@6pici6 - Yes. The cop wouldn't know if the person is a burglar or property owner, and without knowing that the cop has no probable cause to suspect otherwise. Sitting in a car on private property is not a crime and the cops has ZERO authority to detain this person without direct evidence of a crime (Terry-v-Ohio) or empowerment by the property owner to enforce a trespass. A hunch is not a legal rationale - needs REASONABLE ARTICULABLE SUSPICION of a crime.

My Dad once got a call in the middle of the night by police complaining there was a homeless man sleeping in the back of our delivery truck. I heard my Dad say "Is it on my property." followed by "Let the poor man sleep" and "Get off my property." The next morning we had a new employee. He worked for him for the next 20 yrs till he passed away from cancer.

No, not necessarily. If he got a call or if he saw something suspicious it’s reasonable for him to investigate. Most of us with common sense, no police training at all. Would sit back and see if the old man uses a key or looks like he belongs. Maybe see if he starts carrying stuff outta the place even. Most people with common sense would try to conduct an actual investigation before ever making contact with someone. Obviously crazy circumstances not withstanding.

They were NOT best pleased that I hoofed them OUT of my house, they tried to intimidate me, but they left with their tails between their legs! I think there is an exception if the property owner fills out paperwork giving the police permission. That's clearly not the case here, but it is an option for anyone wanting the police to be able to investigate the property while the homeowner is away.

A 1984 fes case removes the protection of the union, and you can charge every person involved in this call, including the dispatcher, the officers supervisors and even the union members, even city board members themselves. A very good example of how cops don't understand how "trespassing" laws work. Usually, we see cops trying to trespass someone from PUBLIC property (where, in most states, you have to commit a crime BEFORE you can be banned). Now we have this cop who doesn't understand how trespassing on PRIVATE property works. For the cop to have the authority to trespass someone from private property, he needs one of two things: 1) A COMPLAINT from the owner or a resident. 2) A WRITTEN AGREEMENT with the owner to ACT as their "agent" without a complaint. This cop obviously has NEITHER since he doesn't know he's taking to the owner.

There was a time when my ex called the police on me and tried getting 'her things' from my house, but I wouldn't let her take anything from my house. The police threatened to kick my door in and arrest me if I didn't let her and them in so that she could take 'her stuff'. I called their bluff and encouraged them to kick my door in and arrest me for not allowing her to take 'her stuff' without providing a receipt for 'her stuff' so I could avoid her taking MY STUFF while she was in the process of taking 'her stuff'. The look on the officers face when I hit him with logic and reason was priceless. What would prevent her from taking thousands of dollars worth of electronics, xbox, ps5, laptops, tv etc if they forcefully kicked my door in and let her take whatever she claimed was hers? Prior to this event happening, she had already packed her things and moved out after claiming that pitching in 75$ a week was 'unreasonable'. I don't hate police but I do hate bullies who abuse their privilege, and I was not nice about telling them to get the ef off my property and not come back without receipts or a warrant to search my property for specific items on the receipts.

@gfg758 things escalated a little before that whole incident was resolved, and a police sergeant ended up showing up. I showed him text messages that convinced him that she had nothing there. When she moved in she had a bag full of laundry and her makeup. She left with the same things. She was just being vindictive because wherever she went didn't work out, and when she tried coming back I told her to kick rocks.

@pavy415 I didn't get 300 a week. It would've been 300 a month. It was better to give me the money than for her to keep spending it on drugs. She was ruining her life with a cocaine addiction. I tried to help her get off it and rehabilitate her life, but you can't help someone who doesn't want it. Luck has nothing to do with it, and money wasn't the issue. With that said, though, I still don't believe anyone should be freeloading and taking advantage of other people.

Unless he's actually witnessing a crime in some way. And someone you don't know being on land doesn't qualify. But there's the rub. As you said, he has no reason to be there. Why do I suspect that - like in MANY cases - if we knew the entire context that we'd have an idea why the cop thought maybe he should check it out? He was wrong, but they don't generally wander onto private, residential land bowing up on strangers when they don't know who owns the property.

Not entirely true… if cop observes a suspicious person or activity like a prowler (perhaps homeowner on vacation) they can investigate. Cop here was NOT rude, perhaps wrong (nothing suspicious) short clip leaves doubt. MANY times cops obviously overstep but too little here to say.

Pass a state constitutional amendment which makes it mandatory that all police officers and other emergency response individuals carry a minimum of $10 million dollars of personal liability insurance which pays for these types of civil rights violations. In that same constitutional amendment make it mandatory that all such claims are resolved by a citizens commission which would act as a grand jury in police/ERS disputes of wrong doing.

How many times a day, though do you think you have a "trust me bro" or a Karen lying to the police about stuff like this? @@tdane5017It seems like the first person they contacted would be the person making the 911 call instead of trolling the neighborhood. If the caller couldn’t articulate probable cause for the call then the investigation shouldn’t escalate into a fishing expedition. If the original caller can articulate probable cause then the cop should articulate that as probable cause for his investigation. Then the “suspect” must identify. Cops just aren’t used to any pushback at all, and feel entitled to always get immediate compliance - to the extent that they treat justifiable non-compliance as a crime.

If a 911 call is made they show up to make sure everything‘s OK and sort it out at that point. People call 911 while they are having a heart attack and pass out on the floor during the call. It’s an emergency line. It’s designed for quick response. They’re just trying to protect the public.

If you call during a heart attack and hang up how does it help to start canvassing the neighborhood? In this particular case the guy they are grilling is the property owner. Let’s just say that his abused wife made the call - she’s inside, and he’s outside. Wouldn’t interviewing her - the 911 caller - first give them probable cause to detain him? That’s not what this looks like. This looks like they accosted him without probable cause and when they couldn’t articulate and he refused to identify the officer just got his ego bruised. There’s no excuse for this. It’s unprofessional, and it shouldn’t be tolerated by his fellow officers. It makes them all look bad. When a civilian rightfully invokes their rights under the law police should immediately disengage. It appears that training is negligently inadequate and police culture is antagonistic towards civilians who expect their rights to be respected. It needs to change.
