At six million pounds a DAY for accommodation plus another one and quarter for security for these mainly illegal economic migrants, I think the public needs to know in detail where the money's going. I wonder how many Tory MP's have shares in MITIE, G4S, Serco etc ?

this goes higher up than UK law,,,,, ECHR European Convention for the Protection of Human Rights and Fundamental Freedoms ECHR) is a European treaty in which the human and civil rights of all residents of the member countries are laid down (article 10). allows filming in the public sector, even public in and government buildings , everything you can see from public (even if you point into private buildings and sites) you can photo and record it since November 4, 1950

I visited this location, 5-6 years ago back, then you were able to drive right up to the gate, which has now changed over time. They don’t really get me any visitors from outside because of the location in the middle of nowhere, but it was interesting to see even the fact that girl saying it was illegal to film, which was hilarious to hear 😂

At 4:20 you mention "Section 33 Criminal Justice Act 1972". This section gives the police the ability to arrest people who are wearing uniforms connected with political parties in premises that are open to the public. Prior to 1972 they could only arrest people in open places. This power for the police to arrest people does not provide any right for you to access any place you want.

Section 33 of the Criminal Justice and Courts Act 1972 re-defines the definition of a Public Place in the Public Order act of 1936 ie 33 Extension of definition of “public place” in Public Order Act 1936. E+W+S. “Public place” includes any highway and any other premises or place to which at the material time the public have or are permitted to have access, whether on payment or otherwise ”. This in turn extends the area people can legally photograph and/or to these areas.

@@mjb1957uk I am afraid that you are mistaken when you say that this has anything to do with where people can film. As you say, all that S33 CJA1972 does it to alter a definition in the Public Order Act 1936. So you need to have a look at that Act to see what it is about. Section 1 of that Act reads:- "Subject as hereinafter provided, any person who in any public place or at any public meeting wears uniform signifying his association with any political organisation or with the promotion of any political object shall be guilty of an offence" Before the change in 1972, police could only arrest people if they were in an open space but not if they were on private premises. So the law changed to allow them to arrest people who were at meetings on private premises. None of this has anything at all to do with a right to film on private property.

@@NickLea Suggest you read your comments again - you refer to Section 33 and then say this section gives Police the ability to arrest people in uniform etc. Sec 33 does not reference uniforms or political parties it simply re-defines the legal definition of a Public Place which, by implication, any member of the public can record or film in unless specifically prohibited under another Act. The founding stone of UK law is that you can do anything unless specifically prohibited.

@@mjb1957uk It DOES give the police the right to arrest people on private premises that they did not have before 1972. Read the Act. S33 redefines a "public place" purely for the purposes of the Public Order Act 1936 and nothing else.

@@mjb1957uk It has nothing to do with were you can or cannot take photographs, what it defines is as Nick has stated, where you can be arrested for committing a public order offence, if you actually look at section 9 of the 1936 POA, you will find that there is a part that defines a private place where you can be arrested for a public order offence. Don't be brain washed by auditors, the only piece of legislation that gives you any right to film is Article 10 of the 1998 Human Rights Act, and this lot break that all the time.

From across the Pond in New Hampshire. Scotland, how I well remember my trip there 50 years ago. I fell in love with your People and the land. One of my ancestor families was William Wallace who yelled the famous word, “Freedom!” I was unhappy to see the “unfreedom” attitude of these guards. But be careful, you do not want to do what our country administration authoritarian bureaucrats are doing in letting anyone in. The Mexican cartel buses pull up and unload the people who pass over the v border. We give them bus or plane tickets to were they want to go and housing and food vouchers. Meanwhile, our own homeless ranks grow. Even the city of New York is having big problems with these illegal undocumented immigrants. So, what is happening to Scotland and “freedom.” Will the people stand up to the freedom cry of William Wallace?

I'm from Scotland and immigrants and refugees have always been welcome in our country and still are. I live about eight miles from this detention centre at Dungavel and we've heard stories of mistreatment of detainees there which, if true, is unacceptable.

14:40 The girl fails at trying to gaslight. Gaslighting only works when the receiving party is clueless. AY and TGA are not clueless. A detention centre might be classed as a form of prison and caught by the Prison Act. But filming a prison is not unlawful. Even being on prison grounds. Unless the prison is an open prison - which this obvious isn't as can be seen by the security fencing.

I think you mentioned the fact that the Law in Scotland differs from England in that you have to give personal details if asked, where you referring to Prisons Officers ??? If "yes" then Mitre are a private company contracted by the Home Office - this doesnt mean they have all the powers of a Scotish prison officer - this needs checking with your Lawyers !!

If they can't be bothered with the hassle why did they walk all the way and spout some nonsense. @@jophillips8230 Section 33 is just an example of the use of the term "public place". It occurs in many other places in legislation. It's a known legal term, defined by case law. It's main use to is define when an action becomes a crime (public place) and when the same action is not a crime (private place). However, it also means that the public use the place. And anywhere the public go, they can do anything they want that is lawful. Places can put up restrictions, but like the contracts between companies and individuals, notifications of such restrictions need to be fair and reasonable and advance notice must be given. It also must be borne in mind that no one ever reads signs, so putting up stupid restrictions that a reasonable person would not expect would be unfair and unenforceable.

@@jophillips8230 All the UK is private property. There are many different types of property. Anywhere you go you are walking on private property. The key thing is what the owner is doing to keep it private and what society thinks is private. So gates and fences means not accessible to the public. Private land outside fencing, say a grass verge, just means that the owner doesn't care who walks on it. Society has conventions about where to go, so residential gardens are not walked on. But anywhere else is fair game - from nosey parkers to kids to auditors.
