I still am uncomfortable with what happened to RA and his conviction. I grapple with how can this be when there is so much reasonable doubt? How? As for the ISP commentator, he behaves like a puffed up man. I have always been suspicious of him, and all of the changes he perpetrated, and the interrogators of RA. It is not true justice. Injustice prevailed in this case for sure. It doesn’t mean I don’t care about L and A deaths, or the family’s grief. I too am a Mom of daughters. I too have experienced a lot of grief in my lifetime, however, truth did not win here. It simply did not.

That's exactly right. Why is it that if we believe in the innocence of RA it somehow means we do not respect the family. That is completely wrong. Of course, we feel for the family and don't want to cause them any more pain. We may not have a lot of respect for the judicial process in this case but that isn't the family's fault.

From the evidence I heard reported from the trial, the state did not prove that Richard Allen was “bridge guy” or that “bridge guy” was the perpetrator that the voice heard in the audio was bridge guy or who it was at all. The states theory and timeline just does not add up to me. I don’t know if Richard Allen is innocent, but I don’t feel the evidence presented in trial was beyond a reasonable doubt he was guilty.

Curious as to WHY Holeman was in the courtroom for a prolonged period of time. He wasn’t a bailiff, not an attorney and seems somehow inappropriate he would have been sitting next to/near the defendant? Witnesses don’t normally “hang out” up front… so what is “special” in this “case”. There is A reason and probably numerous, that cameras and largely, public, were excluded from what seems more and more like the Star Chamber, NOT Constitutional American jurisprudence.
@pseudio3141
@pseudio3141 13 күн бұрын
In trials I have watched my observation has been that it is common for the lead investigator to be sitting at the prosecution table or the first rows of seats behind the prosecution table with other members of the prosecution's team, basically working alongside them throughout the entire trial. Go back and look at some old trials and if the cameras show the prosecution table and/or the prosecution team in the first few rows of seats behind the prosecution table, you will probably spot them. They might be wearing suits instead of uniform but they're there, part of the prosecution team. For example, you can see Esteban Flores sitting at the prosecution table throughout the Jodi Arias trial. This always seemed a bit odd to me because the lead investigator obviously pretty much always testifies in the trial, and they are an important witness for the prosecution because they relay to the jury most of what was done in the investigation (since they were the person who did most of the investigation or made decisions about what to do, etc). Also the jury tend to believe that they are credible. But the lead investigator gets to listen to both the prosecution and defence opening statements as well as any other witnesses who testify before they give their own testimony. That means they can tailor their testimony to what the lawyers and other witnesses have said when they take the stand. I've seen trials where the investigators get up and testify multiple times, sometimes just to answer a few questions to rebut something the defence has brought up during the cross examination of a different witness whose testimony the investigator watched and listened to because they were there in the courtroom at the prosecution table (for example, I think this happened during the Chandler Halderson trial). This does not necessarily make a trial unfair but it does seem like it gives the prosecution a unique advantage that the defence doesn't have. For example, purely hypothetically, during their opening statement the defence attorney might make an argument about some piece of evidence not being reliable because the jury will see police reports and none of the reports will contain any information that shows that the police used some specific procedures for gathering the evidence that must be done to avoid contaminating that evidence. Well, when the lead investigator gets on the stand, the prosecution might ask them questions about how they gathered that evidence and they might testify that it was gathered using those correct procedures to prevent contamination. The prosecutor might ask if they would normally document those procedures in a police report and the lead investigator might testify that no, that kind of procedure would normally never be specifically noted down in police reports, but they know how the evidence was gathered and the correct procedures were all followed. In this hypothetical, it is possible the lead investigator is lying because they know the jury will believe their account of what happened unless there is fairly direct proof to contradict their testimony. It is also possible in this hypothetical that the defence were simply making a mountain out of a molehill in their opening statements, the police gathering evidence did indeed follow all evidence gathering procedures correctly, and the procedures in question just really aren't typically documented in police reports, aka it is possible the lead investigator is testifying truthfully. But having the investigators sitting and working with the prosecution team, watching the entire trial before they testify, means the prosecution will get the slight advantage of being able to do that sort of thing to plug any holes that the defence have tried to poke in their case. That advantage could be used honestly or that advantage could be abused by a prosecutor and/or investigator who were willing to be dishonest in order to win a case. But it is a slight advantage. I don't know for sure that it is normal or legally permissible in every single state, but I think it ism I assume investigators don't attend every single trial, as they must have other commitments or cases. But I don't know of anywhere that doesn't allow them to attend trials as part of the prosecution team if they choose to. I can actually only think of one trial that I have watched where I was consciously aware that the lead investigator WASN'T sitting and working with the prosecution (there might be others where they haven't been there, but it isn't something I normally pay much attention to). And that was the Karen Read trial. And I am pretty sure the lead investigator would have been legally allowed to sit with the prosecution throughout the Karen Read trial if he had wanted to. I think it was a tactical decision by the prosecutors not to have him sitting with them throughout simply because they didn't want the jury to see disgraced lead investigator Trooper Proctor as a big part of the prosecution case or team.

When you are not guilty, you really don't think twice about voluntarily talking to the police. This case shows how incorrect that assumption can be. The life lesson to take away from this case it to NEVER talk to the police without an attorney present. EVER. Rick Allen told the police he was there and even offered to meet them in town at the grocery store he was on his way to in order to expedite things and make life easier on everybody. I bet he's regretting that.

The investigors need investigated. State actors, the judge, prison employees, and third parties need investigated. Those that lied under oath should be prosecuted. The office of the prosecution intentionally sending this defense team extremely disorganized evidence to cause difficulty and delay is sabotage and clearly shows their lack of confidence in a very weak case and their fear of very competent defense counsel questioning their narrative. All the secrecy of the investigation and trial would not have been necessary if LE and the state were acting ethically, and if the investigation could stand on its own merits. It couldn't, they didn't. These attorneys have been mistreated, threatened, played with, and abused for defending a man they believe is actually innocent, who was abused and isolated to the point of psychosis in order for the prosecution to obtain confessions from him that they couldn't otherwise obtain. If you can't properly investigate a case and prosecute it legitimately without abuse and suppression, don't prosecute.

I think it’s easy for the public to put their trust and faith in the prosecution. It’s easy for the victims families at a time of complete vulnerability to fall in line with the state and follow them blindly. Look, the families have no one else to trust. They have no choice. There’s not one person on this earth that’s going to try and drop evidence that the state is not feeding them on their front door step. No one is going to say, “hey, do you think things are really as they seem here”. Then you have an entire community that wants to protect the victims. For the public and everyone else, it’s so easy to just take the trial at face value and not have to question why rulings in the trial disabled the defense from presenting evidence that would have saved their client. It’s easy to believe the state knew they had/have the right guy. People don’t want to believe that the state makes mistakes. In this case, if you read between the lines and you are willing to dissect the evidence that was restricted from the trial, there is SO much overwhelming evidence that eliminates RA from the murders. Headphones plugging into and out of the cell phone at various times…. That’s just one piece of evidence that the defense was able to present because it was in the prosecutions report at trial. Anything and I mean anything that was brought up in trial by the defense was evidence dissected from the prosecutions reports. If the prosecution did not submit a piece of evidence into the trial, it wasn’t allowed. The defense had a ton of evidence that the judge said, nope, not having it. That’s not right. That’s not a balanced and fair trial. Everyone needs to take a giant step back and say to themselves ok, let’s start there. Let’s analyze the franks doc and read the state’s and FBI’s evidence and expert analysis that was in the initial investigation (wasn’t allowed in court). Once a person analyzes and evaluates that and all of that evidence that’s floating around on Reddit, you realize that the system done everything in their power to disable not only the trial but the entire investigation. It’s hard to digest. It’s rough but it’s clear the state had their own objective and it wasn’t and it’s not to solve this crime. I want justice for Abby and Libby and this is not it. I don’t want to see this crime on replay, ever. This was not a crime of convenience. Period. No way. Here’s something else I want to add… there are occult, extremist groups all over the United States. You don’t have to believe that but I’m putting a link of a map of them below. Go ahead and type Indiana in the map search bar. Carroll County is on there. There are independent organizations out there that do nothing but dedicate their time and work to get these individuals arrested and prosecuted. Why? Because our gov can’t handle the responsibility, pressure, backlash, and authority associated with bringing a group of extremist individuals to justice. The groups have nothing to lose and they will use violence to protect their “religion” as Holeman so well calls and defends it. Copy and paste that link below for a map. Educate yourself. www.splcenter.org/hate-map

The facade will be dismantled, truth will come out & hopefully there will be a safer, more secure Delphi when the focus is finally on the real perpetrators. I was so sad when I read the transcripts of the interview with the 1st juror. These attorneys proved time and time again, LE outright lied on the stand. There is no such thing as a small lie, period.

Please keep speaking Defense team. This could have been any American! Any American could have been a patsy for the ISP and Delphi PD. This case needs solved...not just for Abby and Libby...which is reason enough....but also for Richard Allen...and for every single American. This is NOT how we do justice in Indiana. From no safe keeping hearing. To housing RA in solitary for nearly two years. To all the secrecy. To this Judge not allowing a third party defense. This entire thing is a SHAM and so unethical.

Go into a place like a Super Walmart (located in a ‘not so great’ area of the city that you live in) around 6pm on a Saturday & spend a good hour people watching. Then, just imagine that 12 people from those whom you observed would be selected to hold your life in their hands. The concept of being judged by a jury of your peers - unfortunately, this has fallen apart over the last few decades (…in my opinion). The ratio of people that exist in your specific county that could/would truly qualify as your peers vs. those that don’t have a clue what’s really going on all around them - it’s too scary to acknowledge.

So, when I’m made aware of a case in any U.S. state where it’s believed that a U.S. citizen’s rights have been/are being violated (in the many manners this can take place & from police officers to jail employees to the DOC - then the judge & the prosecution team) I dig deep. There’s a big issue w/the lack of judicial oversight in our country, which just adds insult to injury. I’m so glad that today, more than ever, there are cameras in the courtrooms & interested Americans can see w/their own eyes how bad much of this can be.

I think it’s very important work these defense lawyers are doing by coming out and having real interviews about this case. Rarely do we hear the other side of these cases. LE and prosecutors are in the media all the time and I admit, I used to be one of those people who trusted what the prosecution and LE said. I now know, thanks to defense lawyer podcasts, KZbin videos and interviews with defense lawyers as real people talking about their experiences, that there are always two sides and people need to remember that we are presumed innocent until proven guilty no matter what the media or one side says. So thank you for this and I hope you keep speaking out. I will do my part and share this everywhere I can.
