I don't think this is an actual, legal court. I'm pretty sure this is just bonded arbitration like Judge Judy. It's faster and cheaper than going to actual small claims court, the money is real and the decisions are permanent but because it's basically just mediation for a contract and not a decision by an actual judge or jury you don't get to appeal.

Everyone misses the reality of this case. Nail guns have a safety on them they can be illegally taken off, which makes him liable, they can be discharged when the safety is pressed into a board, which if done correctly will result in no injury of this type. If the nail went thru the board, the compressor was set to high in psi for the gun, which makes the contractor 100% liable. So either, the safety was removed and the trigger was pulled pointing at the woman, which is attempted murder, the nail gun was placed on her face and trigger pulled which is attempted murder or the psi was set too high causing the nail to go thru the board and striking the woman so hard that it penetrator her skull more than 2 inches deep, this would be negligence, but also excessive negligence bc for that to happen, thru the board and her skull, the gun would have to be set 2 to 3 times higher than manufacturer standards, which is gross negligence. Nothing she did eliminates this

Same for me. As an engineer I am required to have all my PPE’s with me, always be guided on site and need to have a certificate of safety training with me that’s at most one year old. And that’s just to walk around. Anything missing and I’m liable. I was expecting her to get nothing as she went on the site unsupervised.

It’s actually a good judge, a bad one would have sided with her. She knew HER house was under construction, SHE knew what time she was supposed to arrive, SHE walked in by herself to her house with no protection or self awareness to her surroundings. She’s to blame more than him

Even if it’s her home getting built or renovated it’s still a construction site here in Australia you’ll need your white card be inducted onto the specific site and be wearing all your PPE.

This is why in the UK you legally need to have signage up at any entrance to the site saying that full PPE is required and visitors must be supervised. The real issue here is lack of and/or outdated safety laws because the US is the biggest bureaucracy on the planet.

How will you know that you need to be guided in a construction zone, if you are late. For me its 100% her fault for being late and for going into the construction zone without someone that is actually working there and knows how everything is moving around. She just does not have common sense 🤦🏻♂️

How in the hell did she get nailed by the nail gun? If you suspend a nail gun in the air and pull the trigger, it will not shoot a nail. A nail gun needs to be pressed against an object to engage the trigger and it takes a lot of pressure to do so

@Babychiefsosa I guess that's a fair reason, BUT she did need guidance, and more importantly safety gear, as it is an active construction sight, either you bring your own or you don't go in, regardless of it's your house or not.
