I got a fine from a Victorian council for placing the nature strip grass cuttings around their tree on the same nature strip. They said that my grass cuttings, not theirs, would run into the street drains causing algae to grow. They were more than happy for me to go to court. I didn’t back down and when I showed my photos and videos of the same council cutting their grass on freeways, main streets and public parks where all the grass is forced onto foot paths and roads, the judge asked them why are they not adhering to their own laws. They were ordered to change their cutting procedures and to cut my nature strip every fortnight which they do. The fine was dropped and the council had to pay my legal fees and loss of wages for that day. So in short, every council has to explain to a judge why their laws are affecting their residents from continuing their lives without having to pay for the privilege.

Council overreach is quite common in Victoria. They impose all sorts of woke and nanny rules until someone takes them to court to challenges them. A council needs to stick to its basic services remit, that is provide the paving, road repairs and garbage collection, parks and garden maintenance. Everything else is just a distraction that we (rate payers) should not need to pay for.

Ha , I've got disabled or elderly locals tripping over themselves trying to navigate stepped up uneven concrete footpaths all over my suburb, I had to trim back council brainiac tree planting on the nature strip , so one people could see a Bus coming up next to the bus stop and so busses don't have to slam on the brakes seeing people waiting last minute , and two , so I could see driving out of my side street so I don't constantly nearly get hit by another car . This was a danger to every person in my street . They are no brains between them , just a bunch of overpaid halfwits trying to justify their position . Why are we paying for nature strip tree clearing one foot away from the powerlines "continuously" whilst all getting possums creating havoc in our roofs , instead of them cutting them right back ? Maybe we should All start actually complaining about their neglect in their position to get them actually busy with Something proactive for the community . Useless and going too far with all this garbage .

Think about it, the constitution states only 2 levels are able to be government. Federal & state that’s it. So when they talk BS about local councils being a 3rd level. It’s not possible without the government breaking the law. The local councils are only a delegate entity under the state government banner. They had to legislate an act to delegate select things to these entities. There’s been referendums about local governments getting added to the constitution & they’ve been voted down. If councils were the same as state government, the state government wouldn’t be able to walk in & remove some democratically elected representatives replacing them with administration by claiming they have been mishandled or whatever. Which was done in a fair few councils areas across the state all at the same time!!!

Reality check people: 'Private' land has never been privately owned. Even in the good old days when you could get a title deed for property that you 'owned', it had so many disclaimers on it that it wasn't worth the paper it was written on. It always gave the government a lot more rights than the landowner. It's only now, after decades of complacency, that we're finally waking up to that reality. The best way to reduce government interference in your lifestyle is to live away from the cities. The less population, the less regulation.

Want to see something worse, look at Whittlesea council. Another local council that was entirely dismissed and fired by the state government due to rampant corruption and infighting. I live in Casey and own multiple unregistered and club permit classic motorcycles, my 4wd on club permit, as well as my wife and mine daily cars. Thankfully I have a 6 car garage and 8ft tall solid fences so everything is out of sight for when I do all my own maintenance 😏 I believe someone in the council put something out recently about misinformation being spread about these permits, and his statement doesn’t mention servicing, but everything on the Casey website is still the same, and mentions servicing permits.

I'm in Casey, they are targeting all the residents for random things. The 3 latest before this is rock driveways, if you don't have an approved rock then they will epa you and have you remove the driveway. The second is fire pits, they have been using drones to view residents fire pits and if there is any sign of burning structural timbers, commercial timbers or old fence and pallets then you will expect a visit from Casey council and epa. And third is trucks, if you have a truck parked on your property you must have the property registered with the council as a transport company, otherwise the truck needs to be removed. None of this is here say, this is real and a few local friends are currently in a battle with the council regarding this. The council are constantly harassing them, parking out the front and watching, taking pictures, turning up to their homes unannounced as they please. I would have taken it to the media if it was me but these families are scared from being threatened with devastating fines so are doing their best to comply.

I’m in NZ and don’t have that options. Councils are here are mostly run by communists types who are busy taking democratic rights away where you don’t even have the option of voting them out. Don't think they can compel you to open up a shed. If I understand correctly, police typically require a warrant to enter and search your property so I don't think some local planners would have the right to do that. This should apply to all of the local laws they talked about. Clause 28 of the Casey Community Local Law 2023 (updated 1 July 2024), states that you can't service or repair a vehicle or machinery on private land without a permit, if that activity or use "is detrimental to the amenity of the area in which the private land is located". This specific local law appears to be concerned with whether your activity or use is making the area in which your land is located, less desirable or less attractive. My guess is, if you're servicing or repairing your vehicle or machinery in a garage that the public can't easily see into, then shouldn't be any issues, no matter how much of a mess your work area is. If you're servicing your vehicle out in the open, then you may need a permit if it is "detrimental to the amenity of the area". Don't take my word for it though. Just my 2c. Those local laws are still cooked!!

Wish they did it in my area. Nearby is a well off guy with 10 old junkers, container, boats, motorbike all 'stored'. It's on the block he owns adjacent to the block he lives on. Rat and snake heaven. I service my own cars and bikes in my garage.

The reason it has got to this stage is because abuse you end up with guys taking it to far by operating commercial business from home instead of industrial property and guys that keep an eyesore in suburbia with wrecked cars in the backyard. If you re read the article, it doesn’t say you can’t buy a project cat or repair you car. It’s aimed at guys with 10 wrecks in the backyard and welding and grinding all hours of the night.

this could result in legal action from residents, if they receive several hundred individual law suits related to these council's by laws it might cost the council a lot of money if they violate anyone property rights.

I have family that still live around Crimebourne, Officer, Pakenham, all in Casey shire, most of them are feral! Typical ex Pines Estate, those who know that place will know what is implied, unkept houses, old unusable Holden on the front yard surrounded by uncut grass, accompanied by the old converted trailer, now a camper, driving an early Patrol with every questionable modification supplied by Kings Superstore but bought on FB marketplace. Casey City Council has probably gone overboard, but they’ve also got a population that most Victorians have anecdotes about just like my family. And when we go bush, the fellow four wheelers doing donuts around camp, crapping and leaving toilet paper, and the broken Kings chair left on a fire pit, come from a Casey suburb.

15km from Melbourne a bloke planted a non native tree. 30 years later he saw it was damaging his house foundations. He wanted to remove it but couldn’t until he got a council permit which costs lots of $$$. It’s bloody ridiculous.

I appreciate what your saying, however you need to dig a little deeper and discuss the land zonings and area. Eg residential 400sqm is different to 1ha rural. Council rules will differ depending on community expectations…..plenty of streets in towns are clogged with cars and caravans because there is no enough off street parking

People who buy residential properties don't want to land up next to a commercial one. Large vehicles, containers, vehicle repair, etc. belong in commercial zones. I wouldn't want to look at a container or be bothered by continual noise. This is unpleasant and detrimental to property values. These rules will apply in just about any high density residential suburb area in Australia. (This would not stop you from changing the oil in your own vehicle in the garage or doing other ad hoc maintenance).

Get real - there is a big difference to running a commercial business to enthusiast restoring or working on their pride and joy. It is people who don’t get it that have no understanding of the enjoyment of working on your own vehicle. I am willing to fight for my rights and I am sure there are many who will join me.

The council's in Australia are out of control. Reminds me of the early days of the African diamond mines they had difficulty getting "workers", so "they" introduced a tax on the family dog. All families had one, but not the money to pay the family dog permit. So families were forced into the mines to receive the money to paid the fee, so the mine owners got cheap labour. #TaxSlavery

So what if you wake up one morning to a flat tyre, or a flat battery or the car just won't start or you're just checking the coolant and oil and topping up the washer bottle and the council ranger just happens to drive past. What if you call NRMA or RACV road service. I have a big shed and I just won't answer the door and I would NEVER EVER comply. Amen I live in NSW

It's basic history from primary school, basic logic from social studies in high school. So the main reason the council is doing this is to combat people running commercial operations or turning their area into a scrapyard or hording area. People can still maintain their own cars as long as it doesn’t cause "detrimental" impact to the local area.

These laws are only in place because some people have gone over the top and pissed off neighbours by creating a visual mess or making a huge racket. The laws are there to protect you too. Just apply for a permit and they'll make sure your neighbours are not going to suffer. Do it properly and you'll have your fun and live in peace. NO CONSPIRACY TO SEE HERE.

Checking is not done by rangers it's done by Ariel photography, this is a service already in process such as near map, so the councils just get the updated photos that automatically show any additions then the authorities just turn up with photographic proof, typical pathetic Victoria.

Civil disobedience, legally park as many as possible registered vehicles outside every councillors residence and city officers car park (if possible) for as long as possible, I doubt this decision would last long😁

I see the points that where why they got it though in the first place like stopping people from planting shit boxes instead of flowers in their front yards, suburban wanna be wrecking yards, kids on dirt bikes being more of a danger to the public and themselves but in typical government style from local/city to federal level they also couldn’t give up the opportunity to make some extra cash off screwing over the normal hardworking Aussie with a hobby or business, and I do see how many ways this would shaft people So to everyone that finds out about this issue I think you should in my opinion everytime either local/city, state or federal government tries to bring something to solve a problem take a second to think how could they screw us over in the grey areas around this because they won’t pass up an opportunity to screw you

About ten years ago I worked for casey council as a contractor. There was a bloke who would spend his time on near maps looking at garages and sheds with evap units on the roof. Then he would go to the property to see what is happening in the garage at times he would find other uses. A bit un Australian
