That one has an N number so, unfortunately not part 103. An Aerolite would have a similar configuration and meet part 103 requirements. Best luck

Theoretically though, I imagine that you would be able to do that because if you make the weight requirements and it remains a single seater the “air vehicle” would be considered a home built ultralight and therefore bound to part 103 limitations without any of the Light Sport privileges. My best suggestion would be for you to consult the FAR section on Part 103 rather than going by what people tell you. Best luck!!

Can you get this with a more powerful engine (Rotax) and a two person enclosed cockpit? Of course, I assume that if there is the two person cockpit, then it should offer a parachute for two people.

Did Kitfox ever try a Verner rotory engine? They make a better engine than Rotec. 5,7, and 9 cylinder engines. I would buy a Kitfox with a 7 cylinder Verner engine over a Rotex any day. Rotec rotory engines fail too often, but they make great flat 4 cylinder engines. My favorite is their Rotec 915 turbo engine.
