Qualified immunity went out the window the moment she said she was detaining him for taking pictures of the officers coming in and out. This is clearly established law, upheld by the supreme court with ample precedent to allow for adjudication. She is not protected by law. By the system maybe. As for the male officer there. There better be a call attached to the incident number or his qualified immunity is gone too.

The detained person should have litigation discovery opportunity (or get if from the internal affairs people) - requiring the police to produce the phone call or whatever other 'whistleblower' information 'alerted' them to suspicious activity (trespassing) or a crime. If they can't/won't produce it, that should constitute a violation of 4th Amendment rights against illegal detainment and/or search and seizure without a cause or warrant.

Like I just posted...most times when they say "someone called in"... no one called... police are allowed to lie to you...in the past I've called the cops out on the ...so called "someone called" and said I will need a copy of that call...At that point they know that I know that they are lying ...because I know I did nothing wrong and they just needed an excuse to do whatever with nothing to back it up...ALL calls to the police especially 911 are all recorded

James Freeman pointed this out really well. If the officer said he didn't know what was going on, then later, how could he know that a call came in about the man trespassing? If this went to court, the lawyer would be able to present this and ask if the officer was lying then or lying later. It would not be a conclusion because the officer made two contradicting statements of which only ONE can be true.

It REDUCES the amount of evidence required to detain someone from probable cause to reasonable, articulable suspicion. Essentially a cop's whim. Some dept. teach people to keep their hands in front of them on their belt buckle because it means your forearms are covering your equipment and firearm from being easily snatched.

If the report came from a sworn officer, whose testimony is taken above the word of multiple citizens in a court of law, then any time that report is proven false, there should be an accompanying “Filing a False Report” charge on the officer who made the call. We NEED to hold officers to a higher standard in accordance with the enormously increased amount of freedom, rights, and authority they have.

Part of the issue here is that this police "officer" has a quasi military rank, but it does not come with the responsibility or accountability of an actual NCO. Civilian police are not military and should not be using military rank or insignia.

The Sergeant is typically supervisor of/over lower ranking officers. They are responsible for their training and safety and usually scheduling and area of patrol as well as holding them accountable. You know, similar to how a Sergeant in the military operates. The main issue here is that she was not properly trained from the beginning and thinks she can run rough shot over anyone she wants to without any sort of repercussions. That is the unfortunate issue here.

@@hynsum In the eyes of the law and more specifically, the courts... Arguable probable cause and reasonable fears is an acceptable defense for many of the official abuses committed by police... In excessive force cases, "I was in fear for my life" is a get out of jail free card... In the case of detentions that are later determined to be unjustified.. "I was just trying to figure out what is going on" or "I was concerned for the safety of my fellow officers" is a shield against citizens who would complain regarding the violations of their civil rights... Fear is, indeed, a very acceptable defense for police abuses... If you can sell that the fear was reasonable based on the "Totality of the circumstances" It is very unlikely she would face in severe issues... As long as there is no clear policy violation, she faces very little liability...

As soon as she went to touch him he should of politely said he is going to remain silent until a lawyer is present. Zero reason to talk to cops.

@memphis tapes actually is like a TEST to see if the police will rap3 or respect your civil right and as you can see they didn't pass if they can not do something basic as this what makes you think the rights of all low/middle class will be respected? you need learn your rights also they work for the public YOU they not above you but is hard for people to understand who only POV is of an employee been told what to do your whole life......... if you look we have alot of cases of criminals act rape/killing/family abuse/corruption in the police sector why ? when they supposed to be the ones protecting even 1 case is too many is easy dont commit crimes yet our police does

It was an aggravated kidnapping and interrogation (with an implied threat of murder for any level of perceived resistance) by armed, sadistic thugs who like to terrorize, criminalize, dehumanize and brutalize the public for fun.

I think it was going a bit too far to equate the officer to a bag of hammers. Hammers have a purpose. It's clear she does not.
