Any officer that falsely arrests someone should have to do the max sentence for the falsely accused crime. Officers are only liable if the arrest was complete unwarranted , any good officer would be more worried about the constitutionality of their actions than just getting to rough anyone they want up under the context of justice. They can choose to not make questionable arrests, instead we see them arresting anyone they want, often for imaginary reasons. It needs instant consequences to stop it.

A similar situation happened with a lady at Los Angeles International Airport a few years ago when she was trying to board an international flight. She was arrested and held without bond for 14 days. Only when the LAPD realized that this was a clear case of mistaken identity was she released. She lost her job, eventually lost her good name, and she too filed a lawsuit against multiple law enforcement agencies.

Why would the Coward County Sheriff and deputies care about getting the right person? As you can see not one of them were held accountable. The person they were looking for was 23 years younger and 1/2 foot shorter. It's impossible to think it's the same person unless you just don't care because you know you won't be held accountable. This is the same department that let children die in a school while the deputy stood outside like a coward.

Sympathy for the family isn't enough. Arrests should require thorough investigation before slapping on the handcuffs! Birth date, height, hair color, fingerprints, etc. will result in a positive identification. If it took you three days to complete those verifications, you are incompetent and should be held accountable! Perhaps it's time to raise the education and common sense levels required to be a Law Enforcement Officer!

No Broward county is definitely responsible. Anyone can issue a warrant. It is up to the arresting dept. to properly identify the person they are arresting. Comparing physical characteristics, socials, DOBs. If that isn't done in the first hour they have failed to identify and are guilty arresting the wrong person.

Remember these cops are a great dead responsible for the 2017 Parkland High massacre, namely: Ignoring the perp's daily death threats against about 3 fellow students for months before the massacre. Being called out to the perp's home 45 times for domestic violence he took part in, and yet never arresting him. His threats to massacre people at his school were repeatedly reported to law enforcement and then ignored by the local police. The school resource officer, Scot Peterson, refused to enter the building where the perp was doing his evil. Oh, this is quite normal for Broward County law enforcement to be so incompetent and callous. Yet we have seen other instances where the police have bravely stormed into danger, like at Covenant School in Tennessee, 2023.

For my state license to do business I'm required to have 300 hours of class, 3000 hours of apprenticeship experience for a minimum of 2 years plus a college degree and pass a criminal background check. I could have become a captain had I known the requirements for police were so low.

Broward County Sheriff’s Office doesn’t care. They don’t pay anything. It costs them nothing. The taxpayers pay for the incompetence of BCSO. The taxpayers pay all the expenses of the leviathan police bureaucracy, all salaries, all equipment, all vehicles, all fuel, then must also pay the lawsuits that are generated, because there’s zero incentive for BCSO to carefully check before arresting an innocent person, and you can be sure there was not the first reprimand or discipline for the deputies. It’s way past time to reform policing in America and abolish qualified immunity and force LEO to carry liability insurance just like every other business. Then they will be more careful when their salaries get affected by rising liability rates due to their incompetence.

The Court ruled that police departments can reject intelligent applicants in favor of low IQ applicants. It’s like a doctor getting a referral for cancer and just treating you for cancer without verifying that you really do have cancer. This is a lame excuse and it will not fly in court in this lawsuit. You didn’t notice she was 6 inches taller? You didn’t notice that all of her identification was in a different name? Stripping a citizen of their freedom is not a minor issue. Especially when there were verifiable facts that did not match up with the description and personal details of the real suspect. The arresting officers had a duty to verify the veracity of the warrant and to make sure that they had the correct person prior to arresting her. Jumping the gun and not verifying information....there's a term for this called incompetence.
