No, parody is considered to be a form of expression. This means if you make a funny youtube video parody of your favorite characters that’s fine. But if you can’t actively seek to make money off of it. The real problem for Nintendo is what mike said, it’s gonna be really hard for them to actually make any money off of suing them and it’s financialy better for them to leave it alone.

Nintendo Laywers have already told people to stop emailing them about the game. They aren't sueing. And I think if the worlds most litigious lawyers can't find anything to sue. There's nothing to sue Since more people are commenting, yes they just found a reason to sue. However when this was originally typed they did not have a reason.

This video was just lazy. Japan has very complicated and strict copyright laws, and the fact that both of these companies are in Japan means palworld is violating none of those laws. Palworld never claimed to be Pokémon, and the two games are so different that they can never be thought of as competing for the same audience. That’s basically it, Japan allows parodies as long as the gameplay is different enough

Shit Palworld took more than just designs lol, they also took the inability to make a proper game that doesn't bug out in 3 years. Lookin like Scarlet and Violet with its bugs and glitches that put you through the map, considering you can sometimes spawn under the map. 3 years of development and we still have bugs and glitches that can prevent gameplay.

It was publicly posted at the start of development 3 years ago. If Nintendo had a cast to sue them and shut them down it would have been done already. In Japan there are no free use law, yet they still got copy right laws over there. In the end Nintendo saying they are looking into it is just them sayimg they know about the game and stop spaming them.

I remember reading somewhere recently (I don't remember where exactly) that said that, when it come to the Pokémon games, Nintendo's stance on infringement is 'whether or not a game's code is copied or taken from an official game'. (I believe the same goes for assets as well) Basically, I think Nintendo could only really do something to Palworld if they had either code or assets that were directly ripped from one of their games.

(Disclaimer I am not a lawyer and this is not legal advice) For anyone wondering how Nintendo is still suing Palworld anyway, here is the answer to every one of Mike's points. 1. Nintendo didn't care (also it may be seen as GOOD press culturally in Japan) 2. They didn't do it in the US 3. Patent infringement is for specific patented concepts taken, not the entire product itself. That would be more of for copyright. They sued over patent infringement 4. They didn't sue for IP infringement.

That wouldn’t be the reason if they got sued though, the reason would be the blatant copying of their designs and even other designs from many other games, I guess they don’t really have an imagination to create unique designs lol, and also they can easily sue palworld as they are both not based in the US, I think they just don’t care, there has been many shows and games like Pokemon and they didn’t care either, pokemon fans are just annoyed because they didn’t grow up with this game like the other pokemon like games, Palworld is still a great game to play despite the huge amount of game breaking bugs they actually make it even fun to laugh at the amount of random stuff that happens, especially with friends, though I do hope they will change their designs to be actually unique and not blatant copies and even some being basically reskins of other stuff

This argument doesn’t hold up. Half of the pals being mentioned don’t have animal inspirations that they have copied, they just straight up took proportions from Pokémon. Verdash has the exact same proportions as cinderace with a few deviations like the tail and head ornament. Anubis literally just took lucarios face same with dinossom and meganium. With the examples I just mentioned this argument just doesn’t hold up.

They would sue in Japan, but then the owners of Dragon Quest and Shin Megami Tensei would sue Nintendo for a lot more for ripping off all the same stuff from them. Nintendo is more likely to buy Palworld than sue anyone over it.

When I heard about the controversy, I was one of the people that hurried up and bought a copy. Nintendo is helping by keeping the story in the media. And I heard that both companies are from Japan and it took several years to make the game why did Nintendo not see it as a threat, and tell other people started saying it was like Pokemon with guns. Nintendo doesn't have a monopoly on cartoon figures in video games. Even if they tried, they won't win. The only thing they can do, is strike down modders who make mods that replace models of Pals into Pokémon.

@@cucuawe465 Most people take down their mods from the threat of legal action. Legally, Nintendo can't actually do anything, but most people cave under the threat of an actual legal battle. And who wants that sort of stress and potential financial strain caused by a mod that isn't even making money? They could potentially take legal action if someone was making mods for their games. But Palworld isn't their IP, so they can't take action on behalf of the Palworld devs. It would be up to devs to do so. The best they could do is send the mod maker a cease and desist that doesn't actually have any real legal backing. (Even if they did, the case could be thrown out since games like Garry's mod has those sorts of mods and Nintendo does nothing in spite of Garry's mod being absurdly popular.)

There's a lot your behind on Mike. Palworld's studio is down the block from Pokemon's HQ in Japan. Palworld was announced and publicly talked about 3 years before release so if Nintendo wanted to sue they would have already and they've sued for less.

@@riolu477 they didn't steal assets. Palworld has lawyers of their own watching their every move to make sure the devs don't add something that upsets Nintendo. Stealing assets would defeat the purpose of having said lawyers. They were INSPIRED by their assets. Inspired and stealing are two different things. The whole stealing assets post on twitter was faked because the person who posted the tweet purposely scaled the models to fit Nintendo's models. The same person has stated they did what they did because the game promotes "animal cruelty". Stop using twitter posts as evidence of anything.

No, Nintendo didn't say they will take em to court. They just received many complaints so it's their 'we know, stop messaging us' Remember, Nintendo took down a mod for palworld that changed pals into pokemon the same day it was released. This isn't a situation of it not being pr friendly, you cannot exactly copyright pocket monsters as other IP's also use similar concept.

Ever since Disney got involved in IP laws and paid Congress to make 100-year copyright laws, we have seen many nit-picky people controlling ideas: Disney's image of Steamboat Willie (Mickey Mouse) expired this year 2024, but not the song. Two of my favorite examples. (1) Sherlock Holmes, these stories are as old as time, and a judge ruled that the older stories are finally copyright expired: The owners of the copyright would sue anybody to keep control, even though the stories are old enough. (2) The title 'space marine'. The idea of soldiers in space is as old as Flash Gordon and Buck Rogers, but because nobody copyrighted it, thus the term 'space marine' is a problem for any writer and publisher. Lesson learned, you need enough money to keep it in court, if you have a case to publish your own works: Nintendo shouldn't own the market on monsters.
