It's also a direct attack on the way a lot of investment is done in clubs and specifically Manchester United's current model. When you have one partner in a group investment that wants to invest more money into the club to build or buy things but do not want to change ownership shares you do it with a loan to the club. By providing a 0% interest loan the ownership shares don't change but the individual that does the loan can invest and get their money back once the club is sold off. This makes Manchester United's stadium plans nearly impossible now if that rule change goes into effect

I think that's a misinterpretation of the ruling. The inclusion of shareholder loans under the sponsorship rules is completely separate from any sponsorship deals, and since interest-free loans were allowed under the rules (as voted on by the clubs), no shareholder loans were ever rejected. The rules CAN and will be applied retrospectively on sponsorship deals. Agree that the fair market value evaluation has been found lacking in transparency, but there's no room for debate - the parts that need to be public and/or disclosed upfront are made clear to the PL.

Ergo the FA must either A. retrospectively apply new, yet to be written rules that include loan (which would also be illegal) B. Rescind judgements on past rejected sponsorships (actionable particular if clubs can no longer successfully negotiate for those deals) C. Nothing (also actionable) Many people are overlooking that the very fact that loans weren't subject to assessment, while sponsorships were, means the application of the latter was illegal, at that time.

I may be wrong but I'm fairly sure shareholder loans weren't included because they don't fully impact PSR. £30mill a year of any investment/loan goes into PSR and can be used on the playing squad but anything more is separate from the football side and can be used for infrastructure and the likes that is excluded from PSR. The likes of Etihad could have pumped as much as they wanted into City if they were investing in the infrastructure but that doesn't help City's owners who want more money to spend on players and wages so it needs to go in as sponsorship. All including shareholders loans does is make it impossible for clubs to fund training ground and stadium improvements without spending a decade or so syphoning money from the football side to fund it

Kind of find saying Everton being the odd one out a bit insulting considering they are about to change ownership with the Friedkin Group acquiring ownership of Everton. The deal will see Everton completely debt free with huge big hitters on the horizon in acquiring investment within the club. If anything this means with these ATP rules being challenged Everton have as much to gain from it as Man City, Newcastle & Chelsea & if you’re a new owner in a club then you want to throw your weight behind if it means getting more money into the club via sponsorship deals that won’t be knocked back by the Premier League.This means Everton could get more money into naming rights of Bramley-Moore Docks Stadium without it being challenged by the Premier League as not being market value. So with heavy investment looming on the horizon Everton have as much right to challenge the Premier League then Man City, Chelsea & Newcastle do. Concerning the loans it was agreed under the FFP rules club owners were allowed to loan their clubs money up to a certain amount a year. So now the Premier League are throwing their toys out the pram cos the clubs are abusing this and now want this closed so they have more reason to challenge the likes of Man City etc and probably continue to bully Everton.

It's up for the court/committee/whatever to decide, but if they are legit guilty, then they would need to be punished according to the rules. No free passes, no going easy on them. I dunno, the stuff about Mancini and other players getting extra salaries with external companies sounds pretty bad. Imagine other clubs with rich owners like Stoke and Newcastle just buying up all the talent and having their player salaries entirely covered by "affiliated" companies - this completely defeats the point of FFP. That's why City have been accused of repeatedly "cooking the books", and then when the EPL have come to investigate City have repeatedly lied over and over again. That's why they're being charged, and as much as I hate FIFA, the EPL and all these governing bodies, trying to pretend that (if these allegations are true) don't constitute "foul play" by Man City is just plain bias.

They clearly overestimated the number of arguments that would succeed, a 92% failure rate isn't normal. Person injury cases that go to court have a success rate of 50%. And if you include settlements, it goes to 75%. 79% of criminal cases that go to court in the US are won by the prosecution. 91,4% if you include cases that didn't go to trail (plead guilty or case dismissed). By comparison, an 8% success SUCKS. PS: I know those aren't the best numbers to compare, I'd love to find the stats for multi accusation cases, but they're not the norm 20+ accusations is a crazy number and I think those kinds of cases usually end with a plea deal

Man City shouldn't be deducted points or just relegated...the FA should strip them of professional status - terminating every professional contract the club has. Then, they should be inserted in whatever the highest level of the pyramid is that is 100% unpaid, amateur players. (Tier 9 or 10?) They should not be allowed to sign a player to a professional contract for 24 months. And during those 24 months, and the next 12 months after their professional contract ban is lifted, their ownership status should be frozen - essentially - "no. you can't sell it now that it's broken and worthless. you're stuck with it." The penalty against the club should be as outlandish, brazen, and over-the-top as the rule-breaking was. The punishment should last as long and be as harmful as they've been cheating to win, and in turn, damaging every other club. Only, ALL OF THIS this doesn't go as far or as long as they did.

Except what the tribunal said the delay in handling which the PL said was due to insignificant staffing levels (I wouldn't be surprised if that was due to City as well, their legal team has a habit of bombarding the other party with alot of documents that aren't really relevant while not providing what is really needed just to try and overload the other side. I imagine clubs have to prove the PL with evidence of the terms of the deals and supporting evidence of why its a fair value) broke the PL's only rules BUT that the delay would have had absolutely no impact on the deal happening on the part of the sponsor. They didn't find that the deal was blocked incorrectly though

Well judging by the report, they lost on the other 23 arguments in this case so it's easier to argue that they didn't win than that they did win, purely based on numbers. As to what each of the arguments were, I havent looked into it, so I don't know the importance of them and what is relevant.

The win for City is thus - it is illegal for rules to be retrospectively imposed on loans, hence sponsorships that were rejected during that period can now be engaged with. If refused, or if said deals cannot be resurrected, City can sue for the losses they have incurred from the rules not being applied evenly. Furthermore the potential for further expensive litigation every time a deal is rejected has been green lit: the process of evaluating deals has been found to be opaque and imprecise, and hence subject to debate.
