Since Disney's go-to strategy is to attempt to outspend their opponents whether they are in the right or in the wrong, I hope that Elon Musk funds this guy's lawsuit. This seems to me like one of the most cut-and-dry cases of plagiarism with seemingly even more evidence than the claim that Disney stole the idea for the Lion King from an anime!

Not going to defend Disney here; but the case is weaker than you seem to think. Mainly because not only does Plaintiff have to provide credible evidence that he had the ideas FIRST... there's the argument of whether it was in fact done with malicious intent. Plagerism laws do exist within a grey area that states there's a set bar of similarity in order for something to legitimately be called as such. If the main character for example passed X bar. If ALL of the cast, passed X bar - or the actual content of the plot passed X bar; then yeah. But the ideas presented aren't necessarily unheard of (if gender is added into the mix that's another credible defense - if personality is markedly different, it gets harder to prove it was done maliciously in the first place. It's not impossible but the waters get muddy real quick) Frankly the whirlpool thing is cool as a concept, but you can point to Greek myth and scylla for it. You can argue Element Bending existed before either of those two ideas; so if we let X artist sue Disney for the water portal idea, are the creators of Avatar gonna be able to take both of them to the matress'? IF however, the artist can prove definitively that there are enough similarities between his works on the whole as presented, and they were genuinely done before anything came out in the Moana franchise. Yes. The case would go through, and maybe even in his favor. But it could also drag out for far longer than he could afford to continue it if he doesn't win. Since Disney does have larger coiffers (not nearly as "infinite" as they used to seem, but far larger than one artist) it's very likely they could just arbitrate the whole thing, or argue plausible defense until he gives in not to bleed out for money. Do note: I'm not saying they didn't steal it. I am saying they can and very likely will make it very difficult for him to prove that they did.

I this the sort of thing Disney would do? Absolutely. Did they rip this guy off? I don't know, but my gut says no. 1. This guy, a first-time writer with no credits to his name, presents his screenplay to a third party studio who have a 'first look' deal with Disney. They are interested enough steal his idea, but not enough to just pay him the peanuts it would cost to own the rights? 2. They then sit on this great idea for a decade, before reworking it completely from the ground up. 3. The proof? Almost every 'similarity' he describes is derived from the source culture that they are both referencing, fishhook necklaces (makau), demigods, tattoos, turtles, spirit animals. Oh, and the protagonists are both teenagers with disapproving parents (almost all Disney protagonists are). 4. This guy is keeping his own material hidden that he claims is being infringed. If you'd genuinely been wronged, wouldn't you want to let everyone see, get a ton of public support behind you? Or maybe you're worried that people will see how tangential the similarity is, and loose support. The only things he might be able to argue is the 'giant creature hidden in the mountain'/'Te Ka' similarity. My current opinion is that they made Moana, he saw the slight similarities and figured it would be an easy payday. I'm open to be convinced otherwise, especially once he show his hand.

Winx Club managed to beat the mouse when Disney tried suing them for copyright infringement with W.I.T.C.H. Which was released as a comic in 2001 whereas Winx Club was released in 2004. Winx Club won when they revealed to Disney their early concerts dating back from 1998-99. Since then Rai who made Winx Club became distrustful towards Disney, whereas the creators of W.I.T.C.H. Wanting to strike on their own, tried to sue Disney for the rights and failed, and W.I.T.C.H. Is history. End of story.

I'm afraid I have to disagree with Lion King vs Leo. I watched both as a kid and if it was a rip off/copy, I'd love both. There's only so much you can do if you have simple designs and simple story. And if you want a story about a royal family where your uncle kills your father (basically like Hamlet) you're going to use lions if you want to use animals instead of humans because of the simbolism. There are more differences than there are similarities with the humans being the biggest. You could change any animal in the Lion King with a human being and it would still work. In Leo, that doesn't work, because the whole premise of the story is to show interactions between humans and animals (Tezuka drew a Bambi-manga and was disappointed by the movie's lack of interactions with humans; that's what he used for Leo then). Using a lion as a character, on the other hand, isn't necessary and you could change it to any other animal, like for example a deer. The lion cub you've shown in the video also isn't Simba, but Mheetu, who was supposed to be Nala's brother. However, there's another Disney movie that's almost 1:1 to another movie. And... you might have guessed it... I love both :'D I haven't seen anyone talking about that yet, though. Propably because the movie wasn't popular enough. As for Moana, it sounds pretty similar. While individual ideas can't be copyrighted, the combination and execution can, which is why I'd also be very interested in the concept art and the outcome of the lawsuit. You can come up with the same story idea as someone else and have never spoken to that person, but you can definitely see if someone copied/borrowed that idea or not if there are too many coincidences. I see that regularly in the art space, where people copy other artist's art and pretend they came up with it themselves. Or call it "heavily referenced" which is just a euphemism for copying. And as people who worked for Disney have seen the screenplay back then, they could have "heavily referenced" the screenplay. Or it was a case of cryptomnesia... nonetheless, I'm interested in the outcome.
@dirge74597 сағат бұрын
Most of Disney's lifespan has literally seen them copying existing works or taking ideas from others. The amount of original ideas they've had are far smaller than the ideas they have either copied or stolen from others, even when Walt was alive. This is how creatively bankrupt Disney has been for nearly a century. Modern Disney has zero creative bones in it's body, especially given the advent of AI.
@RufioTheThird6 сағат бұрын
I agree with everything up until the AI point. You didn't bring up the live action remakes
@dirge74595 сағат бұрын
I meant the remakes within the "no original bone in their body". Making a copy and then a copy of a copy is not an original concept, and Disney has done this in spades for decades. I brought up the AI point because a lot of the bigger companies are using AI as outright replacement factors, not as an assist tool. AI is like a hammer, not an army swiss knife that is jack of all trades, master of none.
