long enough, I figured that the tender was broadcasting the same signal as ‘Opera’! Whether accidental or deliberate, seems a knowledgeable mega yacht owner would catch this and have it corrected rather than play dumb and use it to your advantage! I agree with you on the insurance story, I would have thought this would already have been a requirement, people need to be responsible for their own damages and salvage! If you wreck your car, you can’t just leave it on the road!

I believe the tender is part of the large yacht and would not have a separate number. I think Marine Traffic get (pay) people with an office or house on the sea front to fit a box that they supply with an antenna. It connects to the Internet and sends AIS traffic information to Marine Traffic automatically. I have the basic Marine Traffic as the Satellite is expensive for me, and that only uses the land based information.

I get the Add’l Insured provision but that clause applies to general liability, not property (I.e. salvage costs). If someone sues the yacht owner and the BOPOR, that means that BOPOR is covered by the yacht owner’s insurance policy. They’d better have a waiver of the “Insured vs Insured” clause in the event DOBOR sues the Policyholder (yacht owner) for recovery of funds from the insurer for liability of an insurable event (re: general liability). I’m sure DOBOR has covered itself, but it appears the new requirement was written by an attorney or is boiler plate and doesn’t understand what an Additional Insured applies to. (J Kirtland, 35yr corp insurance risk mgr).

Attention. Your boat insurance does not cover recovery. You have to pay for it out of pocket and then submit for expenses. I believe that is why the owners are walking away from their boats it is not that they're not insured it's the insurance companies won't take care of what they say they will do.

With zero experience, my arm chair opinion is the AIS radio was removed from the mega-yacht and installed on the tender for the purpose of making the shuttle run to the airport, and turned off again on return, with the assumption that the radar signature and visibility, is good enough for mega-yacht safety. Meanwhile the the AIS service determines the class of the vessel by some characteristic of the vessel installed antenna, eg Class A = terrestrial and satellite, Class B = terrestrial only.

4:26 The reason boating is so much more popular in the States is because it's more affordable. This isn't like the UK. They aren't handcuffed by insurance and regulation such that it is impossible to engage in these leasure activities.

The 100k is just a starting point and the law would be badly made if it required small boat owners to "over-insure" and that's why the law says 100k minimum and full liability. If you own a 10-meter Riva boat that 100k insurance amount should be enough. If however you own a 30-meter former military vessel 100k will not be enough but since the law now also comes with personal liability you'll probably make sure to get a higher coverage amount.

I understand that Hawaii does make that law, but isn't that conflicting with international wreckage laws? *I know that those wreckage laws are old, and the current value of the ship does not cover the cost of cleaning anymore, but that is still the international agreed law. So.. now instead of state vs owner, when the state wants money to remove the wreck, even after the owner giving up ownership. it will be state vs insurance company, which will be a far far harder battle for the state. The insurance company will point to this international law, pay out the 100.000 and tell the state they can have the ship to cover any additional costs. edit: I typed that before you were finished. but do I understand it correctly that the state payed for removing the boats, WIHTOUT taking ownership of those boats?? why didn't they just seize them an d sold them to get the money or likely MORE money back?

Yes. How big a tender is it possible to carry on a 12,000 ton yacht? A 60 foot small motor yacht with a thousand mile range is not inconceivable to work as a decoy duck.

As a little sailing yacht owner (with AIS transponder class B) I am worried by the big yacht that has turn off their transponder. But perhaps they didn't do it you showed us by spire/shipview. You have to go there how it works out in practice. (sorry for my bad English, I am Dutch)

Every time I took a superyacht to the US I had to show a COFR (Certificate of Financial Responsibility) that proved there were funds and/or insurance available to cover the costs of marine pollution. (Leaving a vessel parked on the beach, leaking or not, could be considered marine pollution). Unsure as to why that would not apply to Hawaii and the vessels that ran aground.

I do not get the fuss.. Marine Traffic shows Opera at a dock made for tenders and the wrong class of transponder do not fit for the main yacht, so it sounds like a tender went to the dock.......Class B would be a tender/shuttle or smaller boat like that right??????

Are you incorrectly referring to the AIS transmitter as a transponder? My understanding is that a transponder is a transmitter that responds automatically to a received radio signal (like the transponder on an aircraft - squawk code ). What is the difference between Class A and Class B AIS ?

I agree with insurance, however who controls the insurance companies. Insurance is getting harder to get, take for instance a 40 y/o well found and well-kept vessel may be denied insurance at the first stage of seeking cover. "Oh, sorry we don't cover vessels over 40 y/o." Given that for the first time in history that vessels built from materials that last hundreds of years the vessel will be around for a long time. Problem is that the value of these vessels is pushed down by the fact insurance cover cannot be placed. The devalued vessels still looking great, are purchased cheap and then the new owner finds the cost of maintaining a vessel is beyond their expectations. It is a viscous circle. I don't blame the insurers for taking the easy path, but when a law is passed there must be away provided to comply with that law. Risk is that one day there will be no historic vessels left. The people who love and respect their boats "you know the loverly timber yachts you see at the marina with 55 coats of gleaming varnish." will no longer exist. Perhaps a government insurance program should be provided.

I personally do not understand the low Minimum coverage amounts. Hell I snow plow company and I take out an umbrella insurance policy of ten million dollars for damages that might occur while the lots are being plowed and another five million dollars policy in case I am sued by somebody who slipped and fell in a parking lot or private street that I have contracts with.

What prevents a geek from building his own AIS that can transmit whatever he wants and change MMMSI number at leasure? Are there keys involved that only legitimate and "locked" AIS receivers have and a geek can't built such a receiver without getting such keys? or is the data sent out in clear and not authenyticated and anyone could build their own AIS machine and broadcast whatever they want?

If it’s an accident it should be fixed soon now that it’s been pointed out. If it’s not fixed at all, then it’s deliberate. Given that it turns off it’s AIS and is owned by a UAE sheikh, I’d bet it’s deliberate.

So this Rule saying as it does that a boat owner is responsible for all costs means that should a storm destroy a harbor and destroy boats in slips the owners will be fully liable for all salvage costs regardless of fault. Same for boats safely at anchor in designated areas. The Rule has no exceptions.

Spoofing means in this case to broadcast to appear to be one vessel (Opera) when it is actually another vessel. Sending out a identity signal (AIS) when the vessel is actually not that vessel.

This really puts the last nail in. Government liability to you for anything ever, including offenses the government committs against you or your family both civily and criminaly = 0. Your liability for the slightest civil or criminal infraction = all of it there ever was or ever will be including benefits from the insurance you were forced to purchase under threat of death. It really is surprising they had not thought of this before.

I did not even finish the video and I know what they are doing....... It has a Tinder or support boat with an matching ####### and they turn off the big boat turn on the little boat and then leave port hidden from AIS...... They are rich they can leave a support boat docked anywhere and just do what they want and when they need to turn on the big boat they make a call to a crewmen or the dock and tell them to turn it off then turn on the big boat....... LOOK THIS IS EASY...... DON'T CARE WHO YOU ARE OR HOW RICH........ YOU MAKE IT SO THEY CANNOT AND I MEAN CANNOT TURN IT OFF........ ONLY TIME IT IS OFF IS IN DRYDOCK OR OUT OF THE WATER.......... THIS F**KING EASY TO FIX...... TAKES 1 LAW WITH HUGE FINES OR LOSS OF CERT'S
