The port boat (keep clear) sails a course astern of the starboard boat. At time 0:36, we see the starboard tack boat begins to turn into a tack as the port tack boat is ducking. IF an umpire thinks that the port tack boat has to duck additionally because of this turn, then 15708 could break 16.2. At time 0:37, it appears 15708 is head to wind, and keep clear. Here 13215 begins turning up, and is required to respect 16.1. Since the first contact occurs while 13215 is turning, he breaks 16.1.

Doesn't matter if he is not sitting down. What matters is if he is on CHC (close hauled course). 13215 breaks 16.1

Actually in my opinion this is a breach of 16.2 by 15708 followed by a breach of 16.1 by 13215.
