That most likely is where this was headed, and to insure the plantiff would get paid, she obviously opted for this, since the state always gets their fines first.

Because the cross eyed guy and his girlfriend gave the phones to the defendant and said they were a gift. The cross eyed guy is the thief. The defendant sounds like she just wanted the phones gone and made a bad decision.

Yup! They were stolen items that they sold. Doesn't matter that they didn't directly steal them. They knew they were stolen. And even if they didnt know they were stolen, it's still receiving stolen property and is still a charge depending on the total worth of the stolen property. In this case, it would be a felony but likely plead down to a misdemeanor.

Because the witness and his ex-girlfriend Montana were getting tired of Brandy (plaintiff) constantly texting them telling them to bring back her phones after they went to the defendant's house to stay. So witness and ex gave the phones to both of the defendants because they didn't want to deal with Brandy anymore. The defendants felt that Brandy had given it to them as gifts so they were literally given gifts of these two phones which they turned around and immediately sold. Apparently the phones were not gifts but were tied to an agreement between witness and his ex while living with Brandy. So Brandy found out the defendants had her phones and wanted her phone's back or the cash equivalent to the point the defendants felt harassed and filed a countersuit for harassment.

So many questions: 1. I dont understand why the Plaintiff and the Defendants aren't more annoyed with Edward (the witness)? He caused the whole mess. 2. Why is the Plaintiff buying two brand new phones and going on a payment plan for a guy and his girlfriend? 3. What was this "roomate agreement " Edward mentioned that JJ didn't want to hear about? Was it payment to the Defendants for letting him stay there, or did he not realize that the plaintiff was only letting him use the phones while he lived in her house? 4. Why not just give back the phones and stay out of the drama Edward seems to have created? Instead they took his word they were gifts despite the plaintiff immediately asking for the phones back, and went through being "stalked and harassed" for less than $300?

yeah this edward dude is really annoying and a menace. like he'll let go of the phones anyway, so instead of 'gifting' to the defendants, why not just return to the rightful owner? he caused all this chaos. People like this are agents of chaos and leave a trail of destruction. The defendants are opportunistic scammers, they didn't want to return the phones because they want to make money out of it and use the excuse that they were 'gifts' to force justify their unscrupulous deeds.
