Like I feel like if we had like two separate supreme courts we had more to separate congresses to help divvy up the workload because there's just too much to do but at the same token we need to be able to hold these people accountable and we are unable to do so

Never say never! Nothing lasts forever. Nothing stays the same forever. A greedy government that only cares about lobbyists who have the most money is no exception, so I know things can be changed within your lifetime, Leela Miller. If all good things must come to an end, then all bad things must also come to an end. 😭Or else the United States is doomed to forever be a plutocracy where human rights and workers' rights cease to exist because checks and balances failed us all when selfish authorities ignored the Constitution!

Allowing justices to be removed by Congress would be a horrible idea. If you think the court is horribly politicized now.... The very reason for lifetime appointments was to at least have a chance at a non-politicized court but rather hopefully to have one that actually is working to uphold the Constitution.

well if we cant get people to do something about it when there is the time to get it done, that would be the first step. The only time the 2 party system and changing voting gets discussed is right before the presidental election and they lose intenest after the election. They will forget that until the next election for president. And until that system changes we only have the two options and you have to pick one. If you dont vote you only help the one you didnt want to win. And unless there are enough dems in congress to make changes they cant get the changes to pass. Its not that people dont want to change tradition, just democrats have a long history of expllaining to their voters what is needed and they often bungle most of their volunteering.

Oh no times are changing. We are just now seeing change from things happening years ago. Things won't change over night, but they are changing. As long as we keep fighting we are pushing it to change. We are no longer staying silent. Everything the government has and is doing wrong is coming to light. Only a matter of time before they have to change their ways because they will be forced to. At least I'm hoping for the best

@@aycc-nbh7289 its not so easy like in the supreme court cause there needs to be a long beuracrtic way it need the aproval from 2/3 the Bundestag ( Senat ), 2/3 Bundesrat ( house of the Represetive ) and even then it needs the aproval form the Bundespresident who can say " i don´t think that is good for ouer contry so i say no " and he´s not allowed to be in a party and must act neutral form any party of the country

well at the moment the tiny majority is stopping them. the best option is gaining enought to overpower the republicans. Although thats near impossible to happen. We can only hope to keep the tiny majority and maybe get one or two extra. The republicans get the majority, at least we will be glad we didnt lose the fillabuster then. Although we would have at least passed massive bills and those would go into motion. But republicans would have likely taken the power back and they are far better at being unified than Democrats.

The left has the audacity of trying to make DC a 51st state. They have the audacity of trying to abolish the electoral college. They have the audacity of trying to make Puerto Rico a state (not sure how well that would work out for them). They have the audacity of using mail-in ballots to fend against the spread of a disease with a 99.8% survival rate. They have the audacity of a massive corporate media that basically responds to their every beck and call. In the unlikely event that the Constitution does not prevent the left from packing the court, the Republicans would see it as a duty to do the same thing the next time they're in power.

As a Canadian law student, I find it interesting to hear someone speak positively of our Notwithstanding Clause (the thing allowing the federal parliament or a provincial legislature to override the constitution). It’s pretty infamous for almost always being used in ways that abridge fundamental rights, most notably by multiple governments in Quebec curtailing the right to use any language other than French in both governmental and private settings.

Hang on, I'd heard that the reason for there being 9 justices on the court and there originally being 6 was because the number should reflect the number of circuit courts. So the number should be expanded to 13 now as the number of circuit courts has expanded.

i’m pretty sure that’s just referencing that a part of the original justification when it was most recently set at 9 was because of the number of circuit courts at the time.

It isn't a Rule, but it really should be. If the law tied the number of Supreme Court Justices to the Circuit Courts then neither party could play with it either... Not without creating a whole bunch of new circuits.

That's the thing. There's nothing really stopping them from adding more Justices it's more a matter of getting the approval though the house and senate ect. They just can't force a resign till the Justice is ready to step down or dies.

@@pugdad2555 although most of the lobbby stuff for the right has been exposed. Heritage foundation and republican think tanks have their suggested bills all ready to go in many red states. People only care about that when it goes into effect and they realize it effects them too. Unless we can get enough dems on the supreme court or get republicans to split off from their party if we cant get the majority then not sure what the lobbists can do. Hopefully Liz can be pursuaded to help dems pass some bills out of spite for the GOP. because shes not changed except for shes not willing to go as low as the rest of them, shes still going to vote with them even when she hates them

There is a movement in the legal community to shift to a more common language base rather than exclusively legal jargon. Beyond that, the only way to make law clear is to reduce the amount of it, so 8 to 20 different precedents do not apply to a case. Until then, lawyers get to argue which is best and Judges pick the road we travel in a purely subjective choice.

Having been overseas from being on active duty, it's very interesting to see how other countries are ran as compared to the US. We could be doing better, we could have universal healthcare, child care, paid family leave, a reformed supreme court, etc. BUUUUUT that's not going to happen in the US anytime soon with our current political and cultural makeup.

It’s not as bad for Tricare, but with Medicare and especially Medicaid, it’s a nightmare. Don’t even get me started on the shitstorm that’s the post-secondary education industry…

Declaring that the supreme court is not the one who should have established law allowing abortion? Or maybe it is in telling states that the 2nd amendment is a part of the bill of rights. Come now. Very weird, given that Thomas's ruling for overturning Roe V Wade specifically indicated that the constitution does NOT state natural rights, so anything outside of the Constitution's domain should NOT go to the (unelected, lifetime appointed) judiciary but get relegated to state legislatures, which are elected by the people. It's the opposite of tyranny. It's the most power-to-the-people move we've had in years. You want centralization and decisions made by 9 unelected black robed individuals who sit removed from the people for the rest of their lives.

14:07 - FYI, this is at best very misleading. Yes, life expectancy _at birth_ was probably about 40 years back then, but that just means the average (mean) age of death, _including all the babies that died in infancy_ was about 40. A better figure is the "adult modal age at death" (or variations on that phrase)... or, another way to think of it: _For those who make it to at least 18_ what's the life expectancy from that point on? You'll find it's more like 70 even back then, so... judges would still have made it a while, usually. See, e.g., "Three Measures of Longevity: Time Trends and Record Values", by Vladimir Canudas-Romo.

Since I have been in Los Angeles, I always know the people I would call would already be supporting a liberal stance. I used google voice for a bit and tried doing calls yet, didnt do much. I used to write letters when I lived in NV which was cool when I would get actual letters back. Although the ones who did, did not vote as I asked. (jerks) I did get a letter from Obama once though. I thought of sending a letter of praise and make it seem like i was a child to get one from Trump, but I just couldnt bring myself to write anything nice to that man.

Went to the thing in LA and then it started moving and I saw how the police looked to be instigating and I got my ass out of there to the nearest bus and went home. Im not good around police, i freeze up with confrontation. Its annoying since I look like id be able to fight but i am a pussy like that.

This is super interesting! One point of correction though, the UK doesn't have a written and codified Constitution in the way the US does. It's a real mess of unwritten traditions and agreements amongst both houses of parliament. It's pretty terrible really because there's nothing to stop horrific politicians (other than international law of course) deciding to deport refugees to Rwanda, for instance.

The assumption against packing the courts is that it assumes a pilot it compromise wouldn’t occur. Right now bad faith actors know there is no consequence to acting in bad faith. If they know that their bad faith can be undone, it’s less likely they will act in bad faith.

unfortunatly we dont have many democrats that understand the game play at all. Nancy Pelosi and the rich legacy Dems keep acting like all they need is to be right and that will go in their favor. Then they launch a bill with a long technical name no one remembers and they wonder why the GOP gets away with thier bill named the Liberty and Loyal American Give Children Freedom Bill. That will end up passing with no democrat support and the Right will claim we hate children and are not Loyal Americans and hate liberty. I mean they recently submitted a bill which was getting white supremists and Nazis out of military. They knew no GOP would sign it yet is it called the Americans Against Nazis and Bigotry bill? I dont know actually what it was called but it wasnt that. Im so tired of the Democrats just walking right into the GOPs traps and making them look bad.

Nice Video! ^^ While everything you said about the federal constitutional court of Germany is true, technically there are five other supreme courts for each section of law (finance, administration, family, etc.) which all have their distinctive organisation and number of judges. The federal court of justice is usually the last court where ordinary law cases end up. Cases that end up at these courts can be revised by the constitutional court as sort of a last resort to check constitutionality but for a lot of cases that won't even happen. Also worth mentioning is that the european supreme court has authority over our federal constitutional court in cases where their ruling goes against EU guidelines. So overall very complex but also balanced :)

As a German, it was quite embarrassing to learn how our Bundesverfassungsgericht judges are appointed from an overseas lawtuber. I did some other research and there are several points which aren't fully correct: 1. there is a 12-year term limit or the age of 68, not the 'normal' retirement age 2. the judges are appointed by both chambers of parliament (each one half), but every appointee needs a two-third majority. So there is that agreement in place which guarantees a certain number of seats to each party, otherwise they would never agree to a single candidate 3. there is no fixed distinction on which cases the two senates rule over, that changes from time to time to balance out the workload 4. while that is not an error in the video, there is a strict rule that every judge has to reveal all his supplementary income and even more strict - only those are allowed which are without doubt in relation to neutrality, integrity, impartiality and independence. So writing a book is okay, but participation at partisan events is not, and accepting money or vacations from clearly partisan donors even more so. Because of that, the public esteem for the court is very high. Just your sentence about the European Supreme Court is not really correct. Most of the time, both courts had a gentleman's agreement about not to dispute each others' authority. There was the one decision about the bonds where the German court indeed claimed superiority, but it seems that the waters have calmed about that.

The Canadian Charter is a genuinely incredibly constitutional document, and a major part of that is actually because of how it can be overruled and amended within its own rules. A number of constitutional protections can be overruled *if* a law is defensible under what’s currently called the Oakes Test - the government can create a law that infringes upon your constitutional rights and successfully defend it in court if it is 1) pressing and substantial, meaning the law must be important and necessary, and 2) proportional, which is broken down into three categories: i) rationally connected, meaning that the element of the law which violates your rights must be directly related to the government’s purposes with regards to creating the law, ii) it must minimally impair the rights of the person, meaning it has to be exactly as much infringement as necessary and no more, and finally, iii) it must be proportionate. Even if a law passed every other element of the test, it still fails if it isn’t a trade off that the courts (including the Supreme Court) are willing to make. Canada also has what’s called a “Notwithstanding Clause”, which was this fun compromise that everybody made when the Charter was being written which basically just allows a province to opt out of federal laws if they don’t like them - most famously used by Quebec in a shitload of legislation over the years as a statement of Québécois nationalism and sovereignty (for some in Quebec, feelings are still very, *very* hurt over what was described at the time by Quebec’s Premier Rene Levesque as “The Night of the Long Knives” when he was left out of the Kitchen Accord, it’s a whole deal, 100% recommend looking it up), but also was considered for use in the province of Alberta by Progressive Conservative Premier Ralph Klein when gay marriage became law in Canada - however, Canada has a strong division of federal and provincial powers, and the actual legal construct of marriage isn’t something a province is allowed to legislate on, so he dropped it. A lot of the Canadian Charter was written in a way that reflected the anxieties about going down the same path as the Americans, as well as the vulnerabilities found in constitutions around the world. These policies - including our Supreme Court’s structure - come from looking at other constitutions and the blind spots that they held, and finding ways to patch them. I think Americans would benefit from realizing just how differently things can be done. Not just in terms of the court, but in terms of the whole constitution.

@Un vaccinated Anticommunist In Canada we also respect contracts, we just also respect that Pierre Trudeau and his Liberals who governed when the Charter was introduced should not be allowed to forever dictate the direction of this country. We have a system that allows our constitution to be a living document so that it can meet the needs of the people. Part of why Canada’s Supreme Court isn’t so hyper partisan is that our Charter has created conditions to protect against it.

I would think that people would have picked up on that over all the marches which trump inspired. It does bring change on some issues. The George Floyd definately brought a change in attitude towards the issue of police brutality., It did nothing to change the officers behavior except maybe worsen the issue. Although there was a shift in the majority in paying attention to the issue. Although marching around for science or wearing pussy hats did nothing but help people channel their anger together.. I wish all the people who did not vote for hilary but showed to their marches had to wear a shirt and have people realized that the protest votes for noone or worse for trump, caused him to get elected. You cant always get the toothpaste back in once its been pushed out. And now I dont even know if enough districts can even be able to flip if we got everyone out to vote. Problem is they will complain ONLY AFTER they lose.

This was fascinating, for one I didn't know those things about the different supreme courts in different countries: but also summarising them all in a similar way and contrasting them so clearly, really made it make sense and come to life for me. Who knows my little brain may even retain some of it, I hope!! I'm in the UK ... I think our system is based on something like 'at least its experts picking experts'. I do like experts, but also I think we have a bad habit in the UK of thinking impartiality is a real thing, which I don't agree with. I like the sound of the German system, where it sounded to me like they try to overtly acknowledge the high chance of bias and work with it, not pretend it isn't there. But I hope they use that to still pick actual experts.

As a German - i have ZERO idea, what the political leaning of our supreme court judges are. I do not hold the illusion that they are perfectly neutral and totally fair, whatever that means at any given time. But whenever I hear them deciding on something I think: Well. That's reasonable. And If i am baffled and disagree and then look it up, i get their decision anyway. I am so impressed by the Brazilian supreme court, who keeps ruling in humanities better interest, despite the rulers spewing whatever they're spewing.

it takes a process to change it and people dont seem to be willing to do any of the work that is needed. Change gets talked about only near elections and people only want change if there is little effort or when they are mad. The lattter they give up as soon as their anger is turned to apathy. problem is many democrats also dont want changes that may get new progressive democrats. AOC is one of the few strong players that we have. Nancy is good at getting money brought in, but she doesnt want too much change

A senior scolded me; told me I was still a pup, saying he was 10 years older, on the day I was born, than the age I was complaining about being! The only change that's politically feasible here is introducing limited term like 5-10 years. And it should include a transition period where senior justices with more than 10-15 years tenure must retire in the next 2 years after the bill is signed into law.

Its why i feel dems should submit THEIR bills and have them veto them and prevent them from putting them up later because those are liberal bills.. Get rid of lobbying first. The entire reason judges don’t have term limits is to get rid of special interests.

Fun fact: the Dutch supreme court (called the High Council) actually has around 50 justices. But they are divided into four areas of law, and are only allowed to judge on cases pertaining to their area of law. So we'll still have 'only' around 11 justices deciding on a case, but with the guarantee that they are an expert at that area of law

I like the idea of the Supreme Court not being able to outright nullify a law, but to kick it back to congress and say "Rewrite this so that it is consistent with the language of the Constitution.". No more legislation-by-proxy when the courts are ideologically imbalanced. I also really like the idea of age-based term limits and having lower circuit judges prepare the list of candidates to present to the president. There's no reason why we can't have that here in America. I'm disappointed in my fellow countrymen that they care more about clinging to what little power they still have left than they do about making a more free and equal society for everybody, regardless of political affiliation.

The fact that any court official ruling over law can be partisan kind of baffles me. I don't know much about how legal and political systems are organised, even in my own country, but aren't normal judges meant to be apolitical?

ideally, of course the decisions they make in court should be apolitical! but judges are people, and you can't realistically expect a person to be completely apolitical, especially not in a democracy where you want everyone to vote

The problem is that in the case of Roe v. Wade they had to interpret the law and inevitably that forces you to be biased. And if you ask me, saying that the constitution does not protect abortion is the more correct imterpretation. The 'It's been a precedent for 40 years'-argument doesnt work because you can use that argument to also claim that all the court rulings that brought us more rights also overturned years of precedent of previous court cases which dismissed these rights. Thr validity of a law is not dependant om how long it's been law. The US treated black people as legally lesser people for decades - that doesnt change the fact that these legal practices were wrong. You cant defend a law by talking about how long it's already been in effect. The 'The overturning of Roe v. Wade was political' argument doesnt work either cause then you could claim that Roe v. Wade itself was political in the first place as well.

@@thelreadtheunready4051 By the ninth amendment the constitution does not have to protect abortion for it to be an absolute right. Back when the constitution was written no-one, not even the Catholic Church, was against abortion. It was just something that women did as and when they needed to. So if the present justices really meant what they say they about being originalists they wouldn't have made the ruling that they did. The overturning was a political act because every Republican appointed justice was vetted for their intention on this issue. The original decision was not political because it was made by people examining the issue and coming to a decision not based on their political affiliation.
