He should not have been sent to jail in the first place. It was a flawed Constitutional Court decision. The Constitutional has no business sending people to prison or imposing penalties. Their role should be similar to that of the US Supreme Court - that is, review decisions that have been made by lower courts. Which is what the Appellate Division - now the Supreme Court of Appeal - used to do. When the Constitutional Court acts as a court of first instance - their decisions should be appealed. As it stands, their decisions cannot be appealed - which takes away the right of appeal - a fundamental right accorded to all accused persons under Section 35 of Constitution. The Zuma case and the State Capture Commission is full of a litany of errors, foolish actions and decisions. When Zuma applied to have Zondo recuse himself as there was a perception of a conflict of interest by Zuma - Zondo should not have heard that application. He should have referred it to a third party - who had no interest in the matter and was impartial. Because you cannot preside over a matter on which you are the person being complained about. You would obviously be biased - which is what ultimately happened. Secondly, Zondo should not have approached the Constitutional Court when Zuma refused to testify. The matter should have been referred to the NPA for them to prosecute Zuma. Instead Zondo approached the Constitutional Court, found Zuma guilty and recommended a jail term of 24 months. Without a trial by the way. Zondo became the complainant, prosecutor and judge - which was very irregular. Zondo asked the Constitutional Court to rubberstamp his decision. Section 35 (3) of the Constitution stipulates that every accused person has a right to a fair trial, which includes a right of appeal to a higher court. I would urge you to read that section. In Zuma's case, a lot of the provisions of this section were suspended - which means his constitutional rights were violated - by the Constitutional Court! The Constitutional Court in its present form - is a huge anomaly in our justice system. They have deviated from their core function, which is spelled out on their website under the heading : "The Court's Position in the justice system. A lot of the cases they have adjudicated on are cases that should have been handled by the lower courts. They have confused their role. Even some of the decisions they have made on some cases have been ambiguous - at best. Take the Makate versus Vodacom matter. Their ambiguous decision on this matter is the reason that this matter remains unresolved up to this day. Why did they not decide on the quantum that Vodacom should have paid to Makate - and not refer the matter back to the parties for them to agree on the amount? It is obvious there was not going to be an agreement as Vodacom wants to pay Makate as little as possible. The role of the Constitutional Court should be reviewed - because if it is not - we may end up with another matter similar to Zuma's. Finally, the Constitutional Court is inefficient - they take months in arriving at decisions - even on matters that are supposed to be urgent.

I have mixed feelings about Prince comments. But I believe that State Capture did not start during Zuma"s tenure, it started before the dawn of democracy. I believe chief Justice Mogoeng when he said that to say State Capture started with JZ it is a fallacy. If we want to solve the problems that we have, to be honest, we have a long path to walk. To incarcerate Zuma is never a solution to our problems as a country. If we are serious to root out the problems of this country, I personally believe that we need to change/amend our Constitution
