I’m going through the same situation right now. Recently filed my complaint through state court after receiving the right to sue. Didn’t know I had to pay in order for the summons to be served. So I did that and now I’m waiting on them to respond nothing yet. They only have thirty days so I was thinking they may just let it go to default. If they respond they have to back it up in court and that’s what they don’t want to do. So thanks Vince I think I got my answer!

Hi Vincent - in the respondents Position Statement, in speculation why would their attorney not respond to certain claims we're making, but simply just ignore them in their PS? Are they possibly hoping that these accusations will simply fade away if they don't address them?

I’m wondering this. My previous employer did not respond to my attorney’s demand letter so my attorney filed it in court yesterday. I live in Minnesota but my previous employer isn’t even registered as a business in Minnesota, only in Colorado. My attorney thinks (and hopes) my case will go to federal court due to the different jurisdictions/states. I’m genuinely wondering why they wouldn’t respond at all to my attorneys demand letter though. Like are they just hoping I didn’t actually have legal representation or have no proof (which I have an overwhelming amount of proof including audio that I don’t think they know I have… MN is a one party consent state).

Finally, I am going to early mediation tomorrow. My former employer refuses to retain any counsel. Both my attorney and I are going in with low expectations and planning for the continuation of the investigation. I was hoping they would retain an attorney to see the exposure and take mediation seriously. Love the videos Vince!

@sek4110 from filed to a date set. 4 months. Employer requested it after an Investigator was assigned. I have zero faith they are going to take it seriously.

My former employer lied about why they fired me in the first place! Their reason wasn’t good enough for the unemployment office and I ended up getting benefits! However, their investigation dragged on for 2 months before I saw a dime!

@@dianetigert1310 Texas…we go through Texas Workforce Commission. They admitted to us the employer lied. TWC also works with EEOC. I got the right to sue from both companies. Just entering the discovery phase

@@tbroberson24 don't forget about the meet and confer process, because opposing counsel might try summary judgement or demurrer. your interrogatories, requests for genuineness of documents/ truth of facts is your case......just putting the ways of the adversary out there for you to be ready for the true battle...TRIAL.

Mr. White, I am studying to be an executive at a government agency. I fight for employees needs and rights, but sometimes we have bad employees who steal time and materials and hide behind artificial discrimination chicanery that is completely bogus.HR will not terminate them because of threat of lawsuit and our staff attorney won’t give any feedback. Can you talk some on working from home then being forced to work in the office. My current employer had me sign an agreement that I would work hybrid, in the office twice a week. That may increase depending on departmental needs. I'm in a division within the department. After working in this model with them for 1.5 years the division claims they need me in the office 3x a week. Increasing my in office days. Can I dispute semantics since we are a division within the department?

It's not unusual in a hostile workplace. Be mindful your employer may be building a paper trail to terminate you for. Document, but not on workplace devices.

So here's my situation! After a few edits of a demand letter working largely with a paralegal, we were all set to have the attorney review it and finalize it. I was told to anticipate a final draft by the end of the week . . . Four weeks ago. Reached out twice since then, got pushed back/excuses and so I reached out again Monday night and no answer. What the fuck! Why are they going dark all of a sudden?!?!?!

I’m in a similar situation with my lawyer but waiting for the final demand letter from my lawyer and it’s been nearly 2 months! There’s always an excuse or just no reply at all.

File a small claims suite and proof of service. Let opposing party play silence then, motion for summary judgement, default.

My lawyer never looked at my Rebuttal prepared by someone who called me to do it. He was never told what happened. On top of rudeness, he said he didn't think I would win the case. I ended up doing most of the Rebuttal and submitting it to EEOC. Easy money for my lawyer.

@@dianetigert1310 Yes! Life seems to have many situations that look like a lawsuit. It's a game for those with disposable money; unless you can find a lawyer who will charge a contingency fee. My lawyer's fee to file a rebuttal with EEOC was $5,000. Another $10,000 was wanted to file a case with the court after a Right To Sue Letter was received.

Hi Vincent! So my EEOC case changed from mediation to investigation pretty quickly. There were around 30 people on my team before I got terminated. The other person that was terminated also had a disability. Would this be admissible in court? She disclosed her disability, which happens to be the same as mine (epilepsy) to me in conversation.
