Father has a right to give the property to whom ever he likes. He may not give it to any children and donate whole amount. Ancestral property becomes self owned after death of the owner and divided between legal heirs. Children, spouse, grand children and paresnts are classified as class 1 legal heirs. Discuss with them about property share if all of them do not arrive at a conclusion, hire a lawyer and get orders from the Courts. It takes 8 - 12 months to get certificate & order from the court.

So …. Two years wasted because the case was filed in the wrong court!!! Of course, because the wife has held custody for so long and no visitation was given (probably wife denied it), the child has no connection or familiarity with father and therefore cannot ask for custody. However some other dude who walked into wife’s life is allowed access to the child. According to lawyer, father has not taken care of child. The school fees and likely other financial support has no value whatsoever. Who approved the second marriage of wife? If father cannot access/visit the child, then how some other random dude be allowed the same privilege?

Maintenance is directly concerned with marriages/divorces I think. Maintenance aakhi chahiye Q ya to marriage hui hai ya fir divorce hui tabhi chahiye. To aysa kahna ki......kuch hajam nahin ho raha hai. Dusri baat ki jo mahin first husband ko chhod ke dusre ke saath shaadi banai to bharosa to gaya. Ab kya bharosa/vishwash ki wo 1st step father ko chhod ke teesre se shaadi kar le. Impossibilities hai to possibilities bhi hai. Ti atse mein us mahila ko dusre husband se bhi bachhe ke liye maintenence milna chahiye court se. Jaisa ki first husband ke saath court ka decisions kiya gaya hai to Q ki maa to maa hi hai. Fir to ye jhhol hi lagra hai. Mujhe lagta hai ki wife jab decisions leti hai dusre shaadi ka aur bachha apne saath le jaati hai to us bachhe ka maintenence dysre pati ki jimmedaari honi chahiye. Jab us mahila ka maintenence dusra pati lega hi to us mahila ke bachhe ka Q nahin le sakta dusra pati. Dusra shaadi bhi kar lo aur bachhe ke naam par peeche se pahle husband ka properties bhi le lo. Tonpahle husband kevpaas bacha hi kya, properties to gaya hi gaya bachha bhi sab din ke liye gaya jab ki shaadi us pati ne nahin maa ne ji thhi. Ismein pahle pati ka kya dosh thha...! Magar fayse se pahle pati ka emotions, properties ke saath bachha bhi....matlab sab kuch gaya bona ki dosh ke. Ho sakta hai main galat bhi houn. Magar hajam nahin ho raha ye baat. Yahi agar pahla pati dusra shaadi kiya hota patni ke badle tab court ka decisions kya hota. ?

If mother take the custody of the child and marry a second person and step father official adopted the child. The child is heir of the step father as the child is legally adopted.
