I've been a City Manager for 28 years and one of the absolute worst things I have to do is eminent domain cases. They go against everything I believe and I promise I've fought very, very hard to avoid taking land and have only had to do it a handful of times. But those cases were all situations done by local government for the absolute and direct benefit of the community, and we still paid far more than the land we took. Still, I hold my nose when we have to do it. But for a private company is given this power and there is no direct benefit to the communities in which land is being taken, that is about as unAmerican as it gets. This should absolutely not be allowed and I hope those land-owners get good representation and fight this and win. I am sure there are other ways to get this done. Most people will sell their land at SOME PRICE, so the company should have to just pony up whatever it takes. The few people who just don't want to sell at any price should have that right, and the company should just have to go around them. Yes, I understand the enormous costs of changing direction of a high voltage transmission line and what it takes to "{go around". But they will pass those costs on to customers anyway. I know there are some cases where eminent domain is just a necessity- I've been part of it- but this doesn't feel like one of them, and private, for profit companies should never be given that power.

So, basically, if i buy a house, land, even a business, that is my private property, I only have possession of it due to the graciousness of government. As soon as they decide that "others" will benefit more from my property than I will, they simply come in and take it. My friend, that is communism, pure and simple and a representative republic such as ours should strip these powers from any level of government period. By the way, have you ever seen a case of a government person getting their property taken in this manner? I didn't think so.

This should be on the front page of every major newspaper and every national news channel's top story. This is the stuff of nightmares. I don't think I could ever get over the seething anger of having this happen to my family. That's saying a lot because I had to go to court yesterday to fight with my late husband's ex-wife who was trying to take over my husband's remains and have him buried out of state, and I have forgiven her. She even applied to receive mine and my daughter's survivor's benefits, and I forgave her of those too, but taking someone's land? NO!!!!!

I live in NJ. We have farms with electric lines passing thru fields with horses and cows grazing below them. Easement were created so farmers kept their land but they can't put a permanent structure within the easement. But no nongovernment, for profit corp should be able to take land. SCOTUS made a very bad decision about 15 yrs ago when they allows a neighborhood to be destroyed so they could build a mall. The neighborhhod was leveled but I believe the mall has still not been built. People who had lived there 40 and 50 years lost their homes. For what?

Moreover, the construction of new malls is superfluous, especially given the fact that many malls have, and continue to close throughout the nation. Remember that they were constructed in the late 1960s and impacted the small shop owners in surrounding towns, later on only to become hangouts for teenage elements of society. I just went to our malls looking for someone to help with a device hardware issue. Every mall had a bunch of stores that are closed up and boarded up. Even the newest ones. The plan-demic has put them all out of being in business and people stopped going to them. I finally found a guy by a food court who helped with device hardware. He didn't speak English and could only repeat my words back to me. No, you can't solve the problem, you can't send it back. Call them after you replace it. Try getting your documents and data on your new device. He just repeated me saying that and told me nothing. If he had a SIM of that type and it's unlock pin, we could try using it and then swapping SIM back. He no have. Solly. I went and bought a cheap one at a large discount food and houseware and drug chain store. They didn't know anything, but let me use their phone to do it for myself. I passed several mall type places and most of the store fronts were boarded up. Even the new ones. All those people are out of work or have gone to work elsewhere. I can't seem to find many people who will admit they voted for this regime. They must all be staying in their houses and having everything delivered?

It’s the state’s guaranteed revenue insurer. Walmart, big box stores, and real estate developers owe much of their wealth to imminent domain. Uncooperative landowners refuse to sell to these companies, so the companies go to these local governments with their plans which includes all the tax revenue. The property owners get slapped with imminent domain, get paid a fraction of what their property is worth and the rest is history and happens all the time.

This breaks my heart- I hate eminent domain in all forms and this should be voted on by both houses before it is allowed to go one step further! He is right, these farmers have spent generations on their land. I think an attorney should stand in the doorway for these folks and demand a very fair monthly rent for the easement, if they try using these people -that way. It is defendable for the property owner to fight in court.

Actually, he's being very generous. The power company is making money from this. They need to pay 2 times what it costs the farmer, how much he would make from the same acre of land, that he would make from the income of the land. When a person breaks up the farm land, it makes it extremely difficult to work this same land, and even until now, nobody can prove, that these power lines do not cause harm, and health issues. There are massive magnetic fields around each of these lines. Or give each of these farmers free electricity and 1 times the value of income from each acre of land they take.

Who do you think owns the land next to the highway? The highway was built with ED, there is a offset but not nearly enough to run a high tension line. More states need to pass non ED amendments. ED ONLY in the case of public use. Not public good, or any other BS that is arbitrary.

I have seen the consequences of High power transmission lines on private property. It splits their land, and they have not been able to sell any of the land because no one want these towers and power lines in their back yards. Over 30 years, these land owners have had for sale signs up. They had usable 10+ Acres before, but after they were left with just several Acres that were split into small inaccessible plots of land. I really do feel for these farmers. What should happen is for every acre seized, they add it back onto another area of the farm or just build the towers over the road ways like an archway plenty of space for that type of structure.

In recent years, surface "wheel" irrigation has been replaced by subsurface irrigation, which is more expensive to install but much more efficient and lowers maintenance costs, too.

Why don’t you have the governor of Missouri place a law against this land grab. The governor can talk to the farmers it would effect. Why can’t the company use the land splitting the land in half of the border states ? With a monthly or yearly lease . Not selling the energy company the land but leasing it?

Top be fair, strategy wise, it's a lot easier to cut directly from Point A to Point B. So what if there's people's homes? Take the land, so it's quick, cheap, easy to do. Going around is expensive! Detours are expensive! Think cost efficient. It's easy to intimidate people off their homes, than it is to spend millions to billions to go around. Think cost-efficient, discard morality.

Not always so practical given the cost and the environmentalist resistance to new power plants being built. The cost is astronomical and would still require transmission lines intrastate so that does not remove the objection of this video. Also fuel, given that nuclear would be virtually impossible to build and absurdly costly that leaves coal or gas. I cant see Bidens administration approving a coal fired plant. So gas it must be. How to get the gas to the plant if there are no waterways or local production?

@@glennrishton5679 Indiana has many many water ways and could easily have 3 or 4 nuclear power plants, and the objection is taking land away by force that the corporation has no right to. Nuclear power is the cheapest and cleanest form of energy, never going to happen under Biden. Interstate 69 and 74 run both directions in the state would be easy to use the land the state already owns.

Corporations should not be able to use eminent domain laws to get what they want. They should have to pay market rate - just like everyone else - for what they want. A company wants 20 acres of a guy's farmland - let them pay whatever he is willing to sell that land for. Anything else is theft, plain and simple.

The problem is cities that are growing need more electricity yet they don’t want generators where they can see them, which requires the power plants to built in the middle of nowhere and miles of transmission lines (which nobody wants to see either) bringing the energy in.

They have no interest in putting more power on. We just have certain individuals who have huge investments in electric. They don’t have the right to put it on peoples property. For about 30 or so years big companies and developers working with local governments have been allowed to use eminent domain to seize land, force the sale of land to go to developers and corporations. That was approved by the Supreme Court. The idea behind it besides corruption and kickbacks is that the new use for the land brings more tax revenue for the city and state. I do not know of Senator Hawley was referring to that when he talked of this company taking land.
