I am a surveyor in Pennsylvania and I have a customer right now that is being shafted by the local government because he happens to have land next to the mayor. The mayor's pool happens to be across the setback lines and is technically illegal. It's a tough one, fight city hall and risk future business thus making my life hell or roll over.

First get a soil scientist to prove we’re that sits isn’t wetlands. He can drill one inch cores and prove how long water hasn’t been there! The city and county planners are terrible and I have gone to court with them many times and not lost. The worst is they wanted me to fix the city water main because it wouldn’t sustain my 26 parcel subdivision and the city .. lol

A man in my town is sueing the city Mayor personally for getting his building condemned, while sooo many others in town much worse still stand. He never even personally looked at it on record. He sent an assistant.

Go to the USDA office...get a farm number and put that building up! You can do alot with a farm number...in the name of agriculture...looks like to me you have "hay land" my brotha!

Be careful playing any govt games. They don't play fair and will change the rules so you lose, every time. Big push against domestic farming so everything can be outsourced.

Or maybe incorporate solar panel plans on top the new, original garage you wanted. See if that will pass for obtaining a permit.. You can also earn subsidies for the panels.

So you can build within a 100’ of a river and not be in a wetland but 5” from an existing building is wetland. Seems to make perfect sense. Lawmakers are clueless.

@@Bruce23d thats just following a law based on some map of land survey. The problem here is inflexibilty rather than them being idiots. If they would take things case by case and not just follow arbitrary map, all could be sorted while protecting the environment.

You are so right on. I was a septic engineer in CA for 30+ years, and the environmental rules we had to contend with were overwhelming. I had a situation like yours, and we had to bring out the Army Corp of Engineers staff. They took one look at it, laughed, and told the Planning Dept to get trained in how a wetland is defined. Put them in their place!

Sounds about right, my old crew was contracted years ago to do some work over the border there. For the job We had to go around a wet in winter "marsh" cost the company another 20k, and then a year later someone paved it over with a parking lot. Was always shocked when we did any work in California.

Army corp will cover the federal wetland regulation, but the state and local regulations can define a wetland differently. I would assume based on the video it’s the local wetland regulations that he’s having trouble with, but who knows.

Since your property is designated in a watershed area, I'm assuming it is a "Protected Watershed" since your building permit was not approved. I'm a licensed civil engineer and I specialize in land development and stormwater permitting in NC. It may be helpful for you to check your local and state regs to see if there is an avenue for you that if you were to provide some type of engineered stormwater treatment (BMP/SCM) that you could increase the impervious area on your property. Also check to see if there is a impervious percentage threshold that you could use in your favor. I deal with these obstacles on a daily basis in NC, there is always something we have to mitigate and work around in order for buildings and sites to be constructed.

Even Kamala Harris took a right-wing pro-business stance as AG of California when she refused to prosecute West One Bank and its CEO, Steve Mnuchin for the huge amount foreclosure fraud they committed. Have there been any sweeping leftist changes to our country since Sleepy Joe was elected? No. Both parties are all part of a big corrupt club, and you and I ain't in it. Well said, Stephen Dodson, I worked in the engineering dept, of a Fed. subcontractor for 38 years. We had rules to follow, not politics. Yes, look for a work around. What people don't understand is that the professional engineers signing off on a project have to protect their own license and reputation. This is their livelihood and their families wellbeing. Don't blame engineering departments for the follies of lawyers and politicians. And, some of those despised environmental laws are really for everyone's good.

I remodeled a house in austin in 2008. I was adding a second and third floor inside of a really tall space. I kept having arguments with the city because they were claiming I was violating the height limit of the McMansion ordinance. I would explain that i was only altering the inside of the building and not making it any taller. I would have to have this same debate with them with every interaction and step in the process. The plumbing inspector failed the plumbing rough of the master bath which was plumbed just like a commercial multi sink setup. Plumber tore it all out and did it how he wanted it. After I passed my plumbing inspection, the city changed the inspectors territories. The new inspector claimed the old inspector didn't update the system that I had passed, and subsequently failed the passed work from the previous inspector. he made my plumber redo the master bath so it was like it was the first time. It was such a nightmare dealing with the city code and zoning departments that I swore i would never do it again. So, I bought 40 acres in liberty hill which is 35 min outside of austin. No building department or building permits. I only need a septic permit from the county to build out there. I hope it stays that way.

If you know anything about land or homes you'll know you never own your land outright. Also every home/ parcel had public debt tied to it. Which is why you are taxed for it. Your deed is not a right to your land but more of a permission slip that you may use it how THEY seem fit.

A neighbor discovered that the building they wanted to build, where they already lived, would not be permitted had a grandfather clause that would permit it. Local government sees permits as a money making scheme.

I've lived in Kentucky my whole life, I don't understand. My grass can be 5 feet tall if I want, I can build or park anything I want on my land without telling anyone, I can do the electric and plumbing, I built a pond a few years ago and I didn't have to ask for permission. Me and the people in my town just wouldn't be able to handle those types of rules. There wouldn't be any way to enforce them because people down here do what they want. We always have. Businesses hang those mask signs up but I haven't worn a mask since the pandemic and nobody has told me to wear one. I would say 90% of our law enforcement hasn't worn a mask this entire pandemic, theirs no one to enforce their silly rules.

@@Robmancan1987 same for us in SW Virginia. I built a second small cabin on our property and did the electrical myself. The inspector could not have been a better guy. He found a couple of small things outside of code and showed me exactly what I needed to do to fix it. He then asked how long it would take. I told him it would be done by the end of the day and he said great, I’ll run by tomorrow and slap a sticker on there. I understand the need for code enforcement but it doesn’t need to be the cash grab that it is in a lot of places.

@@danieljones7096 My electric inspector came and we talked about deer hunting.🤣 He said I could call him with questions about how certain things needed to be ran, so I did. I already talked to him about 20 times before he ever showed up. He walked me through a lot of things.

Random thought for the smaller house, make at least one entry door wheelchair accessible. One shower too. And make the interior doors a little wider. Injuries happen. So does old age. Never realized how much I would hate stairs later in life. The home I bought when I moved out of Occupied-California is all one level, and has the items listed above. And by the way, I left Occupied-California for the same reasons you're alluding to in this video. I believe the objective is to tax and regulate everybody out of rural areas and into town, with the ultimate objective being no more internal combustion engines....among other things. This is the reason for foods grown in petri dishes too.

Cody, considering the OG workshop was obviously planned to be added onto, is there a chance the original permit accommodated the additional length, or possible it was permitted for 40 x 80 (or whatever) and they built it short for some reason. I.E....does some documentation exist that shows it is ALREADY approved or permitted that will help you?

Permits are usually only good for a year where I live. If you haven't built it in a year, then you have to reapply. Probably that way where Cody is also, as I am not that far from him.

Had the same problem, town refused the permit, I pulled all building records on our property including permits, found the original prints for our house, guess what, I built the house to the original prints because they were already approved by the town, they were pissed !!!

Yep. There are sad reasons of this. With out regulations you get dangerous shoddy construction. Watch when ever a third world country has natural disaster. How many die with out being regulated. Unfortunately many people and companies would cut tons of corners to save money

I couldn't agree more. My Dad and I have been trying to rebuild a house that burned down in August 2015 but our local Dept. of Environmental Heath and Planning Dept. has fought us every step of the way. The septic system they are asking for is going to cost north of 100k and will be tantamount to a mini-water treatment plant (pressurized system with pumps and multiple pods). Every time our septic engineering submits the plans for approval they reject them with a handful of requested changes. The engineer makes the changes, resubmits, and the same thing happens again and again and again. Plus since 2020 they scapegoat the pandemic to justify taking 6 months+ to review anything. That's the Peoples Republic of California for you.

My wife’s grandfather in almost Canada MN had a part of one of his fields declared a wetland. The DNR said that their satellite imagery system had detected a body of water in the field. It was a pile of rocks… combine that kind of thing with basically every roadside ditch being declared “waters of the United States” and you start to wonder how land is even still worth anything.

I lived in Nebraska for 30+ years and although the two biggest cities, Omaha and Lincoln, had less than 5% of the land in the state they had 90+% of the people so they told the rest of the state how they were going to live. Something not right with that process since they have no clue how to live where you can't just run down the street to the mega supermarket and get anything you want at any time of the day or night, but set the rules like you can.

Just a heads up folks! When local laws seem to be too much, do what I do and get involved on boards/commissions so you can make a difference. Think about it, Government consists of people like you and me that can change local bylaws - it's tougher changing state laws but not impossible - we do it all the time. Get involved and make a difference, complaining is always easy, trying to change laws is very rewarding.

It is as if these people are incapable of creation - - only inversion, perversion and destruction - - and assume we are like they are . Imagine if people were allowed to build what they want ? Sure you would have idiots building death traps once in a blue moon but Darwin (the Lord actually heh) would take care of those , and we would have some absolutely unique and super interesting builds .An explosion of creativity , new technologies and progress . REAL progress not this progressive progress which is just more inversion / perversion . This world has the potential to be even more incredible by orders of magnitude and I think one day we may seen the beginnings of that . It could be so great !

One positive thing to come out of all this tyranny and nonsense is the fact that the evil made me feel God for the first time . . Kind of hard to explain but somehow I just felt it , and knew it was truth one day out of nowhere . I bet there are alot of people in similar situations to myself out there also . You can just look through these evil people and see clear as day a God-sized hole missing inside of them that they are desperately trying to fill with nonsense . Way I see it - all you really have to do is live by the Golden Rule - work on yourself before daring to claim you have the answers for anyone else especially entire nations or worlds , and if most folks did simply that imagine how great things would be overnight . Bless you . God is great and I am so grateful to know him even as little as I do .

It took me three and a half years dealing with smug bureaucrats in the health department and building department to get a new home and septic system built right next to my old house. Why did I build a new house when my old one just needed to be added onto? They wouldn’t let me add on unless I went up, not out. I didn’t want a two story house.

I had my challenges with City codes as well, Per code I could only build a "6 foot" fence. I asked if that was measured from the ground and they (probably confused) agreed. I built a nice 10" berm and constructed the fence on that, never had any issue. Honestly, (not knowing what plan C is) I really like plan B. It will provide you the perfect opportunity for a home custom to your needs.

In the UK build height is always taken from the highest point of the ground either side of the fence line and if its on a berm start from its top too like you did !

@@danskdna8550 I live in a typical neighborhood here in Portland, Oregon (5,000 SF lots). When you want to do something like cutting a tree down, building a cover over a patio, installing a patio, retaining wall, roofing, siding, etc...you have to submit to the city a "plan" and then the surrounding neighbors get copies of your plan, and then they have a 30 day window to decide whether they're ok with it or have concerns. So for those 30 days, I have to sit around and wait and hope that none of the neighbors stop me from improving my own property. It only takes one- and then the whole process has to start over again, with me modifying my plan so that all my neighbors are happy. This is nothing more than grooming the population for the concept of _no more private property_ because even on your own land, you're forced to bring in other opinions that otherwise have nothing to do with it. Do my neighbors pay my taxes? Nope. We really are slowly becoming a Communist country. Its not hard to see their attempts.

When we went to the county court house to pull a permit here in the hills of TN their response was, “You don’t need no permit… Heck just build it!” Sadly they implemented a building permit required for new homes last year, but any farm buildings are permit free for the time being.

Same here in rural Missouri. Rural for me meaning 40 miles from KC. I built my house 2 years ago and the only permit needed was one for the septic tank.

Heck I don't even play Airsoft and bought a gorgeous fully automatic gas blowback full metal AR-15 just to hang on my wall . Since I am not allowed to own the real real where I am . ;) Great way to stay in shape plus learn some maintenance and orienteering skills if you play outdoors .

I found this out a couple of years ago when I bought 2 acres. Best example the code inspector said I need a septic system plan before I can build anything, so I asked him him what kind of septic system my neighbor had for 200 head of cattle 200 yards from me? I just don’t get where anybody can tell what I can or can’t put on MY land.

It's more diabolical than that, Cody. I am getting several calls a day from companies trying to buy my home. The idea is that there will be no more ownership at all and that large companies, on the behest of the government, will be in control of rentals. Very concerning.

I am for wetlands, but the way it is handled in most states is crazy. Sounds like they have designated most of the property as a flood plain. Could become an insurance issue.

As a GC I dealt with these issues for a few years now. I turned a Mueller steel building into a guest home once here Los Alamos NM. It was hell to get the county happy but with a good engineer on your side that stamp they use means everything. Don’t Matter what they say if engineer says otherwise. I’m lucky enough to have one in my company now. Makes life easier when needing plans.

I do understand all those codes here in Germany. We're so crowed, it would be a nightmare if everybody could built what and how he wanted. But in your place? WTF? Who the hell could be disturbed by your shop? The river bank: I know, it is nice to build there, but when I think of the people at the river Ahr in Germany, you better stay away a reasonable amount.

1 Wants to add on to his shop that was designed to have an addition at some point. 2 Told he can't because the farming fields that have been fields for 100 years are actually wetlands, because they are sometimes flood irrigated with water from a river. 3 Build 5 new houses on a separate lot on what is probably wet lands.

I feel for you! My story: I own property in Virginia. To use my property I must pay $500 per lot, I own 12. The county only allows me to use my property 6 months a year, however I must pay full year taxes. Sounds fair to them. Still fighting.

An unregulated board or no board at all is just as dangerous. Imagine if say Walmart wanted to buy all the land around your property to build a warehouse to store or recycle old electronics or something. Would you like that? You can’t fight them in court because they could just bury you in legal fees. People or corporations with the money have the power. Local, state and federal laws have not been fair to the average joe, but that doesn’t mean throw the baby out with the bath water.

The limiting factor on most of these kinds of things is that someone already owns the property and you have to convince them to sell, which they typically wont do if you're just planning to bulldoze their property into a parking lot.

Although I am only an amateur homeowner with one year of actual experience, it looked to me as if the weeds or grass gave away the approximate location of the tank. In the video it looked as if there was a rectangle of short grass right where you marked the corners after confirming the depth of soil. Am I wrong?

Here’s an idea for your project when you build the unheated building (on your other lot)… put in hookups for RV’s (power, water, & sewer) That way you can use it for both storage and possible living year round living if desired… gives you more options for the future.

In Minnesota lakes are very prevalent and seems like every year the government either state county or local comes up with new ways you can't enjoy your lakefront property. A lot of it is nonsensical and from my perspective is small groups of people flexing their control over large groups of people.

Yeah they do the same thing with all of their wildlife resources in Minnesota, to an overwhelming degree. We have a family farm in the middle of the state. It’s about 150 acres of hilly farmland with a beautiful valley that has a river running along the bottom. This land has been in our family for over 100 years. For the last half of that the farm has essentially become a gathering place for yearly family reunions and hunting/ fishing trips. Just enjoying the land and small taste of freedom we get from our everyday lives. It’s neat how our family set it up. My grandma had a family with 8 siblings and she was the youngest. She moved to Oklahoma years ago but the majority of her siblings still live in surrounding areas so they were always able to take care of the farm for everyone. That meant basic farm work like brush hogging and just maintaining the property. Well about ten years ago everyone had decided they wanted to turn the land into like a trust or something where the whole family owns it. Not going to pretend I’m versed on what exactly was required here but the intention was just making sure nobody in the family would be able to sell off the land for a quick payout. Well when the family went to local government offices to file paperwork on this what ended up happening was the state basically telling us that they would be “protecting” the natural wildlife in the area and recognizing the farm as essentially protected. This meant it was now illegal and not permitted for us to use the river on our land to go trout fishing or deer hunting, things that happened maybe a handful of times all year. There were lots of siblings in my grandmas family but most of them are either passed on or without children. The brother who mainly kept up with the farm was the only one aside from my grandmother who had family that hunt or fished. So for causing this inconvenience the state said we could get like $10-$15k per year for taking those rights away. Oh yeah and they also made us plant shitloads of corn to just uhhh grow? I guess lol Anyway sorry for the essay but thought it would add to this. It’s just wrong to tell someone what they are and are not allowed to do with their privately owned land.

Looked at a house in an HOA. Realtor looked at me like I was a Martian when I said I needed to read the bylaws, agreements, covenants, etc. before I would consider making an offer. So I dealt with the part that driveways had to be black. And that they had to review your choice of style and color of your front door. But I couldn't accept that you were not allowed to grow a single vegetable anywhere in your yard, while there were berry bushes and fruit trees all over. Questioned the HOA secretary who claimed nobody minded if you had a big flower pot for a tomato plant, but surely no one would like looking at corn. The thing was adjoining yards had really crappy, beat up, falling apart and plastic yard toys many looked to be permanent fixtures that were ok. Decided it wasn't the place for me.

Crazy that you have to have a permit to build a shop in the county. Here in Texas the only thing that requires a permit outside of the limits of an incorporated city is an On-site sewer facility.

I know how you feel, it seems like every year there is more and more red tape. Just a heads up, looks like the tile (weeping) bed may be plugged on that septic system. Normally I think you should see the bottom of the outlet pipe. Looks like the outlet pipe is completely full of water and maybe not draining properly.

Here where I live in Western Canada it can be a real pain in the a** to deal with building/construction. All about following the dollar signs, before you can even get started you have to have your project approved by indigenous (native) people they want their cut. Now its the engineers and geotechs they want their cut, by now you need a hemorrhoid cushion to sit on, the district will start screwing you for every last cent. In my opinion I think you're "status" hurts you, you're not Joe blow off the street anymore you have "world wide" presence. The district/county wants to make an example of you, they are seeing dollar signs. I hope plan B goes better for ya, I agree with you about property/house prices its absolutely insane right now.

You need to learn how to sue as a pro se. I have some friends who renovate houses. They are suing some officials in a city in my state for entering property without a warrant. Several cities already have stepped aside and let them build without issues because of the City tramples their God given rights as outlined in the state constitution, they hold the officials accountable. They are really enjoying the suit they are in right now because they've got the officials there in a bind for all kinds of misteps. They know how to file writs, and they use them. If more people knew how to do that, the officials would be afraid if us instead of us being afraid of them. BTW, I sued my governor as a pro se over the lockdowns. She didn't do it again.

I flip houses on a regular basis and I’ve noticed when it comes to permits no matter where you are you’re better off building whatever you want to build and asking for forgiveness on the missing permit as they’re more likely to just issue it with the structure already built! I’ve never had an already built structure be denied for a permit but they will deny if the structure isn’t there already, cause they just want money.

Could be worse, in NZ you have to submit a colour pallet of the colours you want to paint your house in for approval when doing a new build. In the city apartments you have to submit a floor plan with furniture layout, one application was denied as the lounge sofa did not have a good view of the TV. They also dictate what plants you can plant round your house. Everywhere is going full phone owners association at the government level.

And honestly I don’t know what the solution is but i don’t think adding or increasing taxes is the solution. If stealing is immoral, which it is, then any kind of taxation is immoral. Therefore I am against taxation. At the end of the day I think there needs to be an overall raise in the collective consciousness. Also people need to understand that right and wrong can be understood, and choosing right over wrong will help increase the overall freedom for everyone.

I think you would like living in rural Alaska. I lived in Ketchikan for a few years and there is no such thing as building permits or codes. Its painfully obvious if you inspect older homes. I had to remove drywall to locate a junction box and found the wires just taped together. My dads first house when he first moved up there was built by a fisherman and the floor from one corner to the opposite corner had about an 8 inch drop. The second house was slowly sliding down the solid rock it was built on making the middle level useless, it had a garage and a couple of rooms that had a cement slab floor. As the house slides the concrete floor becomes unsupported and has about 2 feet of space between it and the ground.

As a Fire/Building Inspector in the great State of Alaska, I feel your pain. It can be hard to require folks to comply with regulations that seem to change at the whim of bureaucrats. The State is in the process of upping our snow and wind load currently which could require all new construction to be engineered. We’re doing everything we can to avoid it.

As someone who just moved from Alaska, (lived there 20 years) i can say the "building" codes there are a joke. the houses up their are built like junk. even new construction is so sub standard. Everyone wants to sit here and complain about code but its real fun when you buy a home in alaska for 250-300k and realize you just bought a piece of junk that still has nob and tube wiring in the crawl space. So glad to be out of that meth head paradise.

@@punchinello6537 Like anywhere it depends where you live. If code is followed, it is virtually the same everywhere, being based on the International Code Council. Whether or not the code has been adopted where the structure is built and if inspections are done properly is the key. Many places in Alaska, such as outside city limits where I live, there is no building code. It is on the buyer and lender to make sure the structure being purchased is sound.

I'm going through the same BS. I bought a 40 x 60 building and property to put up a business and the regulations for commercial is ridiculous.

Years ago, while looking at one of the Peoples Republic of Illinois' semi-official 7½ minute quad wetlands maps, I noticed that the constructed settling tanks in one town's sewage treatment plant were each neatly marked off as a wetland. Elsewhere in the state, I'd also noticed a HUGE difference between these maps and the U.S. Soil Conservation Service's detailed soils maps.

Thankfully in our county in Tennessee there are no building permits required other than septic and electric.

When I saw that area of dead wet grass, I knew that was your tank. That is a nice spot for a house. Get the plans in and lay the foundation slab, before the rules change. Build at your leisure.
