A day or so earlier than usual, but this was a topic I wanted to cover before the break. Trump's threats against Panama have been extraordinary, especially as they seem to have come from nowhere. But behind it lies a long history. So, what do you think will happen? Is there really a chance that Trump will use force? Or is this all about angling for a diplomatic solution? This Panama talk is not about Panama - it's about Taiwan. Trump is saying that there's plenty of ways to dispossess China from stuff without risking a fight in waters where China has home team advantage. Meanwhile, Trump building up chip-making capacity within continental USA.

The 77/79 Panama Canal Treaties are illegal under both Panama and US International law because: A treaty between these 2 countries can only be made with the elected President of each country, and Omar Torrijos was a Dictator who was not legally elected but took the position of "General" by force. So, on that one point, the entire treaty is invalid. Even the Supreme Court in Panama states that the 77/79 Panama Canal Treaties are unconditional and invalid. So, if the US wants to take it back, they can 100% do that. Read CANAL GATE by Samuel Stoll for all the original documents and answers to every discussion and arguments on the American Panama Canal and Canal Zone.

Panamanian here. I like Trump, I've been following this roller-coaster of entertainment politics and like him. I know he's a proactive aggressive negotiatior, I remember his BS fight with Kim Yon Un and results, other funny troll chad moments, his recent statements about México and Canada, his plan to stop Russia vs Ukraine, Israel and neighbors. *But HIS TIMING couldn't have been WORST:* around the commentation of December 20th(1989) USAs invasión to Panamá. So even Panamanian like me who like Trump and know how he plays, really dislike this. Imagine yourselves if on the commemoration of Pearl Harbor, Japan arbitrarily decided to fully remake their army and demand flying wherever they want. Regarding the abusive husband or parent type of logic "I made you, I own you", you see you deranged it is, coming from a country that virtue signals about freedom. Thank you for the help in our independence. Regarding Torrijos Carter treaty that gave us back the chanel, YOU'LL NEVER SEE a situation in which after anyone has fully paid their house, and then new bank administration says "We made a mistake selling you that house so cheap. We made it, we want it back!". Why dont you dig Jimmy Carter and yell at him instead. Trump will continue Theodore Roosevelt's big stick politics, and I can see Trump making some economical proposals with us, probably even proposing to BUY the canal(dame as Greenland); he CANT push us towards China(they're getting politically too friendly) the same way the far left pushed many people towards Trump. But he'll have to lower his intensity : Panamá has always been a USA ally and doesn't deserve this level of aggressiveness, else we'll have no option but to join BRICKS. Dont push us.

Even if he tries to negociate something about ownership or control over the Canal it'll be a hard "No". We have exceptionally managed the Canal, paid for it and mantained it while the USA hasn't helped. The Canal is Panamanians and it always will be.

@@Marsffect Of course. The price per ton of cargo is unbelievably cheap. Panama should charge 5-10 times more than the current price. Also, the US military personnel have been training Panama special forces for two decades specifically on defending the canal!!! Trump is ridiculous, old man who hasn’t got the slightest clue about politics and diplomacy.

Panameños would say you significantly underestimate the US 1989 incursion into Panamá. 1) Military fighting last weeks. 2) Panameños viewed it as an unlawful invasion, as act of war. 3) 6,000 panameños died. 4) US military covered up deaths by destroying records. 5) US forces started by crippling Panamanian communications so hide US invasion. 6) US CIA supported placement of Noriega as president. 7) This was an unjustified act of war under international law.

No. Panama would vote to become part of the US, and Mulino is a big fan of Trump. The whole government is. Nobody cares about the soldiers who died for Noriega. Panamanians have a short memory and love the US. Sure, the US did bad things when there was a canal zone, but this time around there won't be a harsh regime, it will be soft. Trump just wants technical control, and Panama wants the Panama Papers sanctions that exist to this day to go away. Since Trump lost a lot of money from that, everyone is on the same page. Even the opposition. The opposition hates the canal authority and the corruption. The only thing they will be bitter about is the fact that Kenneth Darlington is Panama's Luigi Mangione. The mine will reopen along with new mines. That will be the result of this. Any opposition will be brutally squashed, and nobody will really protest because they will have much more money. It's win-win for everyone except the indigenous, but is there any country on Earth that cares about them? Everything else you say about Bush, the CIA, and Noriega is true. We know this, and nobody cares. Move on and be happy Torrijos didn't become president. Or Lombana. Mulino is doing good.

err no, a declining empire would have a head of state that would leave the affairs of running it to underlings while pursuing other pleasures. Take Tsar Nicholas II continuing to play tennis after being told his fleet was sunk by the Japanese. Or the Roman Emperor Honorius when told Rome had been lost he thought it had been one of his pet chickens named after the city. Trump seems to have a near Genghis Khan like desire to project strength.

It is important to note that during the American construction period of the Panama Canal, about 6,000 workers died and only a small portion were from the United States. The great majority of the workers who died were from Caribbean and Latin American countries.

Noriega used his status as CIA agent to protect his criminal empire. He convinced the CIA and the U.S. government to look the other way until the first George Bush couldn’t ignore the problem anymore. By that time it would be fair to say that Noriega had gone rogue.

@@maxb4074 How else do you suppose it would be accomplished? I’m not at all saying it’s a serious threat, but it’s absolutely an implied threat. I think there are two things going in here. Primarily Trump is playing domestic politics, trying to stay on the “front page” of the news and to keep his nutcase base of support happy with bellicose rhetoric. The second thing Trump is trying to accomplish with his aggressive talk is posturing in advance of negotiations. This sometimes can work, but the problem is if someone calls your bluff.

People seem to fundamentally misunderstand why countries make agreement with United States. The US isn’t trustworthy and has broken agreements all the time in the past. countries continue to deal with it because the United States continues to be the wealthiest, technologically and culturally dominant country in the world. As long as that remains, deals will get done.

What fees to US shipping? The US has owned no significant shipping lines for many years. The only US shipping line in the top 30 is Matson with 0.2% market share. The main issue is the Jones act that makes it prohibitively expensive for US companies to build and operate vessels. So yes many of the goods that transit via the canal go to the US and a few come from the US but on foreign vessel. also assuming the highest fee for a vessel is USD300k in transit fee. Expensive for sure but on basis of this being a vessel with 14000 TEU's this come to 21 bucks per container. Basically nothing. On the other hand, Trump's tariff of 20-25% would come to millions extra cost to consumers for that same vessel (potentially well north of a hundred million for a fully loaded Panamax offloading all into the US)....

you see, the problem is that with all the treaties and laws protecting the Canal, there is one little clause (i think it's a clause) that makes the US transit free in the Canal, the US only has to pay the taxes. This is determined by the size of the ship (in general, like weight, what it carries and such), if the US is so concerned that it's too expensive then idk my guy, go the long way and don't pay anything or downsize. Literally no other nation has ever complained that the fees are too high.

Panamanian here, really liked the video. I think the events of 1964 needed a bit more context. The January 9th events lead to Panama breaking diplomatic ties with the USA altogether, and it gave Panama the needed diplomatic ammunition for the current strong man, Torrijos to go on a world tour campaigning for the sovereignty of the country. (Literally, he was all over the world.) That's without mentioning the heavy influence of the US during the WW2 and the cold war era in the nations instability. Multiple coups were supported and backed by the US in order to gain or at least keeps it's influence. This events lead to the dictatorships that eventually lead to the invasion as a whole. Also, Noriega was a double agent for the CIA, worked closely with Bush father. The same American president that would end up overturning him. Panama was also used as a proxy to aid the Sandinistas in Nicaragua, Daniel Ortega is still in power till this day, speaking of sowing the seeds you plant, eh?

All very true But 1 Panama would not exist without USA meddling 😅 2 Panama canal would not exist without the US building it paying for it protecting it and clearing malaria from your country so it could be built... There is no world where Panama is independent.. this is a fact you need 2 deal with like adults Do a deal and make it a good 1 Become a state of the USA .. or join a federation so you get lots of benefit and no cost But don't let the Russians and Chinese who live thousands of miles away make problems 4 you Hell I bet Trump has some money in a Panama bank 😅 So your already his best friend 😅. I think you’ve got a big gap in your knowledge with what you said about the Sandinistas in Nicaragua. What you must be thinking of is Panama being used as a staging area for support to the Contras, the paramilitary organization(s) in El Salvador fighting against the rebels there (who were mainly terrorizing the populace). The U.S. didn’t support the Sandinistas. The Soviets were able to support the various Central American insurgencies, usually channeling their limited efforts through Cuba, not Panama. Incidentally, the Sandinistas did conduct fair elections, at least the first time around, and the Nicaraguan people elected Victoria Chamorra, who was a pro-Western conservative. I’ll give the Sandinistas full credit for that. Unfortunately, the Sandinistas themselves suffered a split between the nationalist faction and the corrupt socialist faction that was led by Ortega. Ortega has been a disaster for Nicaragua on the whole, but it should be stated that Nicaragua has fared better than Salvador or Honduras over the past 30 years. Most of the immigrants fleeing Central America are from those countries with very few fleeing Nicaragua. As a side notice, it’s illuminating to note that the current border “crisis” on the U.S. Mexico border is largely due to U.S. policies in Central America during the Cold War. This is what is known as blowback, the unforeseen long term consequences to poorly thought out strategies. Still, in fairness to the U.S., it was acting during the Cold War and in response to Soviet shenanigans in Latin America.

It was the CIA that was using Panama (and to a lesser extent Costa Rica) as a base to support brutal anti-communist dictators in Central America. The Soviets used Cuba as their staging area to smuggle weapons, and they used Cuban agents to subvert what were originally nationalist movements. I think we should also keep in mind the Cold War Context. The U.S. wasn’t just effing around for the sake of effing around. The policies might have been bad, but there was a serious reason for them.

You don't understand that the significant Chinese minority of Panama runs the entire logistics of the country, and they are Cantonese people who hate Beijing, but don't really talk about that sort of thing except to close friends as they rely on the Chinese suppliers to make money. Not only that, the entire government is pro-Trump, including the president. Many are dual citizens. Whatever you hear from Mulino is domestic bluster. Behind the scenes he will negotiate, and he hates the corrupt canal authority every bit as much as his opposition (Lombana and the PRD). Panama would vote to become a territory. Minority voices are being amplified now.

The problem is logistics. Panama is too close to United States and too far from China for your plan to actually work. The United States could quite literally occupied Panama with minimal effort before China could even get anything to Panama.

For Panamanians (Yes, I am one), the Canal is very much up there with the flag 🇵🇦, being a national symbol, but one represents a good chunk of the GDP and the other one looks nice on display. I think some people, also, minimize the geopolitical importance of Panama for the whole world. Thanks JKL, this video was long overdue. It’s good to hear a story being told from a neutral standpoint as opposed to trolls seeking to trigger emotional responses. I will say you underplayed bits like: Panama breaking diplomatic ties with the US in ‘64. Trump’s comments being done a day after the US invasion anniversary, and the likelihood of Latin American unity against actions that would undermine Panamanian sovereignty. Overall tho, this was a good unbiased video and you were probably right to leave out some points that could potentially mislead the narrative. Thanks so much!

After reading the Treaty and amendments, I noticed your reliance on initial clauses stating the obvious divestiture of the Canal Zone to Panamá from the USA. I also read the conditions of the Treaty and subsequent remedies section of (b) specifically. Does it not appear there has been a breach of the Treaty?

Although Britain and France were at a low point in their global influence, they still had the capacity to assert control over Egypt, which they demonstrated by successfully invading the country. However, they ultimately withdrew due to demands from both the United States and the Soviet Union.

Hi James, as a Panamanian, I thank you for putting the topic on discussion. But I also would like to add some more: 1. The multiple projects made by Lesseps (who built the Suez Canal) and his failures. 2. The bulk of workforce was in big part by Jamaicans and people from Barbados, following the Chinese, Spanish, and then the people from USA. 3. The reversal started because in 1964, American students incited multiple troubles because of the disrespect they wanted to keep continuing with our flags, and people honestly was very tired of feeling like second-class citizens in our own territory. This ended with dead people, and eventually president Roosevelt had to lower the head. 4. The return of the Canal was, is, and will always be a cause that unites citizens, because it is not fair for another country to colonize and administer territory that isn’t theirs. This is why we as a nation understand and support people in Kosovo, Gaza, Western Sahara and every occupied territory. 5. After almost 25 years of Panamanian administration, we have demonstrated superior management skills, we serve the world and help the global commerce. Will the US keep this? I don’t think so 6. It is not compatible with international law to “retake” what is now a foreign asset for the US. It’s the same rethoric for Ukraine and Russia.

Will never happen. This is a small part of it though, and also why Panama is a big fan of what Trump has said. actually wrong. The Canal's value hasn't decreased. Yes there have been times where the Canal had to lower capacity but that's because our season cycle is rainy season and dry season. That was more than a year ago (mid 2023) and the Canal since then resumed full operations with its normal capacity.

All countries use the canal. trump has postured about tariffs and how he will make America great "again". the problem with his fodder is "tariffs", He knows the economic failure of his "tariffs" and the expense to American consumers, so he has to please his billionaire donors who ship goods, and the only way to offset the cost is by lowering the fees charged to transit. Plus, he has a vendetta against Panama, they shut his business down due to tax evasion and other criminal activities. China has no control over the canal. @ Trump is more than likely going to want to limit the influence of China, clean up corruption and force immigration enforcement on Panama. The transiting costs is the easiest piece of leverage he has. A deal will likely be made.

Maybe if the US wanted to maintain influence in Panama and the rest of Latin America it should learn "You catch more flies with honey than with vinegar." Don't threaten countries, or invade or overthrow the government. It'll cost you more full stop.

Last time I checked, if a situation occurs on American soil where one party gives something as a gift (by signing the papers), then later regrets it and demands it back 25 years afterward, the court would likely dismiss the claim as laughable. The same principle applies to Panama.

Hi Professor, on the subject of what a new Trump presidency may or may not mean for the world, I've been wondering what you think about the possibility of Trump's brashness (having already threatened tariffs even before his inauguration) directly or indirectly convincing Canada to join the EU, or at least to become closer, in the same way that Putin's actions caused Finland to join NATO? Obviously, they aren't geographically European, but neither is Cyprus in all technicality and Canada does seem to share European values more than even many current EU member states; in fact they're already a council member of the European Space Agency. Iceland also seems to be on the cusp of joining, which would make Canada seem all the less far away than it seems now.

The funny thing is that the new locks and all the expansions we Panamanians have done to the Panama Canal are way more expensive than the original cost of the Canal. In LATAM, we have a saying: "No te encariñes con lo que no es tuyo," which means "do not get attached to what is not yours." This is our land and we will defend it at all cost!

You can stand there and protest by closing a road like you did stupidly last year over the Mine that you were manipulated by your current President's scheme to oust the previous administration in this year's election until you get shot by another Expat who needs to travel down that road. This really did come ouy of the blue. Perhaps Elon doesnt like the new shipping fees, who knows. My understanding is the shipping industry is already considering alternativet to the canal. Critical fresh water shortages due to drought + environmental mismanagent are alrready impacting the canal significantly. There serms to be an idea a north passage may soon be viable due to climate change. Maybe they will stop buildimg panamax ships and build super ice-breaking ships instead. And more ships carrying time insensitive cargo will just go around the bottom. My ref is a yt vid fron the Megaprojects channel i watched recently 'Panama Canal Collapse?. Great video, James! In Malaysia, (for some reason), some people actually believe Trump is a no-war leader who won’t reinstate new wars. I was personally sceptical and Trump’s declaration on the Panama Canal was something I did not expect! It’s also mind-boggling how what used to be formal declarations and statements of territorial claim can now be done on social media, in a very casual manner. It’s just to show how international diplomatic etiquette has evolved. Thanks for the video, James!

An invasion makes no economic sense, the canal brings in $6bn since the cost of an invasion and occupation would be far higher and that is before potential blockages and boycots. It would therefore cost the US taxpayer significant amounts. It's far more likely that Trump is concerned about his litigation cases in Panama.

Read the agreement yourself instead of just offering your opinion. The US has the right to ensure complete neutrality in fees and use of the canal. Panama allowing China to control it will go very bad for them and any Chinese military vessels.

@@libertatemadvocatus1797 Exactly. The issue apart from the current issue of fees is that Panama has allowed China to take control of ports at either end giving them the ability to shut down the canal. This will have to be resolved.

Provide evidence that China "controls" it, a Hong Kong firm operates 2 out of five ports. The US has 70% of the ships that travel through each year and the Panamanians are spending big to ensure more capacity even when in drought. .

All countries use the canal. trump has postured about tariffs and how he will make America great "again". the problem with his fodder is "tariffs", He knows the economic failure of his "tariffs" and the expense to American consumers, so he has to please his billionaire donors who ship goods, and the only way to offset the cost is by lowering the fees charged to transit. Plus, he has a vendetta against Panama, they shut his business down due to tax evasion and other criminal activities. China has no control over the canal. Reality check: During his first administration, trump had every opportunity to enter into diplomatic and financial talks with Panama, but he was too busy golfing, and while he was sleeping on the job, China stepped end diplomatically, engaged in talks and financially arrangements, LEGALLY. China is investing in the South America, and as trump plays checkers, China is playing chess. Who's next on his list. the world will tire of this man soon, and America will suffer due to his ineptitude.

Are you kidding?????.......Trump and Putin have their own Brokeback Mountain thing going on......Hell, Trump has pretty much given Putin the good to go for invading certain NATO nations if he so wished. I figure some of the first things Trump will do once safely installed in the White House is kill off as much Ukrainian aid as possible, including intelligence feeds, allow Musk to cut the Ukrainian forces off from Starlink, remove all sanctions against Russia and release all the ceased Russian assets and fund being held in US banks. Trump has taken a long deep look into what Russia has done and likes what he sees. He wont complain one iota about Russia, instead he would love to try and emulate them.

not really. the Russian federation never had Ukraine. the ussr did which is a completely different government/country. the USA did have the Panama canal for a while, on top of the fact that we literally built it.

The canal is idefensible, you know what I mean, explained the panamanian General Torrijos to Jimmy Carter, "the best approach is respet to our territorial integrity, mutual cooperation, and neutrality" the entire world has an interest in keep the canal running efficiently and in peace, not just the US. Trump is incapable to understand that.
