Here in Texas I need a truck in order to get in and out of my neighborhood. My driveway is paved but the road to it isn't. Glad they don't say a word about my 4 heavy duty trucks, 2 horse trailers, 3 tractors, 2 flatbed trailers and 5th wheel rv.

Apr of a home outside of an hoa compared to one inside an hoa the one inside increases value at a significantly lower rate than the one outside of it. There’s a lot of reasons to buy in an hoa. But you’ve got to look at the long term investment. Hoa isn’t all good

I bought a house on 5 acres in an area that had CC&R' s - everybody but me. My deed was clean of any covenants or restrictions, yet I was harassed for over a year for my classic, antique trucks and Amateur Radio antennas. The trucks were parked on my driveway behind a fence, and the antennas were invisible in the trees on my property. People still complained even though nothing could be seen from the road. The fact that these things existed on my property was a "bone of contention" to all. I finally had to post my land and threaten these other homeowners for harassing me before they finally stopped. I still live amongst the "land barbarians", have no contact with them, and they are happily still upset by my possessions. They have to live by their mistakes - I don't.

I lived in a City that was worse than an HOA, they came out an measured our grass. If it was over 3 inches, they would mow it for you and charge you $200 each time. Same for weeds, unkempt bushes, or trees with branches that hung too low to the ground. They'd come on the property, weed-eat, trim bushes, then charge you out the ass. You were required to have sidewalks, keep them in good repair and keep them clear of leaves, grass, and snow at all times. They fined us for having trees too close to the house, for not having the house painted (it was a wood siding that was designed not to be painted, it treated and water sealed), we had to go to court to fight the fine. Oddly enough, the city has seen a decline in population of over 10% in the last ten years....

This covenant was written back when pick up trucks were nearly exclusively used as a work vehicle. The problem I have is the rotten busy body neighbors that actually had the nerve to complain. Now the neighbor that confronted the kid, is acting illegally. and his threat to call the police and his threat that the police would write tickets or have the vehicle towed is also illegal.

I remarried in 2004 and moved to Melbourne, FL. My husband had a condo and an HOA. This was an older association and the monthly fees were as much as the mortgage payments. It was in his name solely. I attended a few meetings where it was discussed that two assessments were to be imposed in the hundreds of dollars each. Most of the residents were elderly people who could not afford the extra costs. At the next board meeting I stood and politely asked when the accountants had last conducted an audit. Silence. There had never been one. Shortly thereafter 2/3 of the board resigned and a new management company took over. My husband was informed he could leave his wife at home in future. It pays to work for lawyers for 40+ years.

actually it is a constitutional issue. The constitutional amendments clearly state that any law that violates the liberties of the bill of rights is not only unlawful but unjust and un-enforcable. This kids right to life, liberty and the pursuit of happiness along with his right to purchase and own property and keep said property in his immediate lawful possession IS included in his constitutional rights. The idea that any group, for whatever reason, has the authority to specify or vote your right away has never been a right of the people and we are protected from these authoritarian groups by the constitution.

Joe... the road is privately owned. They have control over it like walmart does its parking lot. The constitution limits the government. Not private buisness. You bought A house on private property and agreed to the rules. It is contract law that governs this not constitutional law. There may be laws that the hoa is breaking. But that's why you are forced to hire a lawyer to challenge against any state laws that limit an hoa.

He should have and could have found a pro-bono lawyer to present his case. The by-laws, as they stand, regardless of fairness, are legitimate and enforceable with one important exception. If there are others in the subdivision that park SUV's without repercussions, then the division has violated their own contract and applied it in a prejudicial manner rendering their objections null and void.

ianrsigel ding ding ding! We got us a winner. I put up a shed against bylaws that prohibited any structure in back yard to be taller than the fence which is 5'. Of course the HOA president and letters with threats to fine and sue came right after. I showed up at court, representing myself, and won by providing photos of other units' (including the HOA president) and their huge pergolas. Judge sided with me and dismissed the suit. Fast forward two years, we just put up an above ground pool, also against bylaws, and have not heard a peep. Law is law. You either apply it unilaterally or they are null and void at least in my HOA and state.

I would spend my time driving around the neighborhood picturing and documenting every truck and SUV parked in the driveways. And present that as your argument as they are only citing you. Matthew even stated that there are others, some of who have even opposed him and his truck. Even if they regularly park in their garage, if it is in the driveway unattended, it is parked, and subject to the same fees and scruteny as his.

If it was me I would put the truck in storage off site and buy the oldest, running, multi-colored, smoking, beater that I could find and drive it and park it daily in the same spot as the truck. I would spray paint " how you like my truck now" down each side and wait for the HOA to beg me to bring the truck back.I once owned a condo that my mother lived in and the rules stated that residents could not park a truck or a motorcycle, even in the garage. Fortunately after my mother died I didn't move in, but that was my plan if I did.

When I was 18 I bought a cadillac escalade pickup truck. The city of Coral Gables FL issued me a $150 fine daily for keeping this brand new vehicle in my driveway. I saved up 3 years to buy it. The fine totalled $10,000 which I didn't have. I couldn't afford a lawyer either. This caused me to go into debt and I had to claim bankruptcy at 18. This ruined my life for 10 years. The city of Coral Gables ruined my life over something so stupid and unconstitutional. Thanks Coral Gables for treating your residents with such respect and for violating my human rights. I moved when I hit 25 and I'll never go back there or have an oz of respect for that communist dictatorship of a city. FU #CoralGables.

sixtyfiveford Exactly. When I was looking for property to build on, I told my wife we would NOT buy into an HOA. But we found property that only had designated road fees. Even then I fought them because they wanted to pave new roads for a guy developing his land!!

Kid worked 2 jobs to pay for old school Ford F100 (impressive taste in vehicles!). Pays insurance and gas. I tip my hat respectfully to his parents for doing a great job. Edit: And he's an A student? Where is my kid (probably on the couch, eating Doritos playing Xbox) - he needs to see this.

Ffs here's a clean cut teenager , with a very nice pickup truck , there's alot of older guys drooling to own a truck like that , and WHO IN THE FK has the right to tell ANYONE what they can own , This kid pays his licencing , insurance , has a job , These Prudish people need to hold thier breath and EXPIRE from lack of COMMON SENSE . It's not like he has a rusted piece of crap falling apart and blowing black smoke everywhere , other home owners voting to get rid of this kids classic truck and own a SUV OR TRUCK THEMSELVES , Total Azzholes , should fine them $25 day for having NO BRAINS ! Cripes wish my municipality would act like like this , we have a neighbor who parks a POS rusting out and keep junk around and nothing done about it while everyone pays high taxes !

These laws were written in the 1970's when people didn't have trucks as a family car. It is a new century. The best selling car in the world is the Ford F-150. Most everyone in my family owns trucks (I drive a 1969 F-250) and trucks are now common 'family cars'. Get With The Times People!!

as a former soldier this bothers me. alot. as americans we are told everyday how "free" we are. this is his truck on private property. where does the line get drawn where enough is enough. what is stopping people like this from declaring laws that you cant own a motor vehicle? why does a neighborhood have the right to tell anyone what they can or can not own? completely absurd. this type of intrusion on personal rights needs to be fought in every form.

I clicked on this thinking it was about "Lake Wildwood" in Grass Valley, CA. My mother lived in Lake Wildwood back in the late '90's. She had a love of roses and grew several different varieties on the property. Because Lake Wildwood has an open area situation, fences were not allowed. This allowed deer to roam the grounds with impunity. When the roses were blooming, the deer would feast on the rose buds, ruining my mother's effort at raising beautiful and fragrant roses. To curb the deer, my mother put small fences circling each rose bush. The wooden slats on the fences matched the general appearance of the wooded area which Lake Wildwood inspired. The rose bushes, and their small fences, were not visible from the street or pathways. Somehow, the HOA got wind of the fences around the rose bushes and tried to assess my mother $25 a day, FOR EACH FENCE SURROUNDING EACH ROSE BUSH! After fighting the HOA for several months, she was forced to give in and removed the fences. She gave up on growing roses...... and passed away 3 years later.

HOA covenants can not be selectively enforced. So you have two things going for you. First, if you are fined per day, they would have to document and only be able to fine you for days it is proven that it was parked in you driveway overnight. Secondly, they must also go to the trouble of documenting every truck or SUV that is parked in the every other driveway and document that it was overnight. Everyone must be fined, you can not be singled out. If you can show a long history of the rule not being enforced, that would also be on your side in a court of law. It does not stand by its self, but it is a factor.

HOA's are ridiculous sometimes, and this kid is a clean-cut quality guy too. His truck is clean and not an eyesore of any kind. Hell, I bought a Chevy truck that was brand new with fancy wheels, raised it, and it was nicer and more valuable than most of the cars in the neighborhood. In about 1986 or '87 I rented a house in a place in Woodbridge Virginia that had an HOA. It was a single family house and the day after I moved in it was around 95 degrees and the AC didn't work so I had the windows open and all my fans blowing. Some guy from the HOA came by and told me I had to get the fans out of the windows because it would give prospective tenants and buyers the impression that the AC didn't work. All I said to him was, "well DUH, why the fuck do you think I have all the windows open and fans in them all?" Fucking HOAs should only prevent trash buildup, not legitimate goings on. In that particular place I also eventually got a job that gave me a company 6 wheel work truck but if I wanted to drive it home I would have had to remove 2 of the back tires every day before going home. I guess it is embarrassing that people actually have JOBS that indicate they WORK for a living.

HOAs are suppose to keep your property values high the real fact of the matter is HOAs property values are cheaper. I know this as fact I just recently bought a home in Arizona I didn't want to buy in a HOA area but all the homes that were not HOAs were 50,000.00 dollars more expensive, I could only afford in a HOA community I rest my case. This is completely ridiculous...HOAs should be outlawed to never ever to return to our communities ever!

An HOA is basically an unregulated legislative body that has control over your house. I lived in an HOA once, I learned my lesson to never do that again. I live in phoenix in a non HOA neighborhood now. All the houses and yards are clean, well maintained, its an old subdivision built in the 50s. City code enforcement does a beautiful job if there is a violation. If you don't correct the violation in 2 weeks you get a ticket and the fine is $2500 a day up to $10,000 plus the city could fix the violation at your expense.

I met an older couple who lived in a nearby housing development who told me about the harrassment by their code enforcement over their young grand daughter living with them for more than 2 weeks in an over 55 y/o only development... Their son (father to the young girl) was a soldier fighting in the Iraq war with no one else to watch his daughter....I told them to go to the media with their story...shortly after the local newspaper article the development got so many angry calls from VETS, active military, politicians, citizens etc... from all around the world they had to change their phone #... They eventually let her live with her grandparents. i got a nice note & cake from them. I have seen MANY horror stories about this...NEVER EVER move to a housing development!

It was probably agism (discrimination based on age). A High school kid is more likely than full grown adult to be told where he can park his own vehicle because of his youth. The other residents with trucks, because they are adults, are less likely to have a law like this enforced against them.

Do this the legal, slow way. Get a Lawyer. File a suit of Discrimination against the members of the HOA. Also have the Lawyer send letters to EVERYONE who has a pickup truck that these POWERMAD people have attacked your right to park yours in your driveway and they are threatening a fine for every day you DO park it there. In these letters he must include that he will name each of them as possible called witnesses in the court case he is bringing against the HOA as one resident is about to be fined and they are not, YET. Make it a part of the Courtroom case that since no other has been fined for the same offence, it is being used as a type of DISCRIMINATION against Mathew and him alone; which makes it illegal and the Lawyer can include that if the court allows them to fine him, they must NOT discriminate and must fine THEM all, also. Watch how fast those 40 other Pickup owners start talking to their neighbors and wonderful HOA members!! Threats of fines do not last long when there are many voting out the current HOA members.

Mine gets quite a few miles on it each month and most of those miles are hooked up to a trailer of some sort. Even a base model one ton, dual wheel truck with a diesel engine is over 50k. Now my truck also pays for itself.

Back story: Back in the 70s, there was (still is?) an attorney who lived in this development with his wife and 2.3 children. Said attorney was also on the BoD for the development. One day, word got around to him through a friend of an uncle's sister in law's best friend's daughter that the pool guy was pumping out his ol lady while he was at "work" doing his attorney stuff, which probably (very likely) involved pumping out his secretary after their three drink lunch. The attorney decided to introduce some regulations under the table to ban trucks from the development to keep the pool guy out and away from his home. The guy just slid the ban in under the radar so no one would know about it because in all likelihood, it never would have made it. Regarding the question of the El Camino, the thing about them is that they're actually a Chevelle station wagon that has been modified. I don't know if they continued the practice, but back when I had my '69 El Camino, if you did a little bit of looking around under it, you could clearly see the rear seat mounts. I've heard that some of them actually had the seatbelt holes punched out, the nut welded in place where the seabelt would be anchored, and the 50mm Torx bolt wound into place and tightened. I don't think mine did, but I don't know for sure because I sold mine long before I heard the story about the seatbelt mounts. They didn't actually start from the ground up building them... if production today called for "X" amount of El Caminos to be built, then "X" amount of Chevelle station wagon completed chassis were either sent down the other assembly line where El Caminos were being built, or those chassis would be loaded onto a truck and shipped to a plant that built El Caminos.
