I agree, but most jury's are filled with jurors that are hand selected by the prosecutor and, depending on where you live, they will all be afraid of or against guns or violence of any type. You know the type.

Called " jury nullification", which the judge will order/threaten the defense lawyers they can't tell the jury they can do that (and they won't). Then the judge "orders" the jury that if you find from the facts the defendent did break a law (with which you disagree) , then you MUST still vote guilty. Then from what I've heard, if the judge hears nullification is being discussed by the jury, he or she will likely make additional "stop talking about" orders and start threatening jurors, too.

In Texas; you can defend Property. I believe it is the only state where you can use lethal force to protect property, livestock, and artifacts.

​@coolgamers2794 TX code § 9.32 you can use deadly force to stop theft or robbery at night if the property cannot be otherwise be protected or recovered. However, I think, educated opinion, since they've already displayed deadly force, you may attempt to stop them using deadly force. the robbery

When you shoot through an object, your round will change direction. It might be a slight change, but if someone isn't close to the door, you might miss and harm a neighbor. Remember, if you miss and hit a bystander, you will be responsible for hitting them. This happened not too long ago when an armed man approached a car to jack it, and the owner fired at the car jacker and missed. The round hit a kid in the store behind and seriously injured a kid. The car owner was charged with a felony.

I'm glad that I live in Texas. We are protected under castle doctrine. Our vehicle's are considered an extension of our home. We have the right here to protect ourselves and our property.

I remember an incident that happened in Texas over 20 years ago. A man's car was being repo'd, and he shot the repo man. He later used an old law that basically equated his vehicle to a horse as defense which allowed horse thieves to be shot if caught stealing a horse, and he won.

I would assume with the several felonies committed in the first few seconds of video shown, against the homeowner, a citizens arrest would be a real world potential repercussion. For that they would need to announce it, afterwards things would go from there. People cry too much for criminals and not anywhere near enough for the civil citizen.

In Texas a repo man was trying to take a car at night and was shot. Because it was at night and the homeowner didn't know he was redoing the car, he was released without charges.

Q it is legal for repo men to enter property and repo on private land. It must be open though, no gate or fence etc. If they open gate, it is a breach of peace and is illegal. That being said, trying to repo at night, in the dark is just stupid.

Also, your car is an extension of your house, and was parked nearly in the house, and the people were being held captive by threat of murder, to steal part of their house. Funny but idiotic if you are in populated area. If no one ever knows you are fine. If any neighbor reports hearing gunfire cops will come, if they realize there was a shooting then you were disturbing evidence and attempting to conceal a crime. You just made your court case absolutely unwinnable. If you are out in the country and your hogs are hungry - that’s a different story.

Now it depends on the state, there's quite a few states, such as Montana, that in a case where a felony is being committed (doesn't have to be a force able felony), a person is allowed to use any necessary force to stop it, including deadly force. Regardless tho of the law or the state you live in, always expect to be arrested & charged if you shoot someone. Because it isn't about the law, it's about the political environment your in.

The three armed felons were within the curtilage of the property and commenters are missing the fact that carport is attached to the house which is basically a garage without walls. That area is considered square footage of the residence(you pay taxes on it) which now makes this a home invasion. The door exiting to the carport is leading to an extension of the residence. That makes this a whole different scenario. Lethal force of a home invasion is authorized.

This is a situation where you sneak out the back, circle around, and get 'surprised' to find them on your property after a 'midnight stroll'. Just don't make it obvious and you should be fine if you have a decent lawyer.

I am not an attorney, but with the car being in the carport, that is the cartilage of the home. That typically is treated differently from roadside or the driveway.

Maybe the homeowner heard a noise and went outside to check on it with his firearm. Obviously they are armed which threatens his life, then he is allowed to defend himself at that point.

At my front gate I have no trespassing signs, through the caleche road I have painted the post tops purple as well as another no trespassing sign. No reason someone couldn’t have seen it. Not only can my car not be hotwired but I take the (quick release) steering with me. Thieves won't get very far. My other one's not worth stealing although I'd be pissed after having installed new shocks and struts if it was. The comments here are great to read. An off-duty cop tried to stop thieves stealing a car in his apartment complex parking. He shot at the car while they were trying to flee. One of the thieves died. Off-duty cop sentenced to prison. This happened in the DC metro area.

You just have to open the door. You have the right to defend your property, not with deadly force, but you can verbally command them, that puts you out there with reason, then you have plenty to justify reasonable suspicion of imminent bodily harm. Its also dangerous af using yourself as bait to vibe check them.

Places like VA, make this iffy by having both a castle doctrine & stand your ground laws that state we have " no duty to retreat" & use of deadly force only in imment threat of death or injury, but then follow it up with a clause that states deadly force is only permitted after trying to retreat. Also receiving minor injuries while being attacked are not grounds to defend with deadly force...

Castle doctrine is if ypu are in your car, not if you are in your house to prptect your car. Castle doctrine also applies to tents and bicycles. Depending on the state of course.

@ if they point a gun at you yes. To defend your property no. If they are outside your home you’ll need a carry permit and a 10 round mag. You still be locked up and will need to lawyer up. Better than dead though.

@kahunaal1631 sounds like yall need to get better representation and in that situation he did point a gun at them and that structure was attached to the house making it apart of the house you are right they will probably still arrest you but you wouldn't be dead

Do you remember the case a few years ago where the neighbor showed up at the man's door and threatened to kill him, his wife, and his children? He shot the man on the porch killing him. The shooter was either not charged or acquitted as he was able to show that he feared for his life even though the act, by the neighbor, was not imminent at the time. If these guys are brandishing a switched Glock on my front porch, I'm feeling pretty threatened.

I am 70yo, been everywhere and done everything. I was in the Air Force and Coast Guard for 6 years, worked 32 years as an Auto Tech, and a Horse and Buggy Tour Guide (yes, it is true) for another 3 years and I am retired now. I wont be messed with, I wont be harassed, and I absolutely will NOT let anyone take away my Rights that were given to me by God. I hope I have made myself clear.

a person has evey right to expell trespasers for their property and to stop criminals from conducting crime. they indicwted they would be willing and qble to maim and kill if anyone resisted..... they crossed the line. assault with a deadly weapon. any reasonable person would percieve thqt danger. nobody is required to be so assaulted and simply surrender to criminals demands. he has every right to say no. has evey reason to believe they will kill if he says no otherwise banks wouldnt have guards...... they would be limited to a sign that says "pleaee dont take our money or harm our customers" police defensive shootings would be almost none. crime would be rampant. countering such a violent crime by showing up and saying no followed by immediate force if offered violence is not a crime. i do not live in a state that sees proper defence as a crime. there is no duty to retreat. dont forget the state including police get a piece of our authorized right to serve..... they do not posess a king pass to be the highest authority..... we carry that..... any action a police officer could legally take to stop this crime is the very same wction the people have evey right lawful authority to take.

I think that in Texas, you may use lethal force against someone stealing your property. Especially if it's on your property. I may be wrong. Please let me know if that is incorrect.

Texas law allows the use of deadly force in response to, among other things, "criminal mischief at night." I think this qualifies. Also... No state bars you from going outside to stop the theft. Once the thief uses or threatens deadly force you can respond in kind. I'm not saying this is necessarily smart or that you won't have to defend yourself in court. I AM saying that the letter of the law does provide avenues of response to this situation. Unfortunately, people get wrongly convicted of stuff every day and one should make informed decisions.

They pointed the gun at the camera intending for someone would see that, that would be brandishing a firearm and will always be considered a threat in that situation. This is private property I presume.
