Called " jury nullification", which the judge will order/threaten the defense lawyers they can't tell the jury they can do that (and they won't). Then the judge "orders" the jury that if you find from the facts the defendent did break a law (with which you disagree) , then you MUST still vote guilty. Then from what I've heard, if the judge hears nullification is being discussed by the jury, he or she will likely make additional "stop talking about" orders and start threatening jurors, too.

When you shoot through an object, your round will change direction. It might be a slight change, but if someone isn't close to the door, you might miss and harm a neighbor. Remember, if you miss and hit a bystander, you will be responsible for hitting them. This happened not too long ago when an armed man approached a car to jack it, and the owner fired at the car jacker and missed. The round hit a kid in the store behind and seriously injured a kid. The car owner was charged with a felony.

I remember an incident that happened in Texas over 20 years ago. A man's car was being repo'd, and he shot the repo man. He later used an old law that basically equated his vehicle to a horse as defense which allowed horse thieves to be shot if caught stealing a horse, and he won.

Now it depends on the state, there's quite a few states, such as Montana, that in a case where a felony is being committed (doesn't have to be a force able felony), a person is allowed to use any necessary force to stop it, including deadly force. Regardless tho of the law or the state you live in, always expect to be arrested & charged if you shoot someone. Because it isn't about the law, it's about the political environment your in.

The three armed felons were within the curtilage of the property and commenters are missing the fact that carport is attached to the house which is basically a garage without walls. That area is considered square footage of the residence(you pay taxes on it) which now makes this a home invasion. The door exiting to the carport is leading to an extension of the residence. That makes this a whole different scenario. Lethal force of a home invasion is authorized.

You just have to open the door. Places like VA, make this iffy by having both a castle doctrine & stand your ground laws that state we have " no duty to retreat" & use of deadly force only in imment threat of death or injury, but then follow it up with a clause that states deadly force is only permitted after trying to retreat. Do you remember the case a few years ago where the neighbor showed up at the man's door and threatened to kill him, his wife, and his children? He shot the man on the porch killing him. The shooter was either not charged or acquitted as he was able to show that he feared for his life even though the act, by the neighbor, was not imminent at the time. If these guys are brandishing a switched Glock on my front porch, I'm feeling pretty threatened.

Texas law allows the use of deadly force in response to, among other things, "criminal mischief at night." I think this qualifies. Also... No state bars you from going outside to stop the theft. Once the thief uses or threatens deadly force you can respond in kind. I'm not saying this is necessarily smart or that you won't have to defend yourself in court. I AM saying that the letter of the law does provide avenues of response to this situation. Unfortunately, people get wrongly convicted of stuff every day and one should make informed decisions.

They pointed the gun at the camera intending for someone would see that, that would be brandishing a firearm and will always be considered a threat in that situation. This is private property I presume.

It looked like a full auto “switch” type backplate of the pistol. Certainly didn’t color match the rest of the pistol.

That is a legitimate threat. The millisecond you open the door it is justified. But not recommended.
