I will NEVER understand how the law gives a spouse half of all the assets when there’s proof of infidelity. It’s ridiculous
@SupaSnupak00paАй бұрын
Well you can thank no fault divorce for that. Initially when everything was at fault then the party who committed adultery was the one to lose out. In the case of women this meant being out on the streets with nothing. But no fault’s premise was to first split all marital assets evenly, then make adjustments. It was a means to speed up the divorce process but you can see how that turned out

The fact that she left her job immediately after getting married, especially when she wasn’t pregnant, meant that she likely had this planned from the start. Because she knew he’d be entitled to half of whatever she owned from the divorce as well, so having no active income after the marriage meant that she would have no marital assets to share with him. She planned to use him financially and get out when the time was right from the start. Because if she didn’t have that plan, why would she so willingly allow her phone with her cheating partner’s number on it to be out and visible right where he’d see it?

If they don't have children then why is she a stay-at-home wife? Why? What the hell does she do all day while her husband is working? Is she a ladies-who-lunch type? No wonder she has time to have an affair. Five years of doing NOTHING. The husband was a total wimp for allowing her to manipulate him like this. She could have been working and building funds for retirement... or for wonderful holidays/vacations each year. Yes, I know some teenage moron who has no understanding of the Law, probably wrote this story in creative writing class. If the House was technically owned by the guy's father, then they are tenants and must be paying "Rent". Plus, any Investments and Savings would have been funded from the marital money (his income) so even if the Bank accounts were in his father's name (which is obviously ridiculous), the funds were sourced from marital income and she owns half of it. It's the same as if he was ending money off to an offshore account or to a Trust. It's still marital income that is funding it, so she gets half. Dumbo the husband, being an accountant, would know all this.
