They act stupid because they are actually stupid for real. It's a thing where certain goofballs head for the police departments to join. I heard this from their fellow classmates in high school, and it sure look that way. They can hardly do critical thinking and they COGNITIVE ABILITY IS SKEWED.

What does it mean to be detained? When a police officer detains you, you are held in police custody for a short period of time. Under certain circumstances, police officers can temporarily detain a suspect while the officer conducts a brief investigation to determine if the suspect is involved in criminal activity. This is called an investigative detention.

Now to detain some one you need reasonable suspicion. Which the officer had. Taking into consideration that the man was drinking out of a Heineken bottle, the cop had reasonable suspicions to detain the suspect on the grounds that he was drinking alcohol out in public. The cop detains the suspect, conduct investigation, finds out its not alcohol, and un cuffs suspect, and goes about his business. No violence, no shouting, no kicking, just regular routine police work. I don’t understand what wrong

My neighbor's six year old sees me walking down the street and jumps on his bike, chasing me down making siren noise and immediately starts rapid fire pestering me with questions. If I don't stop walking he bumps me with his bike. This has really given insight into the po-po, children who never got enough attention and need to control.

You can sue the man acting in the role of a police officer. If his public liability/insurance bond doesn't cover what your commercial lien requires, you can garnish his pension and confiscate his property, material wealth, and savings.

Handcuffs during the investigation are, by their policy, only to be used for people they have a REASON to Believe are dangerous or a flight risk. He was standing there and talking to them. It’s important to realize it wasn’t always like this. I was born in 62 & grew up with police that would help you jump start your car , even help fix a flat & or offer a female a ride home in emergencies. It was like another dimension where they were respectable hence respected. Nowadays they don’t exactly serve nor protect.

​@@KT-S6 there are some root beers that come in a brown bottle. I was pulled over for drinking and driving. I was taken to jail. I insisted on a blood draw. They did one. I was in the tank overnight. The sheriff came in in the morning and looked at the paperwork. Tells his clerk to get the deputy into office immediately. When he gets there and gets in a mild discussion with his boss he still claims the ticket and arrest are valid because he observed me drinking and driving.

Ignorance of the law is no excuse. There WAS probable cause, he was detained ( not arrested), cops investigated, no crimes found and he was released. A complaint for not doing his investigation first is laughable. My best guess is that this guy was baiting cops by looking like they were drinking in an illegal setting. You folks need to get a grip.

The Chief of police needs a bad cop to work an illegal private security business. It's a kind of brotherhood. " Hay bro we have something on each other", a mutual agreement. Also, most cops drink vodka to sleep at night. An alcoholic cop may have pulled you over and you would never know. Or could you? The big giveaway is the menacing, belligerent, confrontational, aggressive dangerous grainy VODKA VOICE. When you get pulled over , make as little contact with an alcoholic cop. Like any alcoholic, they are dangerous with a license to carry a gun and kill. They will testilie against you and get away with it. You are dealing with a gang with a badge.. Most judges will rule that being temporarily detained for 30 seconds is not even a minor inconvenience. Even if not, the Officer had probable cause because hius friends WERE illegally drinking (see the Heineken?!) and he was there with them also drinking what APPEARED to be a beer bottle, it was night, and the civilian hadn't even told him that HIS was non-alcoholic while all his friends were illegally drinking alcohol (public intoxication is not legal in most places for good reason).

Judge will rule the cop had probable cause to suspect this guy was drinking too. Not to mention even if not, there is no cause for damages as a 30 second detainment won't warrant more than say $500 it's not even worth the time to file such a case, lawyer's fees would cost you more. Judge might rule you're entitled to just $1, as a symbolic, "yes you're technically right, but you didn't suffer any damages and this is a nuisance suit".

So what you're saying is we should just get rid of qualified immunity? I agree with that, but you seem to not understand what qualified immunity is. It allows government officials to violate your rights without consequences. That is the entire point of the judicial doctrine. The only time qualified immunity isn't allowed to be used as a defense is if those exact actions have been "clearly established" to be unconstitutional. To show that a right is clearly established, a victim must identify an earlier decision by the Supreme Court or a federal appeals court in the same jurisdiction holding that precisely the same conduct under the same circumstances is illegal or unconstitutional. If no decision exists, qualified immunity protects the official by default. It's a bullshit catch 22 that the courts created, it's not even a law, that should be ended immediately. But it also protects those making laws so why would they change it?

Apparently there's some folks who just don't get how rights work here in the US: This is actionable in civil court no matter what some clowns on here claim. NO he didn't have to wait to be booked or charged, no the officer uncuffing him moments later does not change the situation, yes this is a clear and easily actionable violation of civil rights. Qualified Immunity will ensure the officer is not personally sued, but you bet your ass the city can be sued for several digits. You don't need to be beaten, charged, threatened, yelled at, etc. For those that don't get it: Seeing something that looks like a beer is not reasonable suspicion a crime is being committed. In order to cuff him and seize his property the cop needs more than a bottle that resembles a beer bottle. There's plenty of beverages out there that aren't alcohol thus "looks like a beer" is not probable cause. He would need more such as the odor of beer, the person admitting it, seeing a label that clearly marks it as alcoholic, or the man being visibly inebriated. Without at least one of those things, cuffing him and taking the beer were clear cut violations of the Fourth Amendment. Especially without first at least asking "Sir, is that alcohol?" That question alone is common sense and any reasonable officer would have asked. Don't defend tyranny people. It doesn't matter he was unharmed or that it was over quick. That cop should NOT have the job he has.

1 tiny little hole 1 the bottle is a heineken 0% alcohol BEER so it would have looked smelled and even tasted like beer for him to conduct his investigation corectly the officer needed to do the following 1 sir is that alcohol? response no sir 2 the label and shape of the bottle indicate that it maybe a beer can i please have a closer look? note for this the officer does not need to take possession of the bottle but may request to so as to remove the possibility of being struck with said bottle response should be yes sir here (holds out bottle clearly showing label) this is a non alcoholic beer as indicated by the label 3 thank you citizen be on your way

My attorney wins approximately 2 lawsuits per year for me, two out of three each year. If qualified immunity is revoked the lawsuits will be filed against broke cops instead of Counties or Cities and sometimes States. They all have a lawsuit budget and they just raise taxes, no bill deal. If cops are required to carry insurance lawsuits will be significantly less monetarily.

Yes, that's what they're trying to do. Organizations like MAAD will give awards to a cop who has a lot of arrests (not convictions) for DUI. Cops pad their resumes with this stuff to get bigger paychecks in better departments. Also, quotas. Also, no training on actual law.

@@loganskiwyse7823 These are stupid old ordinances related to prohibition, not laws, and should all be repealed. The hypocrisy is astounding when many municipalities have sidewalk cafe's that serve alcohol and many times it's actually city property not public, but they have agreements with the city that allows them to use the sidewalk and serve. There has to be a distinction between public consumption and public disturbance, because they are two entirely different things. In Japan, you can but beer in vending machines on the street and it is a far safer and more polite country than the United States. The police are as well, even if you are a foreigner.

@@TNAROHfan true, though public drunken behavior is a problem in some parts of Japan. The culture of the people also has a major impact on use compared to safety. Same for France for example. Of course, you also do not have individuals driving around with AK 47s hanging in the window. chuckles

He's talked about some cases where the circumstances were much, much worse than this and a jury awarded something like $4k. If the cop had to pay for it then things might change.
