I remember how surprised my brother was when he found out that in the state of his residence if you cohabited with someone for three days and told everyone that you were living together the state considered you married. It went back to the middle 1800’s when someone with the authority to marry you might only come around once or twice a year. The state didn’t want a bunch of unwed mothers because that would put any children in a legal limbo. So if you lived together you were considered married but it was kind of expected that when the preacher or judge came around you would formally get married. The flip side of that is in the state that I grew up in you had to live together for seven years for a common law marriage. I worked with a guy who lived with his lady friend for six years and seven months when he was killed in an industrial accident. They had five kids together while they were living together. She got nothing from the state because they weren’t considered married and the oldest child got the life insurance but couldn’t touch any of it until he turned 18. He was 5 1/2 years old when his father died.

@@YeshuaKingMessiah Only if she turned the kids over to the state. She had no way of proving paternity except for a birth certificate and the state said she could have put anybody on that. Which in a way is true. Where I lived you often didn’t get a social security number until you started working or getting state help so none of the kids had one. She had always been a stay at home parent so she had no taxable income so he just filed taxes for himself. After he died the kids couldn’t get help without a card and they couldn’t get a card tied to him without his say so. It was like a dog chasing its tail. I never heard how it came out because the family moved about four months after he died.

In Germany there is a la, that a marriage is not valid if one of the spouses didn't know that the wedding was a wedding. I'm not sure if this ever became relevant but juristic comments say that it could happen that one of the spouses is told that the wedding is just acting for a movie.

I do not joint anything Financially with my wife. I already see it with my Stepdad and mom and how messy that can be Espically with Joint Credit cards and Loans Since if you Seperate you take on half the debt as well! So my Step dad has about $550k of Debt (This includes a mortgage about about $180k) and if my Mom was to seperate she would take on $225k since all the Debt was incurred during the Marriage but the amount of Assets he has apparently would mean my mom is walking out a Millionaire after everything is split and a 90k a year payout until he dies since after the Marriage goes to point (Usually 25-30 years) it becomes 50% of your income for life.

Friends of mine got a letter from the District of Columbia saying that it would consider them to be married by common law when they reached the 7th anniversary of their joint residence in DC. They moved across the river to Rosslyn, VA because they wanted to choose when they got married, not have it declared by the government. They eventually did get married and have been living in the District for over 30 years now. Their building in Rosslyn is where the Marvel movies show the "Triskelion" being located. It always made me laugh because I used to also live and work in that area.

My current marriage is common law from when I lived in Texas which has no statute minimum time of living together but the other two conditions - intend to be married and hold themselves out as married - must happen while living together. Proving it, though, may be a different story. We filled the Declaration of Informal Marriage a couple years later. We had planned to get married via the more usual route but the ceremony was set for April of 2020 so obviously didn't happen and since the county clerks went to appoint only and that system was quickly overwhelmed we decided to go the common law route.

several states allow marriage by proxy. if you and your partner want to get married, but you are deployed overseas, you can have someone stand in for you at your wedding. most of the time atleast one partner needs to be at the wedding. iirc one state even allows both partners to have someone stand in for them.

That's not explicitly stated in law. You have to agree to be married, live together as a married couple after the agreement, and present yourself as married. As for marriage by proxy in Texas it's only available in the absent person is in the military, and you're still going to need the marriage license.

Good question. My neighbor was disabled from polio. His best friend accompanied him and his bride on their honeymoon trip. If you can't physically maneuver your body as well as normal, and you are in a new environment, you've no idea what situations might occur or exist that could leave you in hopeless straights. You might run into a good Samaritan who is both willing and able to help you, but your chances are much greater that you will be stuck. Take a look around and notice how many ppl are out alone on crutches, walkers and wheelchairs, carrying out their daily activities. Unless you live around a special needs complex, you likely won't see many, or even one?❤

In Australia we have this and it’s called a de facto relationship. After two years of cohabitation between two intimate partners, in every legal sense, they’re married. It can be considered de facto in less or more time but two years is almost always the timeframe. The parties can apply for financial separation orders just as a married couple would. Unlike the USA, Australia’s family law is governed at a federal level (along with employment law and a couple other areas of law)

@@salamanderguy3270 I never made comment as to its merit. I do however see the value both in having it and not having it. In having it, spouses aren’t left with nothing after separation, particularly if one spouse has stunted their own career and lifes worth of savings to make way for another, thereby affecting their future earnings. Also, if they purchase assets together then some formal separation would be needed. Furthermore, there is no difference in the circumstances of the relationship if they have a certificate saying they’re married or not. The courts make de facto separation orders based on contribution and circumstances. They don’t just award someone half without reason. Take my dad for instance, he has bought many assets in a family trust with him appointed as trustee, whilst my mum has taken care of day to day expenditure and bills. If they separated but were never married and de facto law did not apply, then she would be left with nothing. That being said, it does open the system up for abuse and not every financial separation matter has a fair conclusion. I understand the merit in both sides of the argument but the de facto laws haven’t been made without reason. Simply saying it is bad without articulating any reason doesn’t provide anything other than insight into your own personal feelings

@@UnluckySlava I think you could easily fight the claim you’re married by simply saying you’re not married. I think common law marriage is important because it provides an avenue to marriage not dictated by bureaucracy. I can’t imagine the level of romcom you would be in to have joint finances and live with someone who you weren’t planning on marrying. I would totally watch that romcom lol

@@YeshuaKingMessiahNo marriage, no inheriting as next of kin and no rights to make medical decisions on behalf of your partner. To get all the legal rights of a married couple would take way more time, hassle, paperwork, and lawyers' payments than simply going to a courthouse and getting married.

No will, they get all after debts paid. Moral of story, keep ur pants zipped if ur so anti-family u won’t get married
