Maya Alvi ok so within the next 2 months you should be eligible to apply for an immigrant visa. However you must wait for the president’s suspension to be lifted.

My dad works with the US embassy in Nigeria for over 21yrs now, so he applied for a Special immigrant visa (SIV) in 21 November 2019 which is under employment base category E4. Now we haven't heard a thing for over a year now since 2019. Though at first we thought it was because of the March Covid-19 lockdown but now still not hearing nothing. Or do you think the USCIS would/should have approved his petition since the petition year/last year and sent him his 'priority date'? Because we haven't checked the mail he used since he petitioned, and it was because he works there(embassy) and all who applied before him don't usually keep tabs on it like those applying from the outside world because in his work when their SIV arrives they'd usually call them personally by their boss to congratulates them. But that hadn't happened with my dad since he applied since 2019, but i personally think maybe this year's different as they're too busy to do that due to the heavy workload of 2020 applicant that wasn't answered due to the global lockdown or what do you think here?? It isn't compulsory to be congratulated by the embassy before you could confirm your petition has been approved right for the SIV???

Great video, you have explained everything in great detail. However, I had a question, if my spouse is abroad and Final Action date is current and Filing date is stuck at Aug 2020, assuming I apply for I-130 now and it gets approved in the future, what date would I look at for visa processing? I read somewhere that one can also follow Final Action Dates for visa processing because of surplus visas or something. Please elaborate. Thank you!

Jesille Langit by first letter do you mean the approval notice for the I-130? If so, then the “second letter” is the notification from the NVC to start the process for the embassy, which is what I was talking about in my previous response. Several years because your priority date has to become current before the nvc contacts you

Hello, Question for adjustment of status currently reside with me in the USA. We already submit the I-485, I-944, I-765, I-864 together with the supporting documents & I-797 receipt notice for I-130 last April 27, 2020 but we haven't receive a notice from USCIS . We filed our form I-130 april 14,2020. Her I-94 for b2-visitor visa is valid only until May 22, 2020. I'm a Permanent Resident holder for now. I was supposed to have a citizen test this may but it will be deleyed. Does she need to apply for extension of stay? what is the best option that we can take. Our birth place is Philippines

Kenneth it takes about two weeks to receive a receipt notice for the adjustment of status. Once they receive and accept the I-485, she can legally stay in the country. She cannot file to extend her B2 status now that she applied for a green card

Gillian Foster then you do not need to worry about the visa bulletin because your priority date is current if you’ve been able to start the process with the nvc. Now you just have to wait for the embassies to open up!

Mikhail Taguines ok so since you are in the US, you would use the Final Action table for your AOS. Currently it looks like you have to wait 2 more years before fling your AOS, but the wait times change every month. So it can be much faster than 2 years

I got left hanging on a detail: The A table is for status adjusment meaning the beneficiary is already living in the US. The B table on the other hand is for beneficiaries that reside out of the US. My mother petitioned my older sister (39 yrs old) lives outside the US our (F1) Priority Date is Feb 2, 2015. I was looking at the June (Upcoming) Bulletin and it appears to reflect as current next month. My only question is, in reference to the first statement, should I look at the A table or B table to check on our Visa Status??? I would definitively appreciate if you can guide me thru this.

enlasmalasmuchomas you should be looking at Table B. Although it will be current for June, your sister is subject to Trump’s immigration suspension. So she will have to wait for the suspension to be lifted and for the embassy to open back up. Then the NVC will contact her about setting up the interview

I see there is long wait times for India, China etc for EB2/EB3 based green categories. If I am UK citizen, then the "All Chargeability Areas Except Those Listed" would apply correct ? Thanks.

Sunil the general rule of chargeability is the country in which you were born. So if you were born in the UK, then you would be correct

Sunil that is correct. It would be India. BUT, if your spouse that would be coming with you is born in another country for example, then you could use your spouse’s country as the chargeability area.

I am really thankful for such a great effort you made. I have watched plenty of videos trying to explain reading the Visa Bulletin, but none went through it the way you did. I am registered nurse from Jordan, I have a priority date of 12 NOV 2019 for form I-140. I believe that you have noticed that the DATES FOR FILING OF EMPLOYMENT-BASED VISA APPLICATIONS for EB3 category were oversubscribed since JAN 2020 were it was stuck for four months, fortunately MAY Visa Bulletin showed some improvements of about three months. My question please, what is your prediction about the upcoming Visa Bulletins would they keep showing improvements for the EB3 category? Another question please, how long do you think the Healthcare Workforce Resilience Act would take to be issued and passed by the government and would it affect the waiting time substantially for abroad nurses? Sorry for such a long comment. Again thank you so much.

Mohammad Alqebali thank you very much for the positive feedback. I do believe that next month the Eb3 category will show improvements. As for the new bill that was proposed, it would be a surprising turn of events. Currently Congress and the President want to suspend all immigration, but now we have Congress wanting to give 40,000 green cards to healthcare workers immediately. I imagine there might be some back and forth. Or hopefully they realize the immediate need and pass it quickly. I never know what the government is going to do these days.

Car Gomez yes the executive order suspends first preference family based (unmarried sons and daughters of us citizens). You should still prepare the documents so once the suspension is lifted, you can attend the interview at the embassy

petrussell you would use the chart for “dates for filing family sponsored visa applications”. The May 2020 bulletin has 28JUL07 as the priority date for F4. So as long as your nationality is anything other than Indian, Mexican or Filipino, then that’s the date you would use. Since your priority date is July 27, 2007, that means that starting May 1st, you have an immigrant visa number available to you. This is great news for you. Once the president’s suspension is lifted, you will be able to get your immigrant visa at the embassy
