I have followed this case, this is the same one in which the wife had asked for 6L per month maintenance and this judge had asked for affidavit of income/expense/assets from both. Its from those affidavit they have found that she has moved 78L in one year, has inherited some 18 acres from the father and is probably at least as wealthy as the husband if not more. I had noticed this in her earlier petition of 6L wherein she had mentioned Calvin Klein shirt for 10K as necessary expenditure per month, but had not mentioned rent/emi for house. And I was like how is that possible that someone is asking 6L/month for pocket expense but not for a roof over the head. So clearly the roof is worth enough that one can sustain for life. I think that itself was indication enough that the wife is simply playing the system.

It is not legalized because of a stupid logic. As per indian judiciary marriage is sanctimonious and can not be bound by an agreement. At the same time marital cheating is now not illegal. Ecent after cheating, wife can ask for alimony and it is legally very hard to prove cheating. God knows why this two faced law is there. Either say marriage is sanctimonious and make any sort of cheating a valid reason for a quick divorce withoit any liability to wife. Or make marriage a legal agreement and let couples decide their alimony terms in pre nupital agreement.
