As a Agency worker for Pertems working for Sainsburys over nine months. I was dismissed for a small accident in the yard as a lorry driver. They dismissed me permanently from work. If I was one of the employees, I would add a warning and a small training course to attend. I feel unfairly dismissed, and I feel I haven’t treated the same way as one of their drivers. There is no way a driver would’ve lost his job if he was on the books. Do I have any rights?

Thanks for an excellent and informative presentation. I am current undergoing CCMA processes as I was unfair dismissed. I applied to have an external legal representative as allegations put before me required complex interpretation of law and compony policies. The chairman of the hearing gave me permission to make a written application why I will require an external representative. He committed to give response to my application at beginning of the next seating. On the next seating of the hearing the employer changed the chairman, and the new chairman said he is not aware of this application and either way without reading my application he is dismissing my application. The hearing proceeded without me having a representative and I was dismissed. Does my case qualify for an unfair dismissal

In Australia you have one month in which to make a claim with Fair Work, however if you earn over the average wage, you have no unfair dismissal rights. It makes no sense.

Disciplinary causes mental health and stress and it’s unfair when employees take advantage of that.

Only employees are capable of bringing an unfair claim and not all employees, employees who are employed for at least two years- tho there are certain exceptions which automatically qualifies for unfair dismissal. But if you could prove yourself to be an employee then you have a good chance.

. 4 years straight I was made to come in while extremely sick and be around food or id be fired. I finally got so sick and caught covid while working there and they ended up firing me for being sick because I followed the quarantine rules during covids "hay day". which was against the law and to get around what they did, they offered me my job back and apparently thats remedial action which absolves them of their crime (or at the very least no lawyer would take my case because of the remedial action) even though it cost me tons of money among other things. now my most recent job, Kroger; has done something similar while also breaking more laws. a little taste of said "iceberg" is as I was in contact with them the whole time, they put down I abandoned my job even though they knew it wasn't true and the person who signed and made said document was in contact with me the whole time (which I have proof) and the boss would not put me back on schedule to work. I even have proof they knew I was trying to contact them, but they ignored me even when I would go down there in person. "my" union rep who was working for them was working against me even though I paid my union dues. told me I had two options, either drop my grievance which I am not even sure she filed because she won't give me any of the paperwork that I never once saw or was asked about anything at all and when we had the "meeting"(which I believe was just them fishing to see what proof I had concerning what they've done) I was told I wasn't allowed to record or the meeting was mute. so, after they berated me and tried to blame me for everything, they told me to leave and continued the meeting without me which wasn't due to anything I did because I was corgial and polite the whole time. when I got their decision, I was told I had to either drop my grievance or be forced to resign. I told my union rep I want to appeal the decision and want copies of everything including the grievance that they stated was filed and we were in a meeting for among other paperwork which she wouldn't give me and said I had to choose out of the two options she gave me and that she would only send me krogers "offer" I mentioned above. resign or drop the grievance. just a taste of the bs they pulled. not to mention it wasn't just me who was sick, it was my 1 year old daughter who had a fever of 104 to 107 and was throwing up so much she wasn't able to breath. of which they were given doctors notes for my daughter and myself. do I have a good case ?
